Anybody read how she did up the black plaintiffs suing for racial discrimination? She threw the case out I believe even though a settlement had been reached. Conservative, black, right wing justices like Clarence Thomas are not the issue. It is these left wing, black, justices, dog whistling non sense about President Trump that can provide much better racial cover for the Supreme Court. Clarence Thomas couldn't really do that from the right, she can do significant damage to us. There can not be any question marks about her coming from the left versus a right wing black justice that can be easily dismissed.

With President Trump, they wanted to project this image of us repudiating him using BLM, Lebron James, kneeling, criminal, civil prosecutions, and Charlottesville. There was police shootings under President Obama, and you did not hear anything about BLM, BLM was used to smear President Trump as being a racist. If we openly embraced President Trump stance of manufacturing revitalization and ending these horrendous trade deals, it would look bad.

SMH. This has already been discussed several times. Had she let that one case proceed, black employees would have been giving up the rignts to sue for anything discrimination-related ever. It would affect all the black employees, including ones not currently involved in the case, and future employees. She was protecting their rights.
 
MSM put out that argument meant to explain away her decision. I read through her decision, serious question marks about her that we can't tolerate from the left. We can have slippage from a black right wing Justice, but there is zero tolerance from the left.

Making it harder to certify a class action lawsuit is pro-corporate. Many of the black defendants don't have the money or the time to take on Lockheed Martin in court. You expose yourself to being blackballed bringing a lawsuit on your own. You might lose out on your individual claim, but you gain significant legal manpower efficiency with being class action. Having 5,000 defendants saying the same thing is a powerful message to the jury that a practice is widespread and consistent.

This is what I am talking about her dog whistle ruling against President Trump meant to draw Biden attention and this slicked up decision meant to look like she was looking out for black workers. No, she will not be trained.

I guarantee the GOP already met with Judge Brown secretly behind closed doors long before these hearings to give her a heads up on what they are doing. Letting her know it ain’t real and play along.

Sen. Cory Booker, D-N.J., brought Supreme Court nominee Ketanji Brown Jackson to tears Wednesday with an impassioned speech hearkening to the plight of Black Americans and the efforts of their forebears that led Booker and Jackson to be sitting together in the same Senate hearing room.

“It’s hard for me not to look at you and not see my mom. Not to see my cousins, one of them who had to come here and sit behind you. She had to have your back. I see my ancestors and yours,” Booker said. “But don’t worry, my sister. Don’t worry. God has got you. And how do I know that? You’re here, and I know what it’s taken for you to sit in that seat.

“You have earned this spot,” Booker said. “You are worthy. You are a great American.”

The fourth Black person elected to the U.S. Senate, Booker recalled that when he first arrived in the Capitol a decade ago, some Black members of the cleaning staff would hug him after hours and thank him.

At various points during Booker’s presentation, Jackson, who spent much of the last two days fending off attempts by Republican senators to derail her historic nomination to the high court, reached across the witness table in the room and pulled a tissue from the pack and dabbed her eyes.

Throughout his monologue, Booker cited the Black men and women who had helped pave a path for Jackson and himself. He talked about how the abolitionist Harriet Tubman was beaten before she escaped slavery, then went back to save other slaves, establishing a network of safe houses. Tubman, Booker said, would gaze at the night sky looking for a star that was a “harbinger of hope.”

“I thought about her. And how she looked up, she kept looking up no matter what they did to her she never stopped looking up. And that star was a harbinger of hope,” Booker said. “Today, you’re my star. You are my harbinger of hope. This country’s getting better and better and better. And when that final vote happens, and you ascend on to the highest court in the land, I’m going to rejoice.”

Booker’s role in the proceedings seemed to be to shift the mood in the hearing room. The only Black member of the Senate Judiciary Committee, he used his time to put the attacks made against Jackson’s past sentencing decisions or briefs written as an attorney in a different light than the one employed by his Republican colleagues.

