Orlando cop investigated after body camera surfaces showing rough arrest

The Florida State Attorney’s office is investigating an Orlando police officer after discovering that his department did not provide body camera footage related to an incident in which he punched and kicked a handcuffed man, WFTV-TV reported.

Authorities might charge Officer William Escobar in connection with his arrest of 25-year-old Refus Holloway this past March. Footage taken by Holloway’s sister shows him handcuffed and laying on the ground face-down when Escobar punches him in the back of the head. However, Escobar said in his report that he hit Holloway because he was “attempting to stand up” and resist being handcuffed.

The Orlando Sentinel reported at the time that Escobar encountered Holloway, a former military police officer for the Air Force, during an incident at a relative’s home.

“Refus was trying to tell the police officers what happened,” Hollway’s lawyer, Bradley Laurent, told the Sentinel. “He wasn’t yelling, he wasn’t being belligerent in any way shape or form.”

Holloway was arrested and charged with resisting arrest without violence, but the charge was later dropped.

The footage also shows Escobar grabbing Holloway by the wrists and dragging him, as well ask kicking him. Escobar said in his report that the kick was in response to Holloway curling his leg as if he wanted to kick the officer, but that was not reflected in the footage.

However, Orlando police did not enclose or mention the body camera Escobar was allegedly wearing at the time of the encounter.

A former St. Louis County police officer who is already facing invasion of privacy charges was indicted for allegedly videotaping a teenage boy’s genitals with a hidden camera, the St. Louis Post-Dispatch reported on Friday.

Prosecutors charged 33-year-old Chesterfield officer David Cerna with with sexual exploitation of a minor and second-degree invasion of privacy of multiple people for allegedly using the camera to film the teen and two other men under their clothes between August 2013 and this past January.

Authorities found footage after obtaining a search warrant and seizing Cerna’s computer. He is scheduled to be arraigned on the latest charges against him on Oct. 22.

Cerna, a six-year veteran of the department, was fired this past June after being arrested and accused of invasion of privacy following a report by KTVI-TV connecting him to camera hidden inside a gas station restroom, where Cerna allegedly filmed customers using the facilities without their knowledge.

Another camera was found in a St. Charles County home, where Cerna allegedly lured anonymous men with an online posting promising the use of a “gloryh*le.” Footage from both cameras was then reportedly posted online without the subjects’ consent.

“It was rather shocking of course and took a minute to sink in,” Chesterfield Police Chief Ray Johnson said at the time. “But we realized the severity of it and just set out to deal with it immediately as we would with any other suspect.”

Milwaukee police fire officer who shot man in park

MILWAUKEE (AP) — Milwaukee Police Chief Edward Flynn has fired an officer who he said instigated a fight with a mentally ill man that eventually led the officer to shoot the man 14 times, killing him.

Officer Christopher Manney, 38, was dismissed nearly six months after 31-year-old Dontre Hamilton's death. Activists have compared the shooting to that of Michael Brown, an unarmed, black 18-year-old shot by an officer in Ferguson, Missouri.

Hamilton was sleeping in a downtown park when Manney responded to a call for a welfare check and began a patdown. Flynn said Wednesday that Hamilton resisted and the two exchanged punches and strikes before Hamilton hit Manney on the neck with Manney's baton. Manney then shot Hamilton.

Flynn said that while Manney correctly identified Hamilton as someone who was emotionally disturbed, he ignored his training and police policy and treated him as a criminal.

"You don't go hands-on and start frisking somebody only because they appear to be mentally ill," Flynn said during a news conference announcing the firing.

Hamilton's family has said he was diagnosed with schizophrenia but was not violent, and they doubt he struck Manney. They called Wednesday for police to release photographs documenting the officer's injuries. They also said that while the firing was "a victory," they would continue to lead and participate in marches in an effort to persuade the district attorney to bring criminal charges.

"Yes, he was fired, but he took a man's life," Hamilton's mother, Maria, said during a separate news conference.

His brother, Nate Hamilton, said the family remains hurt and their grief would not ease until they feel justice is done.

"Dontre did not attack this man, he did not have to shoot Dontre at all," the brother said.

