US Senate blocks bill sanctioning ICC​


The United States Senate has failed to secure the necessary votes to pass a bill imposing sanctions on the International Criminal Court (ICC).
The bill would have punished the court for an arrest warrant issued for Israeli officials, including Prime Minister Benjamin Netanyahu, for alleged war crimes in Gaza.
The bill recently passed the US House of Representatives, but received 55 votes in the Senate, five short of the necessary 60

The International Court of Justice (ICJ) on Thursday granted the African Union permission to participate in a case on Israel’s obligations regarding UN activities in occupied Palestinian territories, Anadolu Agency reports.
“The International Court of Justice has authorized the African Union, at its request, to participate in the advisory proceedings on the Obligations of Israel in relation to the Presence and Activities of the United Nations, Other International Organizations, and Third States in and in relation to the Occupied Palestinian Territory,” a statement from the ICJ read.
The African Union is likely to be able to provide information on the question put to the court’s general assembly, it said.
Therefore, the union will present a written statement on that question by Feb. 28, 2025, according to the statement.
 

Hungary to quit ICC as fugitive Israeli PM visits European state​

Hungary has announced its decision to pull out of the International Criminal Court (ICC), hours after the Israeli prime minister Benjamin Netanyahu – the subject of an arrest warrant – arrived in the European country for a visit.

In a message on Facebook, Gergely Gulyas, Hungarian prime minister Viktor Orban’s chief of staff said the country would begin the withdrawal process on Thursday “in accordance with constitutional and international law frameworks.”

The announcement came after Netanyahu arrived in Budapest, where he was welcomed in defiance of calls to bar or arrest the Israeli war criminal.

In November 2024, the ICC issued the arrest warrant against Netanyahu over war crimes related to Israel's ongoing genocide against Palestinians in the Gaza Strip.

The ruling obliged all the 125 countries, which signed the Rome Statute establishing the ICC, to detain and surrender Netanyahu to the Hague-based court.

However, Orban invited Netanyahu to visit Hungary the day after the ICC issued the warrant.

As a party to the Rome Statute, Hungary was required to act on the ICC warrant against Netanyahu, but it ignored its obligation.

Hungarian lawmakers have said that although the country signed the ICC's founding document in 1999 and ratified it in 2001, it was never made part of Hungarian law.

The visit to Hungary is Netanyahu’s second trip outside the occupied territories since the warrant was issued. In February, he met with US President Donald Trump in Washington.

Israel unleashed its genocidal war on Gaza on October 7, 2023, after the Hamas resistance group carried out its historic operation against the occupying entity in retaliation for the regime’s intensified atrocities against the Palestinian people.

The Tel Aviv regime has so far killed at least 50,523 Palestinians, mostly women and children, and injured 114,776 others, according to the Gaza Health Ministry.

The International Criminal Court (ICC) sent a request to the Hungarian government to arrest and surrender Prime Minister Benjamin Netanyahu to its detention center in The Hague, due to the arrest warrant issued against him by the court last year, it emerged on Sunday.

According to a report by Channel 12 news, the surrender request was sent several hours after Netanyahu landed in the country on Thursday, but the Hungarian government refused to comply, and promptly announced it was quitting the ICC.

In May 2024, ICC chief prosecutor Karim Khan requested from the court that it approve arrest warrants against Netanyahu and then-defense minister Yoav Gallant on charges of war crimes and crimes against humanity. The court approved the request in November 2024 and rejected Israeli appeals against them.

The warrants accuse the Israeli leader of directing attacks against the civilian population of Gaza and of using starvation as a method of warfare by hindering the supply of international aid to Gaza, during the current conflict with Hamas, which began with the terror organization’s onslaught against Israel on October 7, 2023.

ICC warrants require all member states of the court to detain and surrender the subject of the order to The Hague.

Netanyahu and the government have strongly rejected the allegations, pointing to efforts to facilitate the passage of large amounts of humanitarian aid into Gaza during the war, and insisting that the IDF does not deliberately target civilians.

The Supreme Court, acting in its capacity as the High Court of Justice, ruled last month that organizations that petitioned the court to order the government to increase the supply of aid to Gaza had “not even come close” to showing that Israel had violated legal prohibitions on starving a civilian population as a tool of war or as a form of collective punishment.

In the document sent to the Hungarian government on Thursday, the ICC wrote that its surrender request was “confidential” in order to enable the arrest to be executed. ICC arrest and surrender procedures are often kept secret in order to maximize the possibility of arresting the subject of a warrant.


The document also featured Netanyahu’s personal details, including place and date of birth, and the allegations against him.

“The Registrar requests the cooperation of Hungary to: Provisionally arrest the following person [Netanyahu] when the opportunity to do so arises in the event that he is present on their territory.” the arrest and surrender request stated.

The Appeals Chamber of the International Criminal Court (ICC) has rejected Israel’s request to cancel or suspend the arrest warrants issued for the regime’s prime minister, Benjamin Netanyahu, and former minister of military affairs, Yoav Gallant.

In a press release on Thursday, the ICC said it accepted Israel's appeal for a reconsideration of the Court's jurisdiction over crimes committed in Palestinian territories.

However, it added that this issue did not affect the situation of standing arrest warrants.

The issue of jurisdiction, the Chamber explained, concerns whether the ICC can prosecute individuals for alleged crimes committed in Gaza and the occupied West Bank.

The Court emphasized that Israel’s acceptance of its jurisdiction is not a prerequisite for continuing investigations.

