Do you automatically lose your seat in the senate.................

I have a question. Do the losers of the upcoming presidential elections that are current members of the U. S. Senate, or for that matter hold any other elected position, vacate their seat because they ran for a different elected post. I mean, can they be like "oh well, I lost back to my old job" :confused: Or is there a law that states you must give up the old position?

A senator does not vacate or otherwise give up his/her office by running for another office. If elected to another office, however, the senator would have to choose which elected position to serve since in almost all instances, a person cannot hold more than one elected office, at a time.

Nope. You can go back to being a Senator if your Presidential bid doesn't work out. Same for U.S. Reps.

Now, in some states they will make state reps/senators or county positions, step down if running for a different office.

Thats what Kerry did after losing to Bush. Hopefully McCain will have to go back to his Senate office and stare longingly out the window at Barack over at the White House.
