The Black Panther made his first appearance in comics in the Fantastic Four in 1966. Never heard of the Escapist, but Panther was around waaayyy before his stint in the Avengers.

Many of the stories were silent because the character was suppose to be mute and it was a little abstract for it's time and it was later dropped and incomplete.

He got a PROPER first appearance in 1966...with an alter ego and such.

I'm guessing the legal people weren't as on their toes then as they tend to be now.

IP Copyright back then were not page turners like they are now and many judges use to dismiss cases about 'Funny Books' all the time unless serious money was involved.

Captain America was rip off of SHIELD. The creators of SHIELD sued and eventually won - sort of. They were able to get cap to stop using his original shield which looked a lot like the chest armor of SHIELD. With the legal limbo over their heads the ppl that owned Cap at the time - froze him in ice storyline-wise and stopped using him to prevent further ligation.

The legal battle was a little too much for the small company and SHIELD fell into public domain. Marvel brought back Cap right when the company died.

This is all on Disney. I don't think they will be referencing the past universe of these book too much because of the bad blood. A lot of writers and artists from CrossGen are still looking for their checks and referencing those stories may open up Marvel/Disney for a suit.
