Thomas Thorpe, 51 is facing life in jail for attempted murder, but what he most wants isn't a defense it's no black lawyers standing next to him. Not being around blacks is more important than having a free lawyer!

Thomas Thorpe told a judge in Orange County Court. “I pleaded not guilty and I don’t want this negro standing next to me. I don’t want a negro standing next to me.”

The judge wants a mental evaluation performed on Thorpe to determine if he is legally insane. Dear Judge, Thorpe isn't insane. He's just a bigot. There are a lot of them walking around or haven't you noticed?

The conclusion reached from those separate opinions should be advocating for the black man's legal rights to be respected, not for the white man's rights to be taken away. If you're basing your opinion solely on the information in this thread, you have nowhere near the necessary knowledge to question the judge's motive or true opinion of that man's sanity. Mental health is a serious issue in this country and we have far too many people in prison who are mentally ill. Yes, some of them are racist pieces of shit but the legal system doesn't and shouldn't set the ideal for justice as simply what people would like to see happen to bad people.

What rights were taken away? You have a Constitutional right to legal representation. Not for concern and needless mental evaluation birthed from expressing race based hatred in a Court of law. What I did was gave you first hand account of what would happen if a black man were to express similar objections to representation in a Court of law based on the race of his appointed counsel (let alone while facing charges of violent felony). Though America is shamefully not among them, many executions have been prevented on the basis of cruel and unusual punishment. It may not be a constitutionally explicit right but those are not the only rights there are.

Not that this passage deserves a response but, I'm far from unemployed. I've been bottom-level, low-level, mid-level and approaching high-level. I've seen street racism, corporate racism and, yes, legal racism. I would think a lawyer would understand that one can defend a bigot scumbag without agreeing with him or failing to understand inequality.

My initial post is two fold; 1) the judge failed to adequately and appropriately respond to a defendant espousing hatred and disrespect in his court room. 2) A black person behaving similarly would not have been afforded that same treatment.

I'm not arguing that the defendant did not receive special treatment, simply that a similar level of concern should be shown for everyone. I'm not expressing a belief that he is mentally ill but I see no harm in screening and a reasonable ascertation should be easy to produce.

I also never suggested the judge adequately/appropriately responded to the defendant's hate speech or suggested you disputed his right to representation. It seems like you responded to a lot of arguments that weren't made.

Though I do not automatically cede any argument to someone who claims or has more experience-- because experienced people can differ or be wrong-- I readily concede that you have a better understanding of the legal basis for a judge to order a mental evaluation. You're clearly not "basing your opinion solely on the information in this thread," as I said if you were, you had nowhere near the information to do so. But your first post was more a hateful mini-screed than an argument against the merits of an evaluation. Again, I would defer on those merits if that argument were made; I'm simply saying I'd rather see any arguably questionable case result in a "needless evaluation" than see a mentally ill person denied a needed evaluation. Rather than attack a white waste of space receiving the benefit of the doubt, I think a more constructive approach is to focus on getting every bit of that same benefit for blacks and others as much as possible.

Preciate it man... Yeah being a public defender was a rough 4 years of my life. It's shit like that that caused me to get out of the criminal defense game all together. I give alot of respect to those that continue to practice in criminal law, because this shit happens everyday.
