South African lawyers prepare lawsuit against UK, US over Gaza​

After South Africa filed a case against Israel at the International Court of Justice (ICJ) for genocide in Gaza, nearly 50 lawyers from the country are preparing a separate lawsuit against the US and UK governments on the grounds that they are complicit in Israeli forces' war crimes in Palestine.
The initiative, led by lawyer Wikus Van Rensburg, aims to prosecute those who are complicit in the crime in civilian courts in collaboration with lawyers from the US and UK, with whom he is already in contact.
Rensburg, who has been writing letters to various countries and the ICJ for the last few weeks demanding that Israel and its supporters be prosecuted, has begun preparations to file a lawsuit against the two Western countries, with the support of his colleagues.
"The United States must now be held accountable for the crimes it committed," Rensburg told Anadolu news agency in an interview, detailing the process by which Washington and London will be tried as complicit in Tel Aviv's war crimes against the people of Gaza.

Rensburg said he has been receiving a lot of support. "Many lawyers decided to join us in the lawsuit. Many of those who have joined are Muslims, but I am not. They feel obligated to assist this cause, but I believe that what is happening is incorrect."
'Enough is enough'
What happened in Iraq is an example of this, he said, noting that no one held the US accountable for the crimes it committed in the Middle Eastern country as the issue was not given the necessary importance.
But now people believe what is happening in Palestine is an ideal scenario for the legal process to be carried out, the South African lawyer said.
"The US is busy spending more money and more resources to (allow Israel) commit the crime,” he added.
“No one says stop, enough is enough," he observed. Israel's brutal war on Gaza - now in its 101st day - has so far killed at least 23,968 Palestinians and wounded 60,582 others, health officials say, as Tel Aviv insists on continuing its aggression in the tiny coastal enclave.
Possible sanctions
Rensburg said the genocide case filed by South Africa against Israel at the ICJ will serve as a guide for their case against the US and UK.
If the ICJ trial against Israel is concluded in favour of South Africa, Rensburg believed that the US may face sanctions even if it does not accept the verdict.
The ICJ ruling will also strengthen a case against the Joe Biden administration, he added.
Rensburg said he and his colleagues in South Africa are making preparations by contacting law firms in the US and UK.
Strong arguments
Reminding that Berlin is still paying compensation for the crime of genocide committed by Germany, Rensburg said “The US must now be held responsible for the crimes it has committed. It must accept its responsibilities."
Pointing out that similar cases were filed against former US President George Bush in the 2000s, the South African lawyer said they believed that they could successfully carry out the legal process abroad by working as a team.
He said South Africa made stronger arguments in the case in The Hague, and that he is intimidated by the argument that an attack against Israel could happen again if the court ruled in favour of South Africa.
Last week, the group of lawyers, which has now grown to 47, wrote an open letter to the leaders of the US and UK governments, stating that they could not avoid responsibility.

THE HAGUE, March 5 (Reuters) - The International Criminal Court (ICC) has issued arrest warrants for top Russian commanders Sergei Kobylash and Viktor Sokolov for suspected war crimes in Ukraine, it said in a statement on Tuesday.

The ICC, based in The Hague, said there were reasonable grounds to believe that the two were responsible for "missile strikes carried out by the forces under their command against the Ukrainian electric infrastructure from at least 10 October 2022 until at least 9 March 2023".

"All wars have rules. Those rules bind all without exception", ICC Prosecutor Karim Khan said, adding that he would continue to seek cooperation from Russia, which has so far refused to engage with the ICC.

This is the second set of warrants for the arrest of Russian officials related to the war in Ukraine.

Russia's defence ministry did not immediately respond to a request for comment.

In March last year, the ICC issued warrants for the arrest of President Vladimir Putin and Children's Commissioner Maria Lvova-Belova on war crimes charges related to the abduction of Ukrainian children.

Moscow denies war crimes in Ukraine and has dismissed previous ICC war crime arrest warrants as part of a biased Western campaign to discredit Russia. Russian officials say such warrants have little real world impact as Moscow is not a member of the court and neither are other major powers, such as the United States and China.

