Gotham City Question for the Fam

Now we all know that Gotham city is full of the criminally insane, mass murdering, low life scum..with all this said why isn't there a death penalty invoked there? i mean in the real world if you become a repeat offender of the same types of crimes eventually you will no longer be looked at as insane... i ask this because people like the joker have killed thousands and has displayed that he is somewhat of a criminal genius so does this make him insane? and if not why wasn't/isn't he executed for his crimes?

and on a side note since Gotham city is supposed to be the DCU's version of Manhattan (although New york does exist in the DCU) what state does it belong to?
