So if I roll up on you and punch you in the face and you didn't say "don't punch me in the face" it is not assault. Understand you cannot touch people sexually or otherwise without their consent. Consent comes in many forms but it is the law and it is quite clear. If a women is too intoxicated to give consent then it is rape.

My fault I didn't include if the person says no. I was thinking about the actions of the person being accused.

As I already demonstrated, based on the current laws, intoxication is not an acceptable reason for believing a person didn't give consent and is therefor not repsonsible for their actions.
