What I don't understand is why can't Apple get her photo's back?

Sure the money is gone, that's up to the banks.

However the pics are stored on Apple iCloud servers, it would be nothing for an Admin to login to said server and access her Apple ID account without the need for any passcode info other than server login credentials.