It said, “Investigations indicate that Netanyahu and Gallant oversaw attacks targeting the civilian population and used starvation as a method of warfare.”

In November 2024, the ICC issued arrest warrants against Netanyahu and his former minister of military affairs, Yoav Gallant, for crimes against humanity and war crimes related to Israel’s ongoing genocide against Palestinians in the Gaza Strip.

The ruling obliged all the 125 countries, which signed the Rome Statute establishing the ICC, to detain and surrender the pair to the Hague-based court.

The Israeli prime minister traveled to Hungary, which is a member of the ICC, earlier this month.

The ICC asked the Hungarian government to arrest him, but Budapest refused to comply with the request and promptly announced it was quitting the court.

ICC condemned Hungary for refusing to comply with its arrest warrant against Netanyahu.

The court’s spokesperson, Fadi El Abdallah, said that it is not for parties to the ICC “to unilaterally determine the soundness of the Court’s legal decisions.”

The spokesperson further stated that participating states must enforce the court’s decisions.

Trump administration slaps sanctions on four ICC judges over Israel and US cases

The Trump administration on Thursday imposed sanctions on four judges at the International Criminal Court who have been involved in proceedings against Israel and the United States.

The four judges will be barred from entering the US and their assets in the country will be seized, measures typically used against officials from countries hostile to America.


“The United States will take whatever actions we deem necessary to protect our sovereignty, that of Israel, and any other US ally from illegitimate actions by the ICC,” US Secretary of State Marco Rubio said in a statement.

“I call on the countries that still support the ICC, many of whose freedom was purchased at the price of great American sacrifices, to fight this disgraceful attack on our nation and Israel,” Rubio said.


The court swiftly hit back, saying in a statement: “These measures are a clear attempt to undermine the independence of an international judicial institution which operates under the mandate from 125 States Parties from all corners of the globe.”

Prime Minister Benjamin Netanyahu’s office on the other hand hailed the sanctions, thanking the Trump administration for imposing them.

“Thank you President Trump and Secretary of State Rubio for imposing sanctions against the politicized judges of the ICC. You have justly stood up for the right of Israel, The United States and all democracies to defend themselves against savage terror,” said a statement from the premier’s office.

Two of the judges, Beti Hohler of Slovenia and Reine Alapini-Gansou of Benin, took part in proceedings that led the court’s chief prosecutor Karim Khan to issue in November arrest warrants against Netanyahu and former defense minister Yoav Gallant.

Khan claimed to find “reasonable grounds” of criminal responsibility by the pair for actions that include the war crime of starvation as a method of war in Israel’s massive offensive in Gaza following Hamas’s unprecedented October 7, 2023, attack on Israel, in which some 1,200 were killed and 251 were taken hostage. Israel has strongly rejected the charges.




Gansou also served on the bench that originally approved the investigation into alleged war crimes in the West Bank, Gaza Strip and East Jerusalem in 2021.

Before being elected ICC judge in 2023, Hohler worked in the prosecutor’s office at the court, leading Israel to object to her participation in the proceedings involving Israeli officials. Hohler said in a statement last year that she had never worked on the investigation that began in 2021 during her eight years as a prosecutor.

The two other judges sanctioned by the US, Luz del Carmen Ibanez Carranza of Peru and Solomy Balungi Bossa of Uganda, were part of the court proceedings that led to the authorization of an investigation into allegations that US forces committed war crimes during the war in Afghanistan. They both have also worked on ICC cases involving Israel.

In February, Khan was placed on Washington’s list of “Specially Designated Nationals and Blocked Persons,” barring him from doing business with Americans and placing restrictions on his entry into the US Khan stepped aside last month pending an investigation into alleged sexual misconduct.


Neither the United States nor Israel is party to the Rome Statute that established the International Criminal Court. The Palestinian Authority, on the other hand, is a Rome Statute signatory, in what the court has deemed is sufficient for hearing cases on alleged crimes that took place in Gaza, the West Bank and East Jerusalem.

Moreover, almost all Western allies of the United States as well as Japan and South Korea, the vast majority of Latin America and much of Africa are parties to the statute and in theory are required to arrest suspects when they land on their soil.

Trump, in his first term, imposed sanctions on the then-ICC chief prosecutor over the Afghanistan investigation.

After Trump’s defeat in 2020, then-US president Joe Biden took a more conciliatory approach to the court with case-by-case cooperation.

Rubio’s predecessor Antony Blinken rescinded the sanctions and, while critical of its stance on Israel, worked with the court in its investigation of Russia’s invasion of Ukraine.

ICC judges in 2023 issued an arrest warrant for Russian President Vladimir Putin over the alleged mass abduction of Ukrainian children during the war.

Both Putin and Netanyahu have voiced defiance over the ICC pressure but have also looked to minimize time in countries that are party to the court.

The ICC arrest warrants have been especially sensitive in Britain, a close US ally whose Prime Minister Keir Starmer is a former human rights lawyer.

Downing Street has said that Britain will fulfill its “legal obligations” without explicitly saying if Netanyahu would be arrested if he visits.

Hungary, led by Trump ally Viktor Orban, has parted ways with the rest of the European Union by moving to exit the court.

Orban spurned the court by welcoming Netanyahu to visit in April.

Set up in 2002, the ICC seeks to prosecute individuals responsible for the world’s gravest crimes when countries are unwilling or unable to do so themselves.

Israel and the US have argued that they have their own independent judiciaries that eliminate the need for an international court of last resort.
