BANDAID found in FOOD

My girl eats at Boston Market everyday and on Friday she found a bandaid under her chicken breast. She reported it to the resteraunt, kept the food and reciept, and called the health department. The bandaid was rolled up and obviously used.

I was to know what step should I take in terms of legal action? Can we get $$$$$$$$$ due to their negligence? She is shaken up, has a loss of appetite, and will be getting a blood test on Monday to make sure she doesnt have anything.

I called several lawyers today and had everyone tell me that I have a case, but they either wanted big money upfront or they didnt handle these kinds of cases. Where the fuck is the lawyer that sued McDonalds for the coffee burning the lady???????? I'm in LA CALI so if anyone is a paralegal or attorney or has a recommendation to one please post ur imput. Thanks in advance.
 
Man unless you can prove some damages, it aint worth the effort. You shoulda had the manager to give you some gift cards for the inconvenience and kept it moving.
 
First thing, a cook or chef should know about is food safety and sanitation. The person, that handled the food, may have had an injury, which excluded them from handling food with bare hands. He or she, should have been wearing gloves. Especially in California and numerous other states, look for grading, given by health departments. Check out the scenery, watch the wait service and the cooks. Read up on the place, before you eat there. The cook, is the first line of defense against health code violations. Then there is the chef or kitchen manager supervisor, next the restaurant manager.

You may choose to contact all types of restaurant associations health departments. They could be in violation, of all types of health code violations. It may be a matter of researching, what is, public information.

Some valid questions, ask yourself...

The whole establishment, could be held liable, but for what?
Was anyone injured, developed a sickness?
It's your word against theirs, how to prove the bandaid came from them...?
Given, the fact that they would offer a free meal or some type of comp, would you accept?
 
GETYOUHOT my primary argument is that my girl might have been exposed to a blood borne illness HIV, HEP or any other disease that doesnt even present symptoms for months. She consumed half the meal and found the bandaid under her baked chicken. She has problems sleeping not knowing what she may be exposed to, and I'm hesitant to be intimate because I dont know what she may have picked up. Any additional information is greatly appreciated.
 
Man thats to up but I know you can get some kinda compensation because i know you remember the story of the lady who found the finger in her food, well that turned out to actually be a scam but had they not found out she was scammin she would of been paid. I would either A check out the prepaid legal service or B keep tryin to find a lawyer the kind that dont get paid unless you get paid, they out there and im sure one of them will jump on it.

Does your state have a mandatory health checkup system for ALL, food service workers? Nevada, requires, anyone handling food to be tested, watch a film and pass a test. They have the highest standards, I have ever seen.

Get documentation from the clinic/hospital, about your experience. Arrange a consultation, with a lawyer & go from there. Good luck to you and your girl...