Kobylash, 58, was the commander of the so-called long-range aviation of the Russian air force at the time of the alleged crimes. Ukrainian military intelligence has said Russian strikes on the densely populated areas in the city of Mariupol were conducted under his command.

Sokolov, 61, was an admiral in the Russian navy who commanded the Black Sea Fleet during the period to which the charges relate, according to the ICC.

Ukrainian President Volodymyr Zelenskiy welcomed the arrest warrants.

"Every Russian commander who orders strikes against Ukrainian civilians and critical infrastructure must know that justice will be served. Every perpetrator of such crimes must know that they will be held accountable," he said on the social media platform X.

The ICC on Tuesday said the attacks on Ukraine's electrical grid caused civilian harm and damage that would have been clearly excessive to any expected military advantage.

Exact details of specific incidents and possible victims have been kept secret to protect witnesses and safeguard the ongoing investigations, the statement added.

ICC Prosecutor Khan visited Ukraine in March last year to investigate Russia's campaign of missile and drone attacks on power plants and other infrastructure that killed hundreds of civilians and left millions with no electricity or water.

The Geneva conventions and additional protocols shaped by international courts say that parties involved in a military conflict must distinguish between "civilian objects and military objectives" and that attacks on civilian objects are forbidden.
The ICC prosecutors also want the charges to label the strikes not only as war crimes but also as crimes against humanity because they say they were part of a state policy of widespread attacks on the civilian population.

American congressmen from both parties have warned the International Criminal Court that they are preparing retaliatory measures if arrest warrants are issued against Israeli authorities, Axios reports, citing sources.

According to the publication, Biden was personally urged to intervene by Netanyahu, who appears on the list of persons against whom a warrant could be issued.

The White House declined to comment on Netanyahu's conversation with Biden but said that "the International Criminal Court does not have jurisdiction in this situation and we do not support its investigation."

House Speaker Mike Johnson called the ICC's possible decision "disgraceful" and "lawless."

“If the Biden administration is unopposed, the ICC will be able to create and assume unprecedented powers to issue arrest warrants for American political leaders, American diplomats and American military personnel,” Johnson said.

He called on the Biden administration to "immediately and unequivocally demand that the ICC withdraw" and "use all available tools to prevent such an abomination."

Whilst the ICC is a legitimate court which deals with world events, I don't like how they pick and choose who they want to prosecute. Why isn't George Bush or Tony Blair not at the Hague over the atrocities in Iraq.

Turkey to join South Africa’s genocide case against Israel at World Court​

Turkish Foreign Minister Hakan Fidan says that Turkey would join in South Africa’s genocide case against Israel at the International Court of Justice (ICJ).

“Upon completion of the legal text of our work, we will submit the declaration of official intervention before the ICJ with the objective of implementing this political decision,” Fidan says in a joint press conference with Indonesia’s Foreign Minister Retno Marsudi in Ankara.

“Turkey will continue to support the Palestinian people in all circumstances,” he says.

The ICJ ordered Israel in January to refrain from any acts that could fall under the Genocide Convention and to ensure its troops commit no genocidal acts against Palestinians, after South Africa accused Israel of state-led genocide in Gaza. It did not find Israel was committing genocide.

In January, President Tayyip Erdogan said that Turkey was providing documents for the ongoing case at the ICJ, also known as the World Court.

Israel and its Western allies described the allegation as baseless. A final ruling in South Africa’s ICJ case in The Hague could take years.

The Israeli government warned the Biden administration that if the International Criminal Court issues arrest warrants against Israeli leaders, it will take retaliatory measures against the Palestinian Authority that could lead to its collapse, Axios announces.

Israel told the United States that they have information suggesting that Palestinian Authority officials are pressuring the ICCprosecutor to issue arrest warrants against Israeli leaders, two Israeli officials said.
One of the actions Tel Aviv may be considering would be to freeze the transfer of tax revenues that Israel collects for the Palestinian Authority. Without these funds, the PA would go bankrupt.

Meanwhile, two U.S. officials said the Biden administration has privately conveyed to ICCofficials that arrest warrants against Israeli leaders would be a mistake and that the United States does not support the action.
"We are quietly encouraging the ICC not to do it. This will ruin everything. Israel will retaliate against the Palestinian Authority," a US official said.

