Man, 79, sentenced to 90 days of house arrest in 5-year-old girl's rape

A man in California was sentenced to just 90 days of house arrest and five years of probation after pleading no contest to statutory rape of a 5-year-old girl.

According to KTXL, 79-year-old Lyle Burgess does not have to register as a sex offender.

"The girl is not doing good," family attorney Ken Meleyco said of the girl, who is now 7. "She's showing all the symptoms of somebody who's been molested. She's in counseling, and she's gonna be in counseling all her life."

KTXL said Burgess founded Rare Parts Inc., an automotive parts manufacturer and distributor.

"He's obviously very wealthy and it's just an example of how the wealthy people, time and time again, escape the penalty for what they did," Meleyco said.

Meleyco said Burgess was a friend of the girl's family and the assault happened after the family was invited over to a cabin owned by Burgess.

"They trusted this man, he was a family friend, and he took advantage of them," Meleyco said.

The girl and her family has filed a civil suit against Burgess.

An Oregon judge sentenced a cop for sexually abusing a girl under the age of 16.

Woodburn cop Daniel Kerbs, 29, was sentenced to 150 days in jail and five years of probation by Washington County Judge Charles Bailey.

Two months before, Kerbs admitted to sexually abusing a girl under the age of 16 and soliciting sex online from the daughter of a family friend.

Police reports say Kerbs knew the girl through her family and was once considered friend of the victim's family.

Kerbs was arrested on July 27, 2015, and booked on 13 sex crimes against a minor including sex counts of third-degree sodomy, six counts of second-degree sexual abuse and one count of first degree online sexual exploitation of a child.

Kerbs repeatedly abused the girl from 2013-2014, according his indictment, which explains how Kerbs solicited the girl online for sex and followed through with steps to meet her on various occasions without the family knowing.

He was only busted after an 18-year-old girl, his victim, contacted Tigard police during the summer of 2017 and reported she's been raped by Kerbs years earlier.

Washington County Judge Charles Baileysentenced Kerbs to jail time that's less than typical for raping a child, but stipulated in his agreement that hinges on Kerb's ability to enter into rehabilitative treatment.

Judge Bailey also ordered Kerbs, who is required to register as a sex offender, to stay away from minors and to pay for his victim's therapy and counseling, according to OregonLive.

The sentence was so ridiculous, even Kerbs' former police chief, Woodburn Police Chief Jim Ferraris, said the lack of justice provided by the court was 'unfortunate.'

"It's disappointing at best," he said, adding that Kerbs was a sworn officer for his department when he "chose to commit these child sex crimes."

The day before he was arrested, officer Kerbs was placed on paid administrative leave pending an internal affairs investigation.

Following his arrest, Kerbs spent a week in jail before being released on a $140,000 bond with the requirement he stay away from minor children.

Kerbs, who worked for the Woodburn Police since since January 2015, resigned as a patrol officer in March of 2018.
