If he let her in the car and her weight DID cause damage to the tires and or suspension.
Or worse an accident BECAUSE the previous things happened?
How culpable is SHE?
I would assume if the driver did everything in their power correctly...
Wouldn't SHE be to blame?
Has there ever been a case when the passenger and not the driver were held liable for an accident?
