Fort Worth woman who fatally shot teen breaking into her home: 'I was protecting my kids'

A 14-year-old boy was killed. Police have not filed any charges, sending the case to a grand jury.

Aleah Wallace says she got a gun to protect her family after a handful of break-ins started just weeks ago.

The other burglaries happened when no one was home. But twice on Dec. 14, someone tried to get in.

"I was cleaning my living room sweeping my floor, and I heard my window start going back up. Wallace recalled. "So I went, and I stood in the hallway. And I could see him standing at the window, lifting it up. I just shot."

The gunshots killed 14-year-old Devin Baker, who was at the bedroom window of Wallace's 8-year-old daughter early morning on Dec. 14.

"It's bothering me that he was a kid," she said.

The incident happened not long after police left Wallace's home after responding to her 911 call about someone trying to break into her duplex.

"I called them at 1:22 a.m. She talked for like 20 minutes. They did a report, took pictures of everything and then they left," she recalled.

Wallace said she had four attempted burglaries before the last incident. On top of all that, she’s now being evicted.

"The apartments called and told me that I was not supposed to have a gun at all, even though I kept calling them and telling them somebody was breaking in. They told me I could not have a gun, and I have 30 days to vacate," she said. "I feel like I'm back at square one. I was there for six years, and now I don't know what to do."

The case is going to a grand jury. Wallace says she wants people to know she was just protecting her family.

"I have four daughters. It’s just me and my four daughters that stay there. I just was protecting my daughters," she said. "I'm devastated that he was 14. I hate that. I literally do. And I'm so sorry. But at that point, I had to think about my babies. I didn’t know he was 14 when he was on the other side of that window. All I knew was that somebody could come in and hurt me or my kids. That's it."

I wonder what the rules are in her state for blasting someone that broke into your home. Here in Ohio, I've always heard that the intruder has to be amed or about to harm you before you can blast him. If you're in my house and I didn't invite you, your wig is getting split.

Not in Texas.
As soon as he attempted to break in, all bets are off.
This case won't make it to the grand jury.

Texas allows the protection of property with deadly force...
She will not be charged and all she needs to do is put up a go fund me and
wait for all the Gun lovers of Texas to send the 100 racks she will recieve.

She did what she had to do but next time shout out and let whoever know that you're there and they better get out and go.

Mistakes happen and this kid might of grew out of doing what he was doing but this is a risk you take and he never thought he would of gotten killed or else he might of never done it.Some of us did shit,learned or moved on from doing things like that but thankfully we were given that chance to do that

or not letting him know this was a dumb ass idea.
She didnt owe him any warning, The warning shoud have come long before he left his house.
I blame parents for this type of shit
The only mistake is that he was born to a couple of dumb asses who didnt steer him correctly.

Its against the constitution for them to bar her from having a
weapon in her private residence even if its in her lease.
This is false. A private landlord does not have to follow the 2nd ammendment. If there is no law against it, a landlord can ban whatever they want.
Texas does have a law that forbids banning guns from rental units so she has a case, but the constitution has nothing to do with it here.

Well I digress....but I do know that in this state of Texas
Any attempt to impeed someone from protecting their property
or well being is a no go on private property which includes a place of residence, business or car being leased or rented.
ESPECIALLY ... if said landlord isnt providing proper security or proitection from outside intruders.
I cant and wont attempt to quote and statutes or codes....
however certain things are obvious based on the laws that I am familiar with.
Bottom line ... regardless of method.. she still has a case.
 
Police, did they mean the DA's office?
Why is a grand jury involved?
When whites kill Blacks and claim fright, the DA states no charges will be filed, case closed.

Seems they might be doing this so if the GJ is filled with racists whites, they
can show us their laws are only meant to be enforced on us.

She will lose her job, take a downfall, and then maybe after her life is ruined enough,
they will drop charges like things happened with Markynn West.

A lot of people feel this way but I don't when it comes to things like this and the individual being young.

Being able to live and learn is a blessing and mistakes are apart of it.

But I think I see why legal is involved.

Think you're supposed to wait until the burglar is inside the home. Standing outside still breaking in, attempting to or whatever, is a technicality.

As far as I remember, in Texas, you have to wait until they fully enter the dwelling and maybe have a weapon posing a threat then it's open season.

Shooting through a window, similar to this Latino dude who shot through his door when a burglar was trying to kick it in, is a fine line.

Hope she comes out in the clear.

On Friday night, the teen's family and friends came together to honor him at a balloon release outside of Rosemont Middle School, where he was an 8th grader.

"I know my child," said Landers. "I know him and it doesn't add up."

The mother says she wants more answers from police. "I feel like they need to dig deeper," said Landers.

Yeah that shit doesn't sit right with me. HoW the apartment complex is going to get high and mighty about protecting yourself.

When there was a history of break ins. If anything the apartment building. Should have put up some preventative measures. Whether it be temporary or permanent. To stop the break ins.

My 14 yr old child wouldn't be outside at 1am.

Just like in this case..dude's sister was trying to get a wrongful death suit going against the girl's dad,was posting pics of him holding children on Facebook,etc