The Wisconsin Division of Criminal Investigation investigated Hamilton's death under a state law that requires an outside investigator to review all officer-involved deaths. The Milwaukee County district attorney's office has asked an unnamed investigator to do a second review, and an attorney for Hamilton's family said he was told the FBI is looking into it as well.

Milwaukee County Chief Deputy District Attorney Kent Lovern, who is weighing potential charges, had no comment Wednesday, his assistant Maureen Perez said.

Flynn said his decision was based on an internal affairs investigation. He sidestepped questions about whether Manney should face criminal charges. He said he found "errors of judgment, but no malice" in Manney's handling of the confrontation.

"There's got to be a way for us to hold ourselves accountable absent putting cops in jail for making mistakes," he said.

About 400 officers, or less than one-fourth of the department, have received the full, recommended 40 hours of Crisis Intervention Team training considered the model for dealing with people who are emotionally distressed. Flynn said that starting next year, all officers will receive at least 16 hours of training.

The Milwaukee Police Association condemned the firing.

"The decision to terminate this officer is cowardice and certainly unfounded and unsupported by fact," President Mike Crivello said in a statement.
 
The officers i know are great people. They are placed in stressful where they are viewed as the worst human walking. I don't see officers being horrible human beings. The officers i know raise money for the local neighborhoods they patrol. My officer friends know the neighborhood and neighbors personally.

Without historic covenants and officers living in my neighborhood who knows where would my community be.

Yes i know you have bad officers. You have more great officers than you do bad officers.

Man shot in head during traffic stop Monday; NOPD never publicly disclosed shooting

A man was shot in the head Monday during a traffic stop in Algiers, sending him to the hospital for the past two days with a serious but not life-threatening injury, the man's attorney said Wednesday. The shooting was never publicly disclosed by New Orleans police.

In response to this article, NOPD issued a written statement saying Armand Bennett, 26, "was shot" during the traffic stop, and an officer, unnamed by the department, suffered a minor contusion on the right hand.

Bennett was in an intensive care unit on Tuesday and was still recovering at the hospital Wednesday, said attorney Nandi Campbell, who visited him in the hospital.

LATEST: NOPD issues apology for failing to disclose the shooting
The man's brother was in the car at the time, and said he heard two shots fired by a female officer, Campbell said. The brother reported they were confronted by officers with their guns drawn while parked near the Tall Timbers subdivision, where one of them is a resident.

Details about what prompted the confrontation remain scarce. NOPD on Monday said only that an officer was wounded on the job, in what the department described as an "officer needs assistance" call, in which an officer's life was in danger. The department, despite receiving requests for information and records, did not disclose that anyone was shot.

Until NOPD responded to this story late Wednesday, the only public account of the incident read as follows:

The NOPD only confirmed the shooting after this story was published.

NOPD said once Bennett is released from the hospital, he will be booked on five outstanding warrants from Orleans and Jefferson parishes, including possession of marijuana, illegal possession of a weapon, resisting an officer, resisting an officer and criminal damage to property.

Police said the officer was near 3700 block of Mimosa Court around 1:30 a.m. when she heard gunshots, and then got into a fight with a suspect. She suffered a "minor injury" to her right hand.


Independent Police Monitor Susan Hutson, a watchdog unit within the inspector general's office that oversees officers' uses of force, was notified of the shooting and responded to the scene along with internal investigators.

The monitor's office is involved in the investigation, spokeswoman Ursula Price said, adding it was too early to comment on what happened.

"We've had some conversations with the arrestee's mother and attorney, and are considering their questions and concerns in our review," she said.

The NOPD's Force Investigative Team, which investigates officer-involved shootings, is overseeing the investigation.

"We are cooperating with investigators at this time," said the involved officer's attorney, Donovan Livaccari, of the local Fraternal Order of Police lodge.

"I will point out that the arrested subject was wanted in Orleans Parish and Jefferson Parish for resisting at the time of the incident," Livaccari said. "I am glad the injuries to the officers and the arrested subject were not life-threatening."

