CANOGA PARK, Calif – After consulting with APHSS medical professionals, the Free Speech Coalition today is calling for a moratorium on adult film production due to a performer that has tested positive for HIV.

“We are following established protocols,” said FSC CEO Diane Duke, “for the protection of performers.”

The moratorium will continue until further notice; APHSS will update industry stakeholders about the moratorium as more information becomes available.

There will be more as this develops, both performers are new to the biz. From what I have one is male one is female and they are a couple off camera. There is a call for a halt on shooting until this is resolved.

It's not the actual adult business is the problem. It's more so that people have sex with dirty or unclean people outside of the business and bring it inside the business. That is what gets them in trouble. I will give the adult business credit though, they act very swiftly when it comes these things so you will never have and an outbreak when it comes to HIV. It's always contained very quickly and patient zero is always identified. Everyone will eventually know who patient zero is.

Initially I always suspect it was either some amateur or some dude that did cross over films. Which is why most girls stay away from those guys from what I was told a while back.

LOS ANGELES — Diane Duke, CEO of Free Speech Coalition which administers Adult Production Health & Safety Services, said Wednesday afternoon that APHSS was in the process of identifying the “first generation” of scene partners of the performer who tested HIV positive.

“Once identified, the doctor will be able to check the APHSS database for first-generation testing dates and clearance,” Duke told XBIZ. “Those first-generation partners who have not tested out—which means tested negative two weeks or more after exposure—will be asked to retest. The retest will be paid for by APHSS either by reimbursing the performer or the testing facility.”

Sources said the performer is a female who is relatively new to the adult industry.

Duke said that APHSS has been reaching out to producers since learning of the test result.

“The doctor asked me to get a broad range of shooting information from a variety of producers,” she said. “The doctor will then pull from the data the information he needs. This gives the doctor comprehensive, accurate information without compromising the privacy of the patient and allows him to comply with all HIPAA requirements.”

Duke said she was informed about the positive test earlier today.

“My understanding is that the performer tests regularly but I do not have detailed information as to the last test date,” she said.

She said she has been in contact with the Licensed Adult Talent Agency Association (LATATA) about the situation.

"They have been very helpful and have offered additional assistance,” Duke said. “We will continue to work with them as the situation progresses.”

Multiple agents and producers confirmed to XBIZ Wednesday they are honoring the FSC’s call for an industry-wide moratorium on production and have cancelled all their scheduled shoots until further notice.

Meanwhile, Michael Weinstein, the president of AIDS Healthcare Foundation, said today’s development was further evidence of the need for mandatory condoms in porn.

“How many adult film performers have to become infected with an array of preventable sexually transmitted diseases—including HIV, which is not curable—before the porn industry actually complies with the law requiring condom use?” Weinstein said.

Weinstein is one of the five individuals who were the official proponents of Measure B, the Los Angeles County Safer Sex in the Adult Film Industry Act that requires adult film actors to wear condoms.

“Testing is not prevention,” Weinstein continued. “So far, the industry has considered running away from Los Angeles to shoot, considered not getting the required permits as well as brazenly continuing to break the law—they’ve considered everything except complying with the law. It is high time these laws requiring condom use by adult film performers—both Measure B and the previously existing Cal/OSHA statutes—are enforced on city, county and statewide basis.”

John Stagliano’s Wife Says Lawsuit For Failure To Disclose HIV Status ‘Without Merit,’ Former Porn Actor Will Fight Suit

Porn actress Katie Summers is suing porn director and former actor John Stagliano, who is better known as 'Buttman' in the pornography industry, for failing to disclose that he was HIV-positive when she appeared in a scene with him in 2009.

Summers filed suit in Los Angeles Superior Court against Stagliano and his company Evil Angel, alleging "negligence, intentional infliction of emotional distress, [and] sexual battery" in connection with her performance in the movie Buttman's Stretch Class 4, which was released in 2010.

"Actors engaged in sexual contact during the productions of adult films in the state of California are as a matter of custom and practice, required to provide evidence of testing for HIV and are not allowed to engage in sexual contact if they have a test which indicates they are HIV positive," the lawsuit, which was obtained by XBIZ.com, says. "... As a result of Stagliano's wrongful conduct, [Summers] has suffered damages."

Stagliano has known that he is HIV-positive since his diagnosis in 1997.

In an exclusive interview with XBIZ.com, Stagliano's wife Karen said that the suit is without merit and that he intends to fight the allegations. "John and the company feel that he did not do anything with Katie Summers that would warrant having to inform her of his HIV status," she said. "He had no genital contact with her, no sexual touching of her genitals at all that would have put her at any sort of a medical risk whatsoever."

Karen also said that Stagliano's HIV has been undetectable for over 15 years. According to Advocate.com, an HIV positive person is considered "undetectable" when they have undergone antiretroviral therapy and their viral levels fall below a measurable point. One study indicated that early antiretroviral therapy could reduce the risk of HIV transmission by a whopping 96 percent. But that does not mean the virus has been cured and those who come in sexual contact with even an undetectable infected person are still at risk — as small as it may be — of contracting the disease.

Stagliano is not the first porn actor to face legal consequences for exposing his colleagues in the profession to a sexually transmitted disease. Just last month, adult video star Mr. Marcus was sentenced to 30 days in jail, 36 months of probation, and 15 days of community labor after he exposed his female co-stars to syphilis in an outbreak that caused the pornography industry to close its doors for nearly two months.

Summers has not specified the damages she is seeking in her suit, but she has asked the judge for a preliminary injunction, which would prevent Stagliano and Evil Angel from producing films unless he discloses his HIV status to others.