“I mean, this is a new low,” Booker said of the GOP attacks, especially the claim made by Sen. Josh Hawley of Missouri that Jackson went easy on child pornography defendants. “What’s especially surprising about this is it didn’t happen last year [when Jackson was nominated to the U.S. Court of Appeals for the D.C. Circuit]. You were put on a court that I’m told is considered like the second most powerful court in our land. And you were passed with bipartisan support. Nobody brought it up then. Did they not do their homework?”

The hearing room was quiet during Booker’s remarks, the audience transfixed. When he finished and the hearing adjourned for a 15-minute break, Booker was approached by Republican Sen. John Kennedy of Louisiana, who complimented Booker on his performance and offered him a hug. Booker then moved on to Jackson’s parents, who he embraced.

It's a Hail Mary attempt from the GOP to get a Black woman to denounce CRT (a framework of legal analysis which looks at how institutional racism affects society historically and taught in graduate school) on a national stage, that fell flat as fuck. Basically, pandering to their base, offering some red meat.

It's not like most of the GOP members are going to vote for her anyways since she's not the Clarence Thomas 2.0 they were dreaming of that dabbles in MAGA activism. She will be the only Justice who was also a Public Defender because she wanted to better understand both sides of the Law.

Thurgood Marshall went through the same thing with questions containing "soft on crime" and "not one of us" implications during his confirmation hearings as well.

The Lockheed Martin case was a class-action suit in which the plaintiffs claimed to represent more than 5,500 current and former Black Lockheed employees. Because it was a class action, Jackson had a duty to protect the interests of the Black workers who were not in court but who would still be bound by the terms of the settlement. Clemon is listed as counsel to the firm that brought the case.


Jackson found in 2017 that the proposed class did not satisfy what is called the “commonality” requirement, which is designed to ensure that there is enough overlap between all the class members’ claims for it to make sense to resolve them all together. In doing so, she was applying a 2011 — and controversial — Supreme Court decision about employment discrimination class actions. The problem with the settlement, Jackson concluded, was that the proposed class of Lockheed employees “encompasse[d] individuals with widely varying experiences of discrimination.”


Jackson also ruled that the proposed settlement was not fair, reasonable and adequate because many Black employees would be abandoning potential discrimination claims without knowing what they were giving up and what monetary compensation or other relief they were likely to get in return. Every one of Lockheed’s Black employees would have had to give up all rights to sue the company for any kind of past discrimination to obtain a settlement in this one particular case, which challenged one particular employment practice of the company. Jackson believed that the trade-off was unfair.

I did some further research after reading your excellent response based on a questionable news outlet trying to protect her. Lockheed Martin put this poison pill in the settlement, knowing KBJ would get this case and terminate the agreement. It was never a settlement because it had this clause providing KBJ an opportunity to throw it out while looking like she is protecting our interests. In this case, the Lockheed Martin provided her cover as a judge, and she provided them racial cover to toss the settlement out and validate this Supreme Court Decision. Expect similar type of highly deceptive activity that will affect us if she is nominated to the Supreme Court. We need another Clarence Thomas that will be black but is impotent in providing racial cover for racist Supreme Court rulings.

The legal explanation is that settling this would adversely affect black employees' rights to sue and receive relief for other discriminatory acts.

And since she didn't allow the settlement to be ratified did Clemons take his case to trial ?



Imagine you having to be subjected to recial discrimination because somebody else settled their case and got paid and part of that settlement would be you or I could not longer sue.

My issue is that those who used his letter were selective and didn't include that he was the attorney of record who didn't understand the law and how it would affect black folks who were not his clients.

Yes he was a civil rights attorney but Alabamas courts don't have a record or being fair or even judicial when it comes to black people.

Not to mention that Jim CLynurne is also described as a civil rights pioneer.

In any even Clemons should have known the statutes and saw that poison pill and it seems he didn't.