HOUSTON -- Houston-area authorities say they believe a school district police officer who pulled over a motorist and then asked to smell her feet may have made similar demands of others.

Twenty-six-year-old Patrick Quinn is charged with two counts of "official oppression." He's free on $2,000 bond.

The district attorney's office says Quinn stopped the woman in August and said he found marijuana paraphernalia. Authorities say Quinn told her he has a foot fetish and would release her if she let him smell her feet.

He later said he wouldn't need to smell them if she gave him her underwear. Investigators say he then changed his mind and let her go.

Quinn has been suspended by the Cypress-Fairbanks school district.

A call to his attorney wasn't immediately returned Tuesday.

Violent new video emerges of Michigan police shooting to death homeless man

Dramatic and graphic new video has emerged of a homeless Michigan man being gunned down in a hail of bullets fired by Saginaw police officers in 2012.

Martin Hall, 49, was facing eight screaming officers in a parking lot. A K-9 unit dog was lunging and barking at the homeless and mentally ill man, who was holding a pen knife.

Officers fired 46 times as Hall collapsed and died on the pavement.

Local and federal authorities declined to file charges against the officers, despite a flurry of protests from across the country.

On Monday, the ACLU released violent footage of the incident from a dashboard camera as part of its presentation to the Inter-American Commission on Human Rights in Washington.

Included in the presentation was footage from an interview with his mother, Jewel Hall, who said her son’s blood was “running down the street like water. And he wasn’t a threat, I mean, he had a little pen knife. He had no idea that those policemen would do that to him.”

The police had responded to a call from a shopping center merchant who had gotten into some kind of argument with Hall.

Ex-trooper coerced sex from women he stopped

The cruiser video that the Highway Patrol supervisor watched raised red flags.

The sergeant saw the trooper flirt with two women in a car that he’d stopped for suspected drunken driving. Then he turned off his microphone.

It was that September 2013 incident that led this month to charges against now-former Trooper Bryan D. Lee, who authorities say failed to charge women he’d pulled over in exchange for sexual favors.

Lee, 30, of Lancaster, pleaded guilty yesterday in U.S. District Court in Columbus to four counts of violating the civil rights of four female motorists, as well as one count of engaging in cyberstalking.

He will be sentenced later and could get up to nine years in prison.

Lee isn’t new to being investigated.

He’s the same trooper who was accused five years ago of not ticketing two fellow law officers who were going more than 100 miles per hour on motorcycles. And he was once investigated for possibly sexually harassing a woman after she filed a complaint.

Lee was found to have coerced sex from women he stopped or arrested; had sex with at least one; photographed sexual encounters with his cellphone; and stalked some of the women on social media, according to U.S. Attorney Carter M. Stewart’s office.

The State Highway Patrol started proceedings to fire Lee in October 2013, shortly after administrators began investigating him. Instead of being fired, Lee resigned as a trooper on Nov. 4, 2013.

“Public trust is one of our first priorities, and individuals like Lee compromise that trust,” said Lt. Craig Cvetan, spokesman for the patrol. The patrol took the case to federal prosecutors because the incidents crossed jurisdictions.

The incidents, documents show, occurred between November 2010 and October 2013. Three of the women were victimized in the Licking County area while Lee was a trooper at the Granville post; the other incident occurred in Fairfield County while he worked out of the Lancaster post.

The charges were filed on Oct. 16 and unsealed yesterday. The women who were victimized by Lee couldn’t be reached.

The fact that Lee’s supervisor was looking at video from his cruiser camera wasn’t unusual. Patrol sergeants routinely review dash-cam video of troopers they supervise.

Investigators interviewed the two women who were in the car that was stopped in September 2013 in Lancaster, Cvetan said. Lee later admitted that he allowed the driver of that car to leave without being charged — though she showed signs of being drunk — but told the passenger to get into his cruiser so he could give her a ride home.

Lee pulled into an alley and parked, then took a picture of himself touching the woman’s bare breasts.

The patrol found “evidence of similar activity, where he photographed sexual acts,” at Lee’s phone, Cvetan said.

In a March 2012 incident, Lee stopped a woman for speeding. He then asked her to walk with him to his cruiser.

