Re: Bouncer who slapped woman on F train said he'd apologize for smack as prosecutors

The fact he called her a bitch says a lot about him, why do men resort to women's behaviour

That's not a women's behavior, that is the behavior of a vicious creature in body of a female, she was rabid and relentless.

Cold glass of reality will sober her up now along with that conviction, she can rock her Steve Maddens in her cell while waiting to be sent up.

:smh::smh:

Dude is smart for the public apology and framing the situation. Dude is a large man that has to work on that city

Bouncer who slapped woman on F train said he'd apologize for smack as prosecutors ruled he acted in self-defense
A subway brawl ignited when he slapped a woman seen physically and verbally assaulting him on video. The case was dismissed Monday in Manhattan Criminal Court

Jorge Pena (c.), with lawyers Joseph Indusi (l.) and Cary London, hold jacket that fellow straphanger ridiculed which ultimately led to subway brawl.

Still, if he saw the woman he accused of verbally and physically assaulting him, he’d say sorry for striking her in return, he told Daily News.

“If see her I’m going to apologize to her because a man should never hit a girl,” said the new dad, who works all kinds of jobs to support his girlfriend and 20-month-old son.

Pena had just finished a 12-hour shift when the woman and her friends attacked him on the F train, he said.

After hurling insults at him, she slapped at him and hit him in the back of the head with her high-heeled shoes, according to a video of the fight that’s since gone viral.

Another woman also jumped on Pena. She beat him with her clutch purse, her criminal complaint says.

Pena plans to sue the city over the bad arrest, the man’s lawyer said Wednesday.

He was released after prosecutors found he was acting in self-defense, his lawyer, Cary London, said.

The case was officially dismissed Monday in Manhattan Criminal Court after the DA’s office reviewed the tape, which shows Pena getting harassed by the women.

One of them, identified as Danay Howard, 21, in a criminal complaint, can be seen berating Pena, who towered over her.

She also made fun of his jacket, which has a large 8-ball on the back, on the F train.

Two of her friends can be seen laughing and egging on Howard.

Pena, who speaks with a heavy accent, said he didn’t know any of the women. He heard them making fun of other passengers when he got on the train, he said.

He didn’t know why they turned on him.

“I don't talk to you. I don't know you. Just leave me alone. I don't know why you're talking to me,” he said to Howard, when she demanded to know if he and his friend had been whispering about her.

Howard called him a “bum ass n****” and “stupid,” Pena said. She also made fun of his 8-ball coat.

Pena remained silent until Howard moved away. She noticed a man filming her and slapped the camera out of his hands several times, the video shows.

In the video, as Pena tries to walk past her, he is heard calling her a b****.

Howard takes the high-heeled boots she's holding in her hand and clocks him on the back of the head with them, the video shows.

Pena turns around and slaps her hard enough to send her flying back several feet — then her friends and another man jump into the brawl.

One of the women who jumped up to hit him was identified in a criminal complaint as Shanique Campbell, 21. She whacked at Pena with her clutch purse, the complaint said.

Pena was arrested with the two women and another male. Pena had to go to the hospital to get a cut near his ear stitched up and another near his nose, he said.

“I have never been in trouble before. I've never slapped someone,” he said, adding that his arrest experience was horrible.

“I am quiet man ... I respect women. That's why I don't do nothing when she pushed me but when she hit me I had to do something. I had no choice,” he said.

He was thrilled to learn the charges against him were dropped, he said.

His lawyers are still probing all aspects of the litigation, including whether his attacker has some liability.

“She is ultimately the reason he was put in the situation,” said attorney Joseph Indusi, of London Indusi LLP.

“We're currently investigating with an eye toward possible future civil litigation,” he said.

A lawyer for Campbell said his client denied insulting Pena or getting involved in the altercation with him.

"We are working with the DAs office to work out a favorable disposition as soon as possible," said attorney Greg Gomez.

Campbell's been accepted to Onondaga Community College and plans to attend in January, he said.

"She hopes to put this behind her as soon as possible, go to college, move on with her life and put this unfortunate incident behind her," the lawyer added.

Campbell has been charged with misdemeanor assault and disorderly conduct.

