You didn't listen to the Breakfast Club interview. She was told the girl was 16 and she was 17, didn't know her age til the tape was in the public. Then she was at the first trial. In the State of Wisconsin, all three could face charges. No Romeo and Juliet, no "close in age" protections. Age of consent is 18 and even if it were two 16 year olds, they could BOTH be charged simultaneously.