While she sat in the front seat, he asked her whether he could take a picture of her without her top on and she complied. Lee used his cellphone to take a picture of himself touching a bare breast.

Lee then talked the woman into driving to an abandoned gas station, where they had intercourse. Afterward, he tore up her speeding ticket.

Another incident that Lee admitted to was one that had previously been investigated. According to court documents, in the Nov. 19, 2010, incident, the woman was stopped by Lee after wrecking her car. Lee suspected her of being drunk and had handcuffed her behind her back. She said he instructed her to lean over the cruiser outside of camera view. He then fondled her breasts and rubbed his penis against her hands. Lee lied to patrol investigators when the complaint was originally filed and not pursued.

Then on Nov. 21, 2010, court papers state, Lee groped a woman in a similar manner. Lee found a bag of pills and drug paraphernalia in the woman’s car but did not charge her. He did take her to jail for an outstanding arrest warrant and cited her for speeding and driving with a suspended license.

Lee then contacted the woman on Facebook and demanded that she send naked pictures of herself.
 
Black Teen Football Hero Sues White Cop Who Put A Gun To His Head For A Seat Belt Violation

The family of high school football star Montre’ Merritt (photo above) is suing the Waycross, Georgia Police Department after an officer pointed a gun to their son’s head and handcuffed him on the ground for not wearing a seatbelt.

The incident occurred last January when Montre’ Merritt, a high school senior and gridiron star, was on his way home. Waycross police officer Cory Gay who Montre’ says had been following him for several blocks, turned on his flashing lights as Montre’ pulled into his driveway.

Officer Gay (left) is alleged to have approached the vehicle with his gun drawn, pointed it at Montre's head, and ordered him to lie on the ground, where he was handcuffed. Montre complied, offering no resistance, all the while insisting he had done nothing wrong, and asking what violation he was being stopped for. When Montre's mother came outside and asked why the officer was arresting her son, Officer Gay told her it was for a seatbelt violation.

When another police car arrived, Officer Gay took the cuffs off of Montre' and ticketed him for not wearing a seatbelt. According to the Daly Signal, "No explanation was given to Merritt or his mother about why such force was used."

The Merritts complained, and Officer Gay was suspended without pay for five days and required to attend use-of-force training. But Montre's family doesn't feel that was enough of a punishment. They have filed a lawsuit, claiming false arrest, infliction of emotional distress, assault, and depriving Montre' of his civil rights. The Merritts also claim the incident was racially motivated, and faults the city of Waycross and the Waycross Police Department for negligence, for not properly training Officer Gay.

Montre', now in college, says he is still haunted by the humiliating arrest in front of his mother:

“Coming from me being a huge role model in my community, to see my mom witness that. That was one of the most painful things I could ever imagine for her. The pain that I still feel. The tears that I still cry. Everything is just real in reality. I have to wake up with this on my heart and on my mind every day, and it hurts.”

The Merritt's have asked for $12.5 million dollars.

Austin, TX — In disgusting dashcam footage uploaded to YouTube on Thursday, two Austin Police Officers, Michael Castillo and Mark Lytle, are heard bragging about how important they are, then whistling at a woman and saying “Go ahead. Call the cops. They can’t unrape you.” while investigating a fender bender on May 24.

Officer 1: Alright, we’re gonna be riding out for a week.
Officer 2: Yo, we used to. They used to do that.
Officer 2: Hey, put it this way; if we ride out for a week, crime is gonna be on the run and (expletive) non-existent. (Expletive) would get real for the bad guys. The world would be at peace for a week.

Officer 1: Either that, or, you’d think that because we’d turn a blind eye towards everything.
Officer 2: Or that.
Officer 1: (Expletive) who cares.
Officer 2: Or that. It could be that.
Officer 1: I want to report a robbery! You probably deserved it.

Officer 1: Look at that girl over there.