Howard was charged with felony assault and disorderly conduct.

Kevin Gil, 21, who was also involved, was charged with misdemeanor assault and disorderly conduct.

Their charges have not been dropped, a spokesman for the Manhattan District Attorney said.

Former minor league pitcher who slapped a woman aboard F train sad because he can’t wear his favorite 8-Ball jacket anymore
Jorge Pena, 25, said Thursday that the fame he's achieved do to the YouTube video showing him smacking a woman in self-defense has forced him to stop wearing his beloved jacket.

He won his freedom - but might lose his favorite jacket.

The Bronx bouncer who slapped a woman after she taunted him about an 8-Ball jacket - sparking an epic subway brawl - said Thursday he’ll have to leave the coat in the closet this winter.

“I can’t wear my jacket anymore,” a choked-up Jorge Pena, 25, said a day after it was revealed Manhattan prosecutors dropped all charges against him, relying on the viral video that reveals he was defending himself.

The former baseball prospect from the Dominican Republic was talking at his lawyers’ office while wearing the infamous 8-ball jacket.

But out on the streets, sporting the coat triggers negative reactions, like: “This is the man who slapped a girl,” Pena said, adding he’s also apprehensive about taking the subway.

The 6-foot-6 father slapped Danay Howard, 21, with a right hand that once tossed 98 mph fastballs when he pitched for the Oakland Athletics' minor league squad, before his dream ended with a knee injury in 2011.

Jorge Pena said he’s disappointed that he may no longer get to wear his favorite winter coat.
“I’m going to say to her, ‘I’m sorry,’” he said of Howard. “You left me no choice.”

A cell phone video from the F-train ride early Saturday - which has been viewed on YouTube some 5 million times - tells the story.

It shows Howard teasing Pena about the “ wack 8-Ball jacket that came out in 1990” and cursing him out. She then slugs him with a 6-inch stiletto.

That was when he unleashed a massive smack that sent the aggressor flying backwards and started a free-for-all.

“I never in my life slapped anybody,” said Pena. “I’m a strong man. I don’t want to get in trouble because I can kill someone.”

Pena’s slap has caused him web notoriety, with the video garnering about 5 million views on YouTube.

Pena’s slap has caused him web notoriety, with the video garnering about 5 million views on YouTube.
His lawyer Joseph Indusi, of London Indusi LLP, decried the fact that his client spent days in jail on a $1,000 bail for a misdemeanor, while Howard, charged with felony assault, was released without bail. Two of her cohorts have also been charged.

The attorney didn’t discuss a planned lawsuit against the city or a meeting with Manhattan prosecutors.

Another lawyer, Cary London, noted that without the video, “Mr. Pena would have had to go to court for a year” before possibly clearing his name.

But the footage is a double-edged sword, bringing unwanted notoriety to the shy gentle giant, who was returning from a 12-hour shift and said he just wants to provide to his family and 20-month-old son.

And he also wants winter wear because the 8-Ball jacket - which he received from his brother and only wore about four times - is now an apparel pariah.

“I don’t even have a jacket to wear,” said Pena. “I love that jacket.”

Hey this guy needs to use this new notoriety to get that knee checked out again and see if he can get back on the diamond pitching, 6"6" even if he took it easy and became a knuckleballer. He could name one of his pitches for that knuckle sandwich he applied on be ach's face.

A woman who attacked a club bouncer with her stiletto heel during an early morning subway fracas took a plea deal Thursday.

Danay Howard, 21, copped to two counts of assault, including a felony, but will see her charges reduced if she completes a year of therapy and does three days of community service for the November assault.

Howard was seen on a cellphone video that went viral berating 6-foot-6 Jorge Pena, calling him a “bum ass n-----” and making fun of his dated 8-ball jacket during the 4:20 a.m. dustup on an F train.

She clocked Pena, 25, in the head with her sharp heel as her pals cheered her on.

Fed up, Pena turned around and slapped her hard, causing Howard to tumble back — a blow that is also clearly seen on the footage.

Howard was charged with felony assault. She pleaded guilty Thursday.

The man, 25-year-old Jorge Pena, was arrested, but the charges were later dropped because he acted out of self-defense.
