In any event that's someone that would cease to be my friend. That shit is just inexcusable, I'd tell her that I didn't want to be friends anymore and cut off everything. And depending on what kind of business I had I wouldn't engage her in that.

That's like me having a homeboy that deserted/abused his kids. That ceases to be my friend and depending on the severity of the situation an altercation might ensue because you as a man ain't supposed to be doing that shit.

He can by right petition for more time. If he gets more time though he can then petition for a downward modification on the child support. Which is the real heart of this matter. What does he really want to do? Does he want to be there for these kids or is he ok with letting the mom run the show.

What is really stupid about this - Why did he not ask for joint LEGAL and PHYSICAL custody for the children? I think the ans maybe because he did not want to. But that would nip child support and give him more time with kids.

You can - and I have - request a psych eval before completing the signing of the pre nup in front of a judge for both parties.

Both of which are free and provided by thousands of non-profits in the US.

I want to get rich and set up a non-profit organization that's main purpose is to have legal representation/advice for fathers in this type of situation. Probably set something up in my area then branch out later. I don't have any children of my own but this has got to stop NOW.

Also, I got two questions: What's stopping the woman from going back to court every few years demanding more money? How much evidence is needed to prove that the woman needs more money per month?

You don't need to be rich to do this. If you have the will and some experience (or other with experience) you can do this.

I had 0 dollars when I started mine. Now I have 2 locations and service over 500 fathers a year. In 2007, I retired and only handle special cases but the programs are still going strong.
 
I don't think you guys are understanding exactly what's happening in the court with this case or others.

A parent that is receiving child support must fit certain critieria:

1) My be custodial parent or in a joint custody agreement must have the child(ren) living with them 90% of the time.

***by the way you can ask to not be ID'ed as the non-custodial parent if you put up a good case of how you feel is demeaning your role as a parent...the agreement can state both custodial parents with residence to x parent - this will put neither parent above the other***

2) The male non-custodial parent must be IDENTIFIED as the father through Acknowledge of Paternity, DNA testing or birth certificate.

With that said child support will not be awarded or be lower than the federal avg if:


1. The financial resources of the parents and of the child.

2. The physical and emotional health of the child and any special needs/aptitudes.

3. The standard of living the child would have enjoyed had the marriage or household not been dissolved.

4. The tax consequences to the parties.

5. Any non-monetary contributions the parent will make toward the care and well being of the child.

6. The educational needs of either parent.

7. A determination that the gross income of one parent is substantially less than that of the other parent.

8. The needs of the children of the non-custodial parent for whom the non-custodial parent is providing support, who are not a subject of the instant matter.

9. Provided the child is not on public assistance, extraordinary expenses incurred by the non-custodial parent in exercising visitation.

10. Any other factors the court determines are relevant in each case.

NOTE: For more complete and statutory language see the Family Court law in your area.

With all of this shit said - 9/10 if a dude is paying child support chance are HE WANTED TO - either by ignorance of the law or by being ok with it or - There is fraud by the other parent through non-disclosure.

All you got to do is speak up and present your shit right and shit gets killed - But you have to want to.