An APD spokesperson stated they were unaware of the video until they were contacted by local station KXAN, providing them with this comment-

On Friday, the department confirmed the validity of the video, which was released by a lawyer who stumbled upon it as he was working on a case related to the car accident, and issued a statement which read-

The Austin Police Department has validated the video/audio publicly released pursuant to the Texas Open Records Act. The officers in the video/audio have been identified as Austin Police officers. Upon learning of the video’s contents, the Department immediately launched an internal investigation. The investigation will include a comprehensive audit of the involved officers’ contacts with victims of sexual assault to ensure the actions taken during the contacts meet the expectations of the Department, the public and most importantly, the victims. Upon conclusion of the investigation, the Department will take appropriate corrective action.


With the amount of rapes and sexual assaults occurring at the hands of law enforcement, jokes and statements like these must be taken very seriously, yet both officers remain on normal duty.

As horrific as this conversation is, some may like to believe this is just a couple of “bad seeds” or an isolated incident.

Unfortunately the jokes by these officers is almost unsurprising considering the attitude towards rape demonstrated by police nationwide.

Just last month, after responding to questions about the shocking string of rapes by officers, OK Highway Patrol Captain George Brown was on television telling women that if they don’t want to be raped by police, they should obey traffic laws.

Gretna, FL - The city of Gretna is still reeling after the death of Kaldrick Donald.

On Thursday emotions ran high during a march to Gretna City Hall.

Donald's family was joined a-long side friends, neighbors the Dream Defenders and even Leon County Commissioner Bill Proctor.

They asked to see immediate justice for Kaldrick.

"I think demands are being made by the people we want something to happen but we also know that a grand jury has to convene and the grand jury will ultimately decide what's gonna happen with Sgt. Brown," said Donald family attorney Craig Brown.

"It has a cause and effect we're here to show support we're in our town showing support and being out in the streets trying to show our fight for justice but we should be here as well showing support for people in Gretna who are trying to do the same for Kaldrick," said Dream Defender Michael Sampson.

Donald was shot and killed in his home by Gretna Police Officer Sergeant Charles Brown. Sgt. Brown was called to the home after Donald’s mother called 911 asking to have her son committed because of his mental illness.

Sgt. Brown was taken to the hospital after, but investigators have not released how he was hurt.

Sgt. Brown is currently on administrative paid leave while the Florida Department of Law Enforcement investigates the shooting.

With crime tape surrounding a church and more just blocks away blocking off a home, in a town as small as Gretna, Florida in Gadsden County, residents feel like it's a crime scene at every turn.

Gretna resident Francisco Chambers says, "I've never experienced this. Never. Not in Gretna. It ain't but 7,000 people here."

Monday night, a man and woman were found dead at a building at Glory Apostolic Faith Temple Church off Fourth Street. Police say it was a murder-suicide.

By 9:30 Tuesday morning, 24-year-old Kaldrick Donald was dead in his home on Cornelius Harris Lane. He was shot by SGT Charles Brown. Authorities say Brown was responding to a 911 call because of Donald's mental illness.

Residents say the two tragedies are bad enough, but the fact that they happened less than 24 hours apart, makes it more unbelievable.

Gretna resident Martha Clark says, "Stuff like this has never happened back to back like that. You hear about people dying, not about people getting shot or killed."

The police say because the department does not have the capacity to handle the murder-suicide, the case has been turned over to the Florida Department of Law Enforcement.

FDLE is also investigating Donald's death.

Chambers says, "Gretna has made more action in the last 24 hours than it has in the last 55 years. I've been here 55 years, so I can't figure this out."

The names in the murder-suicide have not been released. Neither have details of the events leading up to Sergeant Brown shooting Kaldrick Donald.

SGT Brown is on administrative paid leave until the conclusion of the investigation.

GRETNA, Fla. -- Gretna Police Chief Carlos De La Cruz has identified the officer involved in Wednesday's shooting.

De La Cruz says that the officer that was involved in the shooting was Sergeant Charles Brown.

Brown is currently on paid administrative leave. He will remain on leave until the Florida Department of Law Enforcement completes its investigation.

Other details about Sgt. Brown, including how long he has been with the department, are not available at this time.

The screams and cries from 24-year-old Kaldrick Donald's family could be heard as a hearse pulled away Tuesday afternoon with his body inside.

