Two San Antonio police officers who were effectively fired last year for sexual misconduct while on duty are appealing the decisions and likely will appear before an arbitrator this year.
Officers Rebecca Martinez and Eman Fondren both were served indefinite suspensions in April for repeatedly disabling their GPS units and having sex with each other while on duty, according to suspension paperwork obtained by the San Antonio Express-News through an open records request.
They appealed the decisions by Chief William McManus. An exact date for the arbitration has not been set, SAPD spokesman Sgt. Jesse Salame said.
According to the suspension documents, Martinez and Fondren disabled the GPS units on their vehicles two times in October 2015 and met with each other while on duty, once in the rear parking lot of a Home Depot store and another time at a private residence.
During the investigation, Martinez and Fondren denied they had sex while on duty, but investigators said they didn’t believe either officer.
On the same day the two met at the private residence, Martinez was dispatched to a disturbance with a knife call and waited 20 minutes from the time she was dispatched to begin driving to the scene.
Once she arrived, according to the paperwork, she did not activate her vehicle’s video recording device, violating department rules.
Martinez, who joined the force in 2011, was given a second indefinite suspension for taking photographs of a woman at the City of San Antonio Detention Center. The woman, who was not named in the suspension paperwork, allegedly assaulted Martinez earlier in the day.
Investigators said Martinez’s actions “amount to taunting” and were an “abuse of power,” the paperwork states.
Martinez was served two separate terminations because SAPD’s internal affairs department investigates complaints separate of each other, resulting in two outcomes.
That was not the first time Martinez had been disciplined. In serving Martinez an indefinite suspension in April, investigators cited a 15-day suspension Martinez received in August 2012 for actions in the previous year.
According to the disciplinary paperwork for that suspension, Martinez repeatedly confronted two cadets in her training class — one whom she was romantically involved with, and another who she said “placed her breasts in the face” of the cadet she was dating.
At one point, after the cadets graduated, Martinez called the female an expletive. She also showed up to the male officer’s apartment complex and refused to leave.
Martinez and Fondren were two of about 20 SAPD officers who were given indefinite suspensions last year, out of the 2,400 officers on the force.
