Apple quietly settles lawsuit

According to Ars Technica, Crave, & Cnet - 2 well known photographers filed suit against Apple over false adverstising.

Apple has quietly settled a lawsuit over its advertising practices in connection to the displays used on the MacBook and MacBook Pro. As usual, the terms were not disclosed, but the circumstances make it appear that Apple wasn't the only party trying to make the lawsuit go away.

The plaintiffs, Fred Greaves and Dave Gatley, originally brought the suit against Apple in May of 2007, alleging that Apple's displays were "grainy" and "sparkly," and that some customers had observed banding (when the display shows you bands of different shades when it is supposed to display a smooth gradient). Their proof, aside from their own observations, were pages of printed discussion threads from Apple's support forums. The lawsuit alleged that customers who complained about the displays were allegedly told that they were being too picky or that they were imagining the problems.

What the problem ultimately came down to was Apple's advertisement of "millions of colors" on its displays and its apparent use of dithering in order to achieve those "millions." The traditional 16.7 million colors advertised for many displays can be achieved through an 8-bit channel, but the plaintiffs believed that Apple actually used 6-bit displays, which generate 262,144 discreet colors before dithering. Apple does not advertise where its displays come from, but some digging showed at the time that Apple did make use of 6-bit displays in its MacBook and MacBook Pro lines.

The plaintiffs called this an illusion: "The reality is that notwithstanding Apple's misrepresentations and suggestions that its MacBook and MacBook Pro display 'millions of colors,' the displays are only capable of displaying the illusion of millions of colors through the use of a software technique referred to as 'dithering,' which causes nearby pixels on the display to use slightly varying shades of colors that trick the human eye into perceiving the desired color even though it is not truly that color."

Now, its probably not a big deal to peeps that only use their machines for just surfing the net & itunes, but to professional photographers, this is not a good thing

At the time, the plaintiffs were seeking to turn the suit into a class action, as they believed that a large number of people had suffered from Apple's apparent bending of the truth—particularly those who rely on color accuracy in their displays, like photographers. However, according to a Chicago Tribune blog, they were apparently unable to get other members to join the class. "it was difficult to find other people who were wronged because they had bought Macs solely based on the 'millions of colors' claim," a San Diego County Superior Court clerk told Tribune writer Eric Gwinn.

Why could that be? Some commenters noted that digital cameras are capable of shooting 10 bits per channel and that Photoshop can edit up to 16-bit, so Apple's use of 6-bit displays is not only unsuitable for the professional photographer, but its advertising that it is suitable is even worse. However, even many of the better displays on the market are only 8-bit per channel—those photographers who want to edit things in 16-bit are either using very high-end displays or already settling for something lesser.

In the end, it appears as though Apple and the plaintiffs decided to cut their losses. Although we won't know what amount the company settled for, Apple-watchers are sure to keep an eye on Apple's advertising to see whether it changes over the next few MacBook and MacBook Pro revisions.

Damn! Between the two professional photographers they have a combined 50 years experience in the professional field. Now, I see why they were able to notice what others wouldn't.

I take it that you don't own a apple 'cause if you did you wouldn't say such a thing.

:lol::lol: Why not? But I will give Apple fanboys/PC fanboys their credit for sticking by their sides, no matter what.

I really don't think its wrong when a customer/user admits that something is wrong or just have a problem with a product. I would have use for the Mac OS, but on my hardware preference. That way I don't have to be told what to use, but rather I use the parts I like along with the software I like. But before you know it, the Mac OS will eventually end up on Apple & PC machines alike, regardless how much Jobs don't like to let control go. He opened that door when he allowed the x86intel platform inside. So now he has allowed for users to have the Mac OS on pretty much any x86platform we choose to, just have to violate the EULA, but who cares about that shit.

Yes I know a lot of people will say but its the "Mac Experience" that makes the entire purchase worth while. Well a lot of users just want the "Mac OS" without the other stuff to go along with it. Apple doesn't make the hardware anyway. So let us use ATI or Nvidia GPUs. Use WD, Hitachi, Maxtor, or Samsung for HDDs. Creative for the best audio. AMD or Intel, ah you get the picture. Well maybe you don't. Not everyone likes to have unlimited choices to pick from. No I'm not saying Apple is trash, just saying I like any option of hardware & software, is and should be my choice, not Jobs.

well i own both and i have to say i prefer PC for graphic work and apple for audio work (and i started doing graphic work on Mac and audio on PC) go figure....
 
Apple is just good for the software if you have a specific use for it. If you're just surfing the net, who the hell cares. Apple products are a total fucking rip as far as hardware goes though.
 
exactly...and I own a Mac book pro.....but im gonna buy myself a Lenvo(formerly IBM) Thinkpad
I'm thinking about getting a new laptop. Looking at the Lenovo & the Toshiba. Nothing major like a true desktop replacement, just Docs, surfing, little photoshop & movies from time to time.

Apple is still the #2 Computer manufacturer in the world and the #1 rated OS in the world and a Multi 100 billion dollar company so before you jump on the bandwagon ask your self what's your net worth?....and what have you made that's number #1 rated (without lying to yourself) then use your answer to decide if this bullshit was post worthy!
 
The Plaintiffs were probably ... and upset that their favorite picture wasn't being displayed in all its multi-colored brillance.

In other words, they do like the products but don't lie about what it can and can't do. They pour in great amounts of money for these products only to find out, it was misleading. They more or less want Apple to fix it and stop advertising what it really can't do.

Also, sorry to tell you but Apple is doing well, but they are no where close to #2 in sales in the U.S.A, let alone the world. Also, being that the large majority of the world uses PCs, still makes XP not OS X nor Vista #1 OS. Now Apple users will rate the Mac OS #1, but even then the big buzz of the OS, is that you can run XP on it since adopting the x86 Intel chip. You will find the rankings at IDC.

"Success has enemies!".... "More money more problems"...... "No matter how great your product or service somebody will sue you"...ect, ect.....no matter how you spin it this is far from post worthy except for Apple Haters:smh:

Nothing to hate on, no different from any other tech news of another company. This is just a heads up, and that Apple will probably fix the display problem ASAP or let buyers know which one to get to avoid problems. Tech news is just always about new products, reviews, sales, delays, & lawsuits.

Now if someone could review the Psystar Open system and post it would be great.

Das cool just pointing out that most photographers who use computers have chosen their mac/pc platform and will stick with it no matter what, serious photographers will do what they have to to make their money...

So info only noteworthy for those beginning photography or looking into a computer for editing or marketing thru the internet.

Most experienced photographers are smart enuf not to trust what they see on the screen anyway.

For Apple this is just a hiccup in progress....not a mass recall.