Wayna Ward, family friend said, "I felt like he shouldn't of got shot like that, not shot down like a dog in his own house."

Early Tuesday morning Donald was shot and killed at his home on Cornelius Harris Lane.

The Gadsden County Sheriff's office tells us they had received a call from Donald's mother saying her son needed to be taken to a mental hospital.

Once the officer got to Donald's house, he and the officer got into a fight.

Investigator Ulysses Jenkins of Gadsden County Sheriff's Office said, "The police officer arrived, a struggle ensued and from that point during the altercation and suspect is now deceased."

Gretna, FL - A Gretna police officer shot and killed a man inside his home this morning.

We are still waiting to find out the name of the officer involved.

Juanita Donald says she knew her son, Kaldrick Donald, needed his medication because he was cursing at her. That's why she called the police, expecting them to take him to the Apalachee Center like before. But, this time, the responding officer shot and killed Kaldrick, while his mother and pregnant sister were there.

She says, "I heard my baby say, I want my mama after he shot him, and then I didn't hear anything else."

Donald says she called police around 9:30 Tuesday morning because her 24-year-old son had not taken his medication for mental illness.

Police were called to their home on Cornelius Harris Lane, formerly Canty Lane.

Donald says, "It wasn't but one officer. Instead of him calling for backup, he took things in his own hands and he goes in the house and he rush him and shoot him."

Gretna Police Chief Carlos De La Cruz says, "Our thoughts and prayers are with the family. Since the investigation began, we have asked the Gadsden County Sheriff's Office as well as the Florida Department of Law Enforcement to assist us."

Detectives say they're looking into what led to Donald's death and why the officer had to shoot.

Juanita says all Donald did was walk off from the officer and said he "didn't want to be bothered." She says, "Just grabbed him and he tased him. Then when he grabbed him and tased him, he rushed my son off in the bathroom and I heard three shots. I was like, you shot my son and he was like, I had to. I said, no, you didn't have to."

Donald says her son did not have a weapon.

The officer was taken to the hospital and has been released, but, investigators have not released how he was hurt.

Gadsden County Sheriff Morris Young says authorities were called to the same home the night before. He says, "They had a domestic issue. The sheriff's office looked into that and of course, we were dispatched again here at 9:28 a.m. and the Gretna Police Department responded."

The officer's name has not been released.

GRETNA, Fla. -- The Gadsden County Sheriff’s Office says that a Gretna Police Officer shot and killed a man while responding to a Baker Act call earlier this morning.

The incident happened on Cornelius Harris lane.

24-year-old Kaldrick Donald's mother told WCTV that she called police to help her with her son because he hadn't taken his medicine. She also said that she expected them to take him to the Apalachee Center like they normally do.

She was in the house along with her pregnant daughter during the incident.

Gretna's police chief says the officer is in the hospital and in stable condition and authorities say he was not shot. A GCSO spokesperson wouldn't say what caused the officer to shoot.

Gretna Police, GCSO and FDLE are currently investigating.

WCTV is at the scene and will update this story as more information becomes available.
 
Man Calls Police to Escort His Girlfriend, Cops Show Up and Shoot Her in the Head | The Anti-Media

A 40-year-old woman and mother of three from Ann Arbor, Michigan was shot and killed Sunday night after allegedly confronting police while holding a knife.

The woman’s boyfriend, Victor Stephens, 54, challenged the police on their handling of the incident, saying that the use of lethal force was excessive and that the situation could have been resolved through non lethal means. Stephens said:

“Me and her, we had an argument. Glass was being broke, so I called the police to escort her out,”

Police were called at approximately 11:45 pm by Stephens to escort his girlfriend from his property. When officers arrived, Stephens was in a separate hallway in the house away from where the incident occurred and she was pronounced dead at the scene. There were 5 other people at the house.

“They said ‘freeze’ and the next thing I know I heard (gunshots),” Stephens said.

Significant questions are being raised regarding the circumstances surrounding the event, the use of lethal force in the encounter by Ann Arbor police and the investigation being launched by Michigan State police into the fatal shooting.

