Man Shot, Killed After Entering Wrong Apartment

HUNTSVILLE, Ala. -- Police said a Huntsville man who mistakenly entered the wrong apartment was shot to death early Sunday.


Wendell Johnson, a police spokesman, said 34-year-old Gary Lee McCarty allegedly was drinking and locked himself out his apartment. Johnson said a preliminary investigation indicated McCarty tried to crawl through a back window and was shot by a resident who thought the man was a burglar.


The shooting occurred just after midnight on Webster Drive.


The unnamed resident was not charged, but Johnson said the case could be presented to a grand jury by the Madison County D.A.'s office.

It's the victim fault that he drank too much and forgot where he lived. But damn, I hope the person that shot him felt they were in some kind of imminent danger and not because they felt entitled to kill an intruder. I'd feel bad knowing he lived in the same complex and wasn't a threat.

I'd be more than a little concerned if someone were crawling into my back window unannounced, too.

I suspect that the man who shot the drunk guy asked him to stop, once or several times, and then the drunk guy...didn't or got aggressive.
 
thats messed up...but what would've happen if that resident didn't shoot..

sometimes you got to take those chances..... :smh:
 
This is one reason why Im not gun crazy and dont think everyone should own a gun.Its just to many people to eager to pull the trigger with no caution or whatsoever.

:smh:maybe shouting or just waiting a minute or two could have saved someone life.
 
if dude cant remember where he stayed at, hes obviously your neighbor, obviously hella drunk, crawlin through the damn window.... you shoot?!?!?!..... dude was entitled to but idk..... imma have to play the race card on this one, what were the races, could play a biiiiiiiig part on that....

maybe, or maybe an intruder crawls in your back window with a little more than simple burglary on his mind. you see he knows that you have a pretty young daughter in there or a sexy wife and plans on taking some liberties with them after he relieves you of your valuables.

now you being the compassionate anti gun advocate yells loudly in your most aggressive tone possible while clutching your trusty louisville slugger only to be met with the sound of a shot gun racking. now you have to explain to your child and wife why you can not and could not protect them.

the man was not wrong by shooting someone who was climbing into his back room window after midnight. no one with good intentions enters anyones dwelling in that way or manner so it is understandable to use force on someone at that hour. had it been day light and he could CLEARLY see if the intruder has a weapon in his hands or not then i might say a different level of response could possibly be warranted. he has a responsibility to protect his family and his home. (period)

Unfortunately, we'll never know exactly how the situation went down, as the only other known party in the incident is sitting in the morgue.
 
The man did nothing wrong, nobody should be crawling through your window and its not your job to find out their intentions.

Thats how you get killed.
 
Can't say my response in the same situation ... u don't know how u react until you go throu it personally . I spoke to my boy about a similar situation that happened in our home town . Me catchin' someone stumblin' and bumblin' throu my window would catch Louisville slugger . But that my response throu thought .... it's totally different in the middle of the ordeal ! :(
