Homeowner shoots dead two teens allegedly trespassing on his property in Ohio

The shooter was taken into custody by Dayton police for questioning about the deaths of the two 17-year-olds, but was not immediately charged with a crime.

Two 17-year-olds were fatally shot by a man in Dayton, Ohio, on Wednesday after they allegedly trespassed on his property, authorities said.

The man called 911 at about 9:30 p.m. to report that he had shot two people who were in or near his garage, according to the Dayton Police Department. The unidentified resident of the home said he saw a light from that area of the property and encountered three people inside his car in the garage.


He then fired a .38 caliber revolver, which killed two of the three people. The Montgomery County Coroner's Office identified them as teenagers Devin Henderson and Javier Harrison.

The third person in the car was arrested on a breaking and entering charge.

The man who shot the teens was taken into custody for questioning, and then released. He was not immediately charged with any crime.

Police said Thursday that they were consulting with prosecutors, as recent changes to Ohio law places the burden of proof for cases of self-defense on the state.

“It will take time for us to comb through the evidence and statements in order to determine if what transpired was a criminal act or an act of self-defense," Dayton Police Chief Richard Biehl said. "We ask for patience on behalf of the public as our detectives do their due diligence in investigating this case.”



"I need police, I shot two guys ... trying to do something in the house," the man told a 911 dispatcher, according to audio recording released on Thursday afternoon by the Montgomery County Sheriff's Department.

“They’re on the floor in the garage.”

The man and dispatcher appeared to struggle with a language barrier. The dispatcher asked twice if the two people shot were dead, and the man did not answer.

At the end of the 4 1/2-minute-long recording, the sound of police sirens could be heard in the background. The final second of the recording appeared to be of the man meeting police at the door, with him saying, "Here's the gun."

The scene of Wednesday night's shooting is about 2½ miles from Dayton's downtown entertainment district where a 24-year-old gunman killed nine people, including his sister, on Aug. 4.

And Monday, two 6-year-old girls were killed when a man suspected in a stabbing and driving a stolen police cruiser crashed into two vehicles near a library in Dayton, officials said.

I read this yesterday and I guess I'm not understanding...at least I hope I'm not understanding it correctly. So, lemme get this straight...A homeowner was at his home and saw a light on in or around his garage. He went to investigate, and upon arriving sees 3 teens in his vehicle. He then fired into the vehicle thus killing 2 of the 3 teens. He was briefly taken into custody but then released and no charges were filed because the police are trying to determine if he fired in self defense or did he break the law? According to this article, he was not in any immediate danger, nor did he see any weapons on the teens...correct? Ok, so if someone is on my property, I can shoot to kill with reckless abandon simply because they are trespassing on my property or attempting to steal my property? Do I understand this correctly? If so...its gonna be a long winter here in Cleveland! A long Cold Winter!

They are on the interior of his home, or property if the garage is detached. In WI, if you shoot 'em while they're climbing through the window and fall outside, you best go throw that body inside the house.
At least that's the way it was before Castle Doctrine and Stand Your Ground laws existed.

I am 100% OK with this shooting by the homeowner. Is he supposed to wait until one of the kids jumps out on him w/ a gun?! Plus he was outnumbered. He didn't know if all three had firearms.

Just a fatal decision made my those kids.

Not all homeowners would have shot them, I'm OK w/ that too, but for the one's that do, I'm cool w/ that as well.
 
This makes it pretty clear that the homeowner will not be charged.

In Ohio, there's a legal presumption that a person acts in self-defense when he or she uses force against anyone who unlawfully enters his or her residence or vehicle. Additionally, Ohio adheres to the castle doctrine, meaning that you don't have a duty to retreat before using force in your residence or vehicle.

That is not true. Once you attempt to break in a house the person can use deadly force to protect themselves. As soon as you break the window or door it is fair game. If you are actively trying to enter such as breaking down the door they can shoot through the door
 
I get it,I understand but I just look at things differently now that I have a kid and see how one simple stupid mistake can lead to something like this.
You know how many times I was on or near someone's property that I didn't know,taking short cuts,retrieving a ball or just doing something I wasn't suppose to do like climbing onto their garage roof or even inside,I was lucky I guess but even now that I have my own place I'm more understanding and I don't ever want to mistakenly kill anyone especially my own child;youtube pranks and all the shit like that going on...

You can replace most materialist items but can you replace a life or in some cases your own....it's just one of those things.

3 - Enter someone else's Car , inside the Garage ( why ? )
4 - That looks like a Triple inside someone else's property

Someone breaks into my garage, I’m shooting too. :dunno: Especially if I don’t see whether they are armed or not. Entering someone’s property is a deadly game.

I understand if they were knocking on a door or on the sidewalk but all bets are off once you enter someone’s house (yes, the garage is part of the house).

If true, I have no problems with this at all. It’s unfortunate and sad that these young men died but they where playing stupid games and you know the rest.