Ann Arbor Police issued this statement and Police Chief John Seto asked Michigan State Police to conduct an investigation into the incident, saying that those involved in the shooting and the community “deserve an objective, unbiased review of the facts surrounding this incident.”

Whether that goal can be achieved remains to be seen, as there are clear conflicts of interest with having the police investigate themselves as well as potential difficulties in ascertaining facts as a result.

This concern over objectivity is what prompted Wisconsin to become the first state to mandate outside reviews in police killings earlier this year as a result of activist movements in the state.

Retired Air Force officer Michael Bell, an advocate for this legislation had filed a wrongful death suit against police, who cleared themselves of any wrongdoing after killing his 21 year old son in an altercation. Bell hired his own investigators and submitted an 1,100 page report to the FBI and US attorneys, which brought important evidence and circumstances to light surrounding the incident and police response, and led to the case being settled after 6 years in court.

In researching, Bell also found that, “In 129 years since police and fire commissions were created in the state of Wisconsin, we could not find a single ruling by a police department, an inquest or a police commission that a shooting was unjustified.” Demonstrating how difficult it can be for police to be impartial in their own investigations and citing lack of accountability as the culprit. Bell kept organizing and fighting for what ultimately became Wisconsin’s law mandating outside reviews.

In addition to objectivity in the investigation, police use of lethal force continues to be a major concern, with high profile incidents such as the recent Michael Brown shooting elevating the issue into the national consciousness.

Whether the investigation finds the killing justifiable or not, the question will remain of whether the deceased mother of three could have been disarmed and taken into custody without facing lethal force, and to what extent police should be responsible for attempting non-lethal means of resolution.

While some circumstances certainly justify the use of lethal force, it is intended to be the last resort in ending an altercation and only to be used when in extreme danger. If the facts come to show that this was not the case, accountability must be demanded. If nothing else, because the price for society is far too steep: 3 children will now enter adulthood in society with their mother having been taken from them by violence. And regardless of whether this woman was a good mother or not, this is not the kind of practice that engenders building a better society.​

MSP Confirms Lansing Shooting Involved Police Officer

The Lansing post of the Michigan State Police has confirmed to WILX News 10 that a shooting that took place earlier this afternoon on Kalamazoo Street involved a Lansing Township police officer.

A spokesman for the Lansing School District says that Sexton High School was on a "shelter in place" alert for 40 minutes.

LANSING TOWNSHIP- Police are investigating a shooting incident in Lansing Township Monday afternoon.

The shooting took place at around 1:30 p.m. in the 2600 block of West Kalamazoo Street, just west of St. Joseph Park. Initial police-band radio reports stated that one person, possible two had been shot.

News 10 is trying to get information about this shooting confirmed through Lansing Township Police.

Update: Suspect dead after officer-involved shooting in OKC

OKLAHOMA CITY – The suspect connected to an officer-involved shooting in Oklahoma City has died.

It all happened around 8:30 p.m. Sunday near NE 28th and Laird in northeast Oklahoma City.

Oklahoma City police say officers were trying to pull the suspect over for a traffic violation, but the suspect wouldn’t pull over.

That’s when officers say the suspect went east on NE 28th and south on Kelley in northeast Oklahoma City.

The suspect’s car then turned east on NE 26th and crashed into the north fence of the Heritage Pointe Apartments, according to investigators.

Police say the driver then took off on foot and ran through the apartment complex.

According to police, the suspect, later identified as 39-year-old Jerry Nowlin, brandished a firearm and pointed it at officers.

That’s when officers say they shot Nowlin.

Nowlin was transported to an area hospital where he passed away just before 11:00 p.m. Sunday.

The two officers involved in the shooting were placed on routine administrative leave pending a complete investigation.

Police say a firearm was recovered in Nowlin’s possession in addition to several grams of marijuana and cocaine.

Early reports indicated that two people were shot, but police later reported only one person had been shot.

SAN JOSE POLICE OFFICER ON LEAVE FOR CONTROVERSIAL PROTEST TWEETS

A San Jose police officer is now on leave after controversial tweets about protests in the Bay Area. Officer Phillip White's tweets were aimed at people protesting deadly police brutality, and his messages have created a firestorm of condemnation.

