Samsung may have pulled off an incredible feat by getting five major US carriers to pick up nearly-identical versions of the Galaxy S III, but if Apple has its way the launch won't go as smoothly as we've been expecting. The Cupertino-based company has filed a motion requesting Judge Koh to have Samsung's headline Android smartphone blocked in the US before it starts shipping later this month. Specifically, Apple has requested that the judge add the Galaxy S III to its current motion for a preliminary injunction against the Galaxy Nexus, the hearing for which is set for tomorrow. Apple argues that the Galaxy S III is similar enough to the Galaxy Nexus to be bundled in the same motion, and if it gets its way it won't have to submit a new request and — more importantly — it may block Samsung before it gets its new devices into customers hands.

Specifically, Apple claims that in its brief analysis of a UK-sourced version of the phone, the Galaxy S III infringes two of the four patents that its going after the Galaxy Nexus for: universal search and smart links (like those on phone numbers that push users out to the dialer). Apple hasn't yet concluded whether or not the other two patents (slide to unlock and keyboard suggestions) are also infringing, but due to the similarities it says that both smartphones can be judged together. Samsung, in its opposition to the motion, says that "This should not be done on two days' notice, without due process, and with no factual record whatsoever" and that "Adding a new product to this motion would significantly change the analysis of all four preliminary injunction factors." Samsung says that should Apple wish to seek a preliminary injunction against the Galaxy S III, it should enter a separate motion, giving both parties enough time to analyze the evidence. We'll let you know whether or not Judge Koh grants Apple's request as soon as we hear it.

Apple chief Tim Cook might have said that he doesn't like lawsuits, but he must have left a loophole open for International Trade Commission disputes. His company quietly filed a third challenge against HTC on June 4th (just now coming to light) that -- surprise -- claims HTC is still violating patents that it supposedly worked hard to avoid.

If successful, Apple would slap down 29 devices that include a much more modern set of hardware than the first two disputes, including the One X (and EVO 4G LTE), One S and One V. Apple had success in December with the final results of its first ITC complaint and may simply be rolling the dice to try for more. Whatever throw Apple lands, there's no doubt that HTC and its fans are exasperated at the thought of more launch delays, or worse.

Agreed...I copped the OG EVO when it initially dropped, and always said that if Apple dropped a 4inch plus screened phone (rumored to be the iPhone5) i'd definitely buy it, but after all of Apple's pettiness w/all these patent suits i'm completely turned off by the company...their business practices pushed me to buy the new EVO, when I had planned on buying the iPhone5.

Apple can kiss my ass. They are the reason HP/Palm stripped out options from the webOS facebook app, they got pissed it was better than whatever they were offering. After reading the verge article: http://www.theverge.com/2012/6/5/3062611/palm-webos-hp-inside-story-pre-postmortem Due to apple cornering the market on parts, HP could not get top notch parts for the touchpad. I wish samsung would have bought Palm. Palm has a ton of patents, some of which apple is probably infringing on. If webOs makes it to open source, I hope samsung puts it on one of their phones.

Been using iphones since 3g dropped...I cant even front the Galaxy SIII has my attention. That shit is NICE. If the iphone 5 dont come with it ...I am copping the Samsung

The only reason I went with the EVO/OneX was that it felt more sturdier in my hand/aluminum unibody (assuming the Galaxy 3 would have a similar feel to the Galaxy 2)and that HTC phones seem to get more frequent updates as compared to past Samsung phones...outside of those variables i'd rock with the Samsung.

And I ironically i'd originally planned on getting the rumored 4+ inch iPhone5 until all of this shady and petty litigation by Apple.

I spend that much on a phone. Gives me all the power when it comes to negotiating my phone plan cost. Buy a hot new phone for $600, wait a couple months, sell it for 500, get the newer phone.

You'd be surprised. The first phone I paid $500 for was the i930 in 2005. Prior to that I spent damn near as much when the i95 had dropped. If folks want it they will pay for with no problem. My Galaxy S2 was retailed at $685 this time last year but it cost just over two and change as an upgrade. Meh they're relatively expensive toys :).
