Trump Pleads The 5th Amendment In Deposition By NY Attorney Generals Office


The New York Attorney General's office released video of a deposition given by Donald Trump last August in its civil fraud investigation against the former president.

Trump opened the deposition clarifying past public statements that he intended not to use his constitutional protection against providing self-incriminating statements, now instead saying "anyone in my position not taking the Fifth Amendment would be a fool, an absolute fool."

He proceeded to decline answers to all questions, repeating the phrase "same answer," all while appearing to closely examine documents handed to him by state attorneys.

New York Attorney General Letitia James later sued Trump and the Trump Organization, saying it misled banks and tax authorities about the value of assets like golf courses and skyscrapers to get loans and tax benefits.

That lawsuit, which is pending, could lead to civil penalties against the company if the Democratic attorney general prevails. She wants $250 million and a ban on Trump doing business in New York.

In the meantime, a judge has appointed an independent monitor to watch the company.

"The current schedule makes the preparation of a defense impossible," Trump's attorneys Alina Habba and Clifford Robert wrote. "Fundamental notions of fair play and due process mandate that Defendants are afforded every opportunity to prepare a meaningful defense, rather than to have an impossible schedule forced upon them."

Thirty-four days ahead of ex-President Donald Trump's New York civil trial for Attorney General Letitia James' " $250 million lawsuit filed against the 2024 hopeful alleging 'widespread fraud,' the banks and companies that lended the former president "millions of dollars for business deals" want to hide the proof from the public, The Daily Beast reports.

Per The Beast, Judge "Arthur F. Engoron, ruled that—aside from information like the home addresses of certain employees and bank account numbers—the public has a right to see the documents and communications."

According to the report, the judge said Tuesday that "he'd allow the companies to hide personal information, but he sided with the AG that most of the documents should stay in the open."

Engoron wrote, “Here, the non-parties have failed to demonstrate a compelling interest in favor of wholesale sealing that outweighs the public’s right to access and the presumption in favor of open judicial proceedings."

In a court filing, James said evidence shows that if Trump’s net worth were correctly calculated, it would be between 17% and 39% lower than what he claimed each year over the course of a decade, “which translates to the enormous sum of $1 billion or more in all but one year.”





The allegedly false statements included years when Trump was in the White House, according to the filing.

James’ filing comes two months before the trial is set to begin in the civil suit against the former president; the Trump Organization; and his sons, Donald Trump Jr. and Eric Trump, at New York Supreme Court in Manhattan.

James is suing the Trumps for allegedly defrauding banks, insurance companies and others with the use of false financial statements.

That trial would still take place to address other claims, even if Judge Arthur Engoron grants James’ request for partial summary judgment and finds Trump and the other defendants committed fraud under New York business law.

James, in her motion, says Engoron has to answer just “two simple and straightforward questions” to make that finding.

One question is whether Trump’s annual statements of his financial condition were “false or misleading,” the attorney general wrote.

The other question, she wrote, is whether Trump and his co-defendants repeatedly used the financial statements to conduct business transactions.

“The answer to both questions is a resounding ‘yes’ based on the mountain of undisputed evidence cited” in the documentation submitted by James’ office, the motion said.

“Based on the undisputed evidence, no trial is required for the Court to determine that Defendants presented grossly and materially inflated asset values in the SFCs [financial statements] and then used those SFCs repeatedly in business transactions to defraud banks and insurers,” James wrote.

“Notwithstanding Defendants’ horde of 13 experts, at the end of the day this is a documents case, and the documents leave no shred of doubt that Mr. Trump’s SFCs do not even remotely reflect the ‘estimated current value’ of his assets as they would trade between well-informed market participants,” the motion said.

CNBC has requested comment from a lawyer for Trump.

Donald Trump and three of his children will soon take the stand in a New York business fraud case.

A judge ruled on Friday that Mr Trump's daughter, Ivanka, must testify in the case against her brothers and father.
She was dismissed as a defendant in the case earlier this year - but her brothers Eric and Donald Jr were not.
The New York Attorney General's Office said the former president will testify on 6 November and his three children will take the stand before him.

Their testimony is expected over three days from Wednesday next week, starting with Donald Trump Jr.
Judge Arthur Engoron has already ruled that Mr Trump inflated the value of his properties to secure favourable loans.

The trial focuses on six other claims made in the lawsuit, including falsification of business records, insurance fraud and conspiracy.
Mr Trump has previously said he would take the stand at the earliest opportunity. He and the other defendants have denied the allegations.
His daughter Ivanka had previously sought not to take the stand, arguing that she had moved out of the city to Florida and had stepped away from the Trump Organization in 2017.
But Judge Engoron said she still maintains ties to Trump businesses and real estate in New York.
Prosecutors have argued that Ms Trump has important information to share about the events being examined in the case.
In his ruling on Friday about Ivanka testifying, Judge Engoron sided with the prosecutors, writing: "Ms Trump has clearly availed herself of the privilege of doing business in New York."

He cited documents showing that she still had ownership or management ties to some businesses in New York, and that she still owns Manhattan apartments.
The civil fraud case was brought against the former president by New York Attorney General Letitia James, who is a Democrat.

WASHINGTON — New York Attorney General Letitia James, a Democrat who has clashed with President Donald Trump, was indicted Thursday by a federal grand jury in Virginia, three sources familiar with the matter confirmed to NBC News.

James was charged with one count of bank fraud after Trump publicly called for his Justice Department appointees to bring charges against her.


As NBC News reported in August, Attorney General Pam Bondi appointed a special attorney to probe mortgage fraud allegations against the New York attorney general, who brought a successful civil fraud case against President Donald Trump before he retook the presidency. Though the text of the indictment is not yet public, the bank fraud charge appears to be related to the mortgage claims.

Federal Housing Finance Agency Director Bill Pulte had referred the case to the Justice Department, alleging that James had made false statements on mortgage loan applications. But the case hit a standstill last month because federal agents and prosecutors didn't believe they had the evidence to secure a conviction, two senior federal law enforcement officials told NBC News last month.

Trump then named one of his personal attorneys, Lindsey Halligan, to be acting U.S. attorney for the Eastern District of Virginia, though she lacked any prosecutorial experience.

Trump has repeatedly sought charges against his political enemies, including James and former FBI Director James Comey, who was indicted in September on charges of lying to Congress and obstructing a congressional proceeding.

“We can’t delay any longer, it’s killing our reputation and credibility. They impeached me twice, and indicted me (5 times!), OVER NOTHING. Halligan presented the case against Comey to a federal grand jury, doing so by herself in a break from DOJ norms and convincing a majority of the grand jurors that there was probable cause to indict Comey on two of the three counts she presented. Comey pleaded not guilty Wednesday and plans to challenge Halligan’s appointment.


The standard for securing an indictment before a federal grand jury is much lower than securing a unanimous conviction by a jury at trial. The Justice Manual, which guides federal prosecutors, says that attorneys for the government should only move forward on a case if they believe the admissible evidence would be enough to obtain and sustain a conviction.

"It would be interesting to see how many grand jurors actually voted for the indictment," former U.S. Attorney Carol Lam said Thursday on NBC News NOW. "In the case of Jim Comey, it was 14 out of 23. And I will tell you, as a prosecutor, if I had even one or two grand jurors expressing concern and not voting for an indictment, I would be very, very concerned because they are only voting on probable cause and they are not voting beyond a reasonable doubt."

Democrats swiftly condemned the Trump administration over James' indictment, much like they did after Comey was charged.

New York Gov. Kathy Hochul said Thursday on X that Americans were seeing “nothing less than the weaponization of the Justice Department to punish those who hold the powerful accountable.”
