Following about two-and-a-half hours of deliberation Thursday, the eight-woman, four-man jury found Reggie Bernard Burks Sr., 47 not guilty on a charge of assault with a dangerous weapon, a four-year felony and guilty on a charge of resisting and obstructing police, a two year felony. The second verdict was the less-serious of two options the jury had for the resisting and obstructing charge. The more serious option was resisting and obstructing causing injury, a four-year charge.

After hearing one-day’s worth of testimony Wednesday, the jury began deliberations at 9:02 a.m. Thursday and announced their verdict at about 11:30 a.m.

The charges stem from an incident that took place during a traffic stop in front of the entrance to the Northern Michigan Regional Hospital emergency department on Sept. 18.

According to testimony and a tape from a police cruiser video camera, Petoskey officer Todd Troxel attempted to make a traffic stop on a van driven by Burks’ wife Jacqueline near the U.S. 31/131 intersection. Reggie Burks testified that his wife was driving him to the hospital after he was injured in a fall. Jacqueline Burks did not pull over for Troxel until reaching the hospital at which time a verbal confrontation ensued between Troxel and Jacqueline Burks. While Jacqueline and Troxel were arguing, Reggie Burks exited the vehicle and moments later broke his wooden cane over Troxel's head.

Burks testified Wednesday that he hit Troxel in self-defense because he thought Troxel was about to shoot him or his wife.

Charges, including resisting and obstructing, fleeing and eluding police, possession of mislabeled prescription drug containers and several misdemeanor traffic-related charges are still pending against Jacqueline Burks. Court officials were waiting for the outcome of this case to schedule the trial in Jacqueline Burks’ case.

Following the verdict Burks’ defense attorney Hillary Briolat told the News-Review that both she and her client were happy with the verdict.

“Nobody likes to see a police officer assaulted and nobody likes to see someone’s rights violated,” Briolat said. “I think it came down to whether the jury thought it was self defense.”

She noted that the jury was not allowed to consider a “self-defense” defense in the resisting and obstructing charge because higher courts have held that a person may not resist police even if the officer’s actions are unlawful.

Both Emmet County Chief Assistant Prosecutor Duane Beach and Troxel declined comment following the trial citing the pending case against Jacqueline Burks.

Although the maximum penalty on the resisting and obstructing conviction is increased to 15 years because of a habitual offender, fourth offense sentencing enhancement, the state’s sentencing guidelines make it unlikely that Reggie Burks will receive a prison sentence on the conviction, Beach said.

Burks will be sentenced on his conviction in about a month. He remains free from custody on a personal recognizance bond in the meantime.

"I pulled you over for failure to signal and loud exhast"......umm let me translate....."i pulled you over for driving while black". The officer was totally out of hand for not letting the man seek medical care before issuing a VERY PETTY traffic ticket.
 
The real issue is our police system is fucked up. Being pulled over for a loud exhaust and not using a turn-signal is bullshit. Those people should have never been in the situation. I'd rather have the police sitting eating donuts. That whole situation is not "to serve and protect".

That is not the case and THAT is for the doctor to decide. That is just as bad as a cop holding a woman up who is pregnant for a ticket. Get real, the woman told the Cop she would gladly comply and accept her ticket, she just wanted to secure the medical care first.

NOW, you tell me ONE reason that the situation warranted him NEEDING to issue a ticket first. NOT for HIT AND RUN, NOT for SPEEDING, NOT for MURDER, but for a failure to signal and loud exhaust. That is just pure HARASSMENT.

There also wasn't a reason for the dude to jump out of the car and whack the cop over the head with a cane. However the situation may have turned out if he had done nothing, the jackass pretty much assured himself how his day was going to end up the moment he swung.

But hey, some people just have to stick the fork in the socket...
 
Horrible misuse of authority and I would have seeked charges against the cop for harrasing a citizen and if the man's injuries would have been life threatening neglegent homicide. They gotta realize they should not abuse their power, but I don't think that will ever change.
 
I love two things here..

Me myself have been a victim of Racial Profiling Many Times and I understand her frustration. This is why some of us on this board including myself LOVE to hear when Police get killed. Especially when they get shot in the fuckin face:cool:

cops..there is no reasoning with them.
for the most part..i have actually been pulled over, at 3am and my license wasnt right.
i was 4 minutes from my house and he told me to go home.
i do realize i could have also been shot 41 times, theres no clear solution to dealing with them.
you cant assume they are all power-tripping racists, if you treat a good cop like a PIG..he will likely become one.
assume a PIG is a decent person and you could lose your life.

oh yeh..and the cane across the brain was excellent

I spent a number of years in law enforcement both in and out of the military. I cant speak for anyone other then myself.

You guys look at not signaling or running a stop sign as bullshit but a line has to be drawn somewhere. I arrested a white man who had attacked a black boy when all he did is not use his turn signal.

I always tried to be very polite during a traffic stop. I would have let them go inside and at get triaged. I can always write a ticket later.

I disagree about the comments above that you cant protect yourself from a cop when his actions are illegal. Suppose you come home from work and a cop is raping your girl? What would you do? I know what I would do.

On the side of the road is not where you are going to win a fight with a cop. Be polite, note the time and location, get his name if possible and deal with him through the courts or internal affairs.

Oh yeah in my opinion cop was out of line. If I was taking my mom to the hospital I would have told him once what was going on then went and got the wheelchair.

This happens to you flip your hazards on and dial 911. Remember everything is being recorded "This is so and so Im in a blue mini van Im on such and such street going to the hospital there is a cop trying to pull me over" The dispatcher is going to tell you to stop. Tell her no and to call the cop on the radio. it will help you in the long run

I still don't think that a failure to signal warrants that cop acting like that because if that man were to develop some type of lasting illness, brain damage, etc from being held up for a stupid ass ticket, then all the sorries in the world would not make it go away. I usually don't condone beating cops, but in this case:dance:


I realize alot of police may just be trying to do right, BUT as a black man i have been on the other side of harassment WAY too many times. Just minding your own business, lights go off behind you....oh i thought your tail light was out, oh i thought you swerved, umm your tint is a little dark.


The ultimate kicker was getting a ticket in downtown Baltimore for pissing in a back alleyway at night when none of the businesses in the area had public restrooms....and the officer asked if he should arrest me. C'mon now Baltimore is in the top ten dangerous cities in the US, but they have time for this shit. I had to go to court, wouldn't let me just pay and plead no contest for this DUMB shit. Even worse was a brotha in court who got a FUKKIN $10 ticket for riding a bike on the sidewalk.:hmm:

I think people fail to see why he hit the cop. The cop was grabbing at his wife, when she was doing nothing wrong. If a cop did that to my wife, I'd do the same thing. A cop want to grab on somebody, than he can try me and I'd do the same thing the man did with his cane.

they are AT the hospital. so he gets a wheelchair and sees the guy into the hospital and THEN writes her a ticket. that dumbazz gonna say 'u should've called an ambulance????'

they're in the car. why would you pull over, call up an ambulance, wait for who knows how long to go to the hospital when u can get there QUICKER in your own car since you are DRIVING! dumb azzed cop.....then again, if that cop had a better career choice, he would've taken it.