Egypt says it will join South Africa’s genocide case against Israel at ICJ​

Cairo says the move is due to Israel’s worsening attacks against civilians in Gaza.​

Egypt says it will formally join the case filed by South Africa against Israel at the International Court of Justice (ICJ), which accuses Israel of violating its obligations under the Genocide Convention in its war on the Gaza Strip.

The Egyptian Ministry of Foreign Affairs said on Sunday that Cairo intended to join the case due to escalating Israeli aggression against Palestinian civilians.

“The submission … comes in light of the worsening severity and scope of Israeli attacks against Palestinian civilians in the Gaza Strip, and the continued perpetration of systematic practices against the Palestinian people, including direct targeting of civilians and the destruction of infrastructure in the Strip, and pushing Palestinians to flee,” the ministry said in a statement.

South Africa brought its case against Israelin January, accusing the country of committing genocide against Palestinians in Gaza. The death toll from Israel’s war on Gaza, which began in October, has surpassed 35,000, and most of the dead are women and children, according to Palestinian authorities.

Israel launched the assault after Hamas led an attack on southern Israel, killing at least 1,139 people, mostly civilians, according to an Al Jazeera tally based on Israeli statistics.

The top United Nations court issued an interim ruling in January that found there was a plausible risk of genocide in the enclave and ordered Israel to take a series of provisional measures, including preventing any genocidal acts from taking place.

The court, which sits in The Hague, rejected a second South African application for emergency measures made in March over Israel’s threat to attack Rafah.

Egypt will join Turkey and Colombia in formally requesting to join the case against Israel. This month, Turkey said it would seek to join the case after the South American country asked the ICJ last month to allow it to join to ensure “the safety and, indeed, the very existence of the Palestinian people”.

Egypt said it is calling on Israel “to comply with its obligations as the occupying power and to implement the provisional measures issued by the ICJ, which require ensuring access to humanitarian and relief aid in a manner that meets the needs of Palestinians in the Gaza Strip”.

It also demands that Israeli forces do not commit any violations against the Palestinian people.

It will likely take years before the court will rule on the merits of the genocide case. While the ICJ’s rulings are binding and without appeal, the court has no way to enforce them.

Israel has repeatedly said it is acting in accordance with international law in Gaza. It has called South Africa’s genocide case baseless and accused Pretoria of acting as “the legal arm of Hamas”.

‘Diplomatic blow’​

Alon Liel, former director of Israel’s Ministry of Foreign Affairs, told Al Jazeera that Egypt’s move was an “unbelievable diplomatic blow to Israel”.

“Egypt is the cornerstone of our standing in the Middle East,” he said. The connections that Israel has in the Middle East and North Africa today, including with Jordan, the UAE and Morocco, are all “a result of what Egypt did 40 years ago”, he said, referring to the 1979 peace treaty between the two countries.

“With Egypt joining South Africa now in The Hague, it’s a real diplomatic punch. Israel would have to take it very seriously.

“Israel has to … listen to the world – not only to the Israeli public opinion asking now for revenge.

“We have to look overall in the wider picture, in the long-term security of Israel, not only in the next few weeks in Gaza.”


The latest legal development comes as Israel engaged in new battles with Hamas in northern Gaza and ordered tens of thousands more people to evacuate from the southern city of Rafah, which lies close to Gaza’s border with Egypt.

Israeli forces seized the Palestinian side of the Rafah border crossing on Tuesday, a day after Hamas said it had accepted an Egyptian-Qatari mediated ceasefire proposal, which Israel quickly rejected. The crossing had been the main entry point for aid into Gaza, but it has been closed since Israel took control of it.

Tanks and planes pounded several areas and at least four houses in Rafah overnight, killing 20 Palestinians and wounding several others, according to Palestinian health officials.

The city is crammed with more than one million displaced Palestinians living in dire conditions, and the international community has warned Israel that a full-scale Israeli ground assault would trigger a humanitarian catastrophe for civilians.

But Israeli Prime Minister Benjamin Netanyahu has said the Rafah offensive was needed to defeat Hamas.