The posts on White's account can no longer be accessed by the public. But they were already captured by others including the website BuzzFeed, which displayed other posts the officer had made previously about the ongoing demonstrations. Since his tweets were revealed, there's been a lot of criticism and repercussions. White was not only a police officer, he was also an assistant basketball coach at Menlo College. The school fired him on Monday, but that's the least of his troubles.

White's tweets read: "Threaten me or my family and I will use my God given and law appointed right and duty to kill you. #CopsLivesMatter."

And another reads: "By the way if anyone feels they can't breathe or their lives matter, I'll be at the movies tonight, off duty, carrying my gun."

The reaction was quick and predictable.

"I think he needs to lose his job," said Rev. Jethroe Moore.

Moore sits on the San Jose Police Department's Community Advisory Board.

He was with other leaders of San Jose's civil rights groups at their regular meeting. Everyone there had read the tweets.

"The fear is that he tweeted this to maybe some other friends," Moore said. "So are there other officers in this department that are part of the tweets?"

The Police Officers Association disavowed the postings.

"Disrespectful, offensive, and inappropriate comments on social media have no place in the public discourse involving the tragic loss of lives in officer-involved incidents around the country," said James Gonzales with the San Jose Police Officers Association. "We condemn these comments."

On Monday morning, someone filed a complaint with Judge Ladoris Cordell, San Jose's independent police auditor. That triggers a police internal affairs probe, which will look into whether White's tweets violated a chief's order, which warns officers from posting on social media anything that would reflect adversely against the department. White may have also violated the duty manual's policy on conduct unbecoming an officer.

"Basically the rule says officers are not to engage in that kind of conduct either on duty or off duty," Cordell said.

On Monday, the police department placed White on administrative leave. In a statement they said his tweets "do not reflect the thoughts or feelings of the men and women here at the San Jose Police Department. Nor do we condone this type of behavior."

Man fatally shot by police in Mayfair is identified

A Frankford man was shot and killed by a Philadelphia police officer early Monday, police said, during a traffic stop and struggle in which the man allegedly tried to get to a handgun in his vehicle.

Several witnesses were being interviewed at the department's homicide unit Monday morning after the 2:45 a.m. traffic stop in Mayfair that led to the alleged struggle.

The dead man has been identified has Brandon Tate-Brown, of the 5200 block of Horrocks Street.

Two uniformed 15th District officers stopped Tate-Brown, 26, on the 6700 block of Frankford Avenue because he was driving without headlights on, police said, citing preliminary information.

When the officers approached the car, a Dodge Charger with Florida plates, they saw a handgun on the center console of the car, police said.

The officers asked Tate-Brown to get out of the car, and when he did so, the struggle began, police said.

He was able to break free from the officers and forced his way to the passenger side of the vehicle and tried to retrieve the gun, police spokesman Lt. John Stanford said.

That's when one of the officers fired his own gun, hitting Tate-Brown once in the head, police said. He was pronounced dead at the scene at 3:05 a.m.

Police said the gun in the car, a .22-caliber semi-automatic pistol with eight live rounds, had been reported stolen in July 2013.

Court records show Tate-Brown has been arrested twice. In May 2007, at the age of 19, he was arrested on charges of receiving property and car theft. Those charges, according to records, were later dropped by prosecutors.

A month later, in June of 2007, he was arrested on charges of attempted murder, aggravated assault, and carrying a firearm without a license.

After pleading guilty to the lesser charge of aggravated assault, he was sentenced to five years in prison.

The officer who fired the gun has been placed on administrative duty, police said. Stanford said he has served on the force for about a year and a half.

Police said the officer's partner was taken to a hospital for observation. Internal Affairs and the Homicide Unit are investigating and will forward their findings to the District Attorney's Office.

The shooting is the fourth fatal police-involved shooting this year, of 26 total police-involved shootings. By this time last year, according to department records, officers had been involved in 42 shootings, 13 of them fatal.

Deceased positively identified 12/27/2014 from the Texas City Police Department’s Officer Involved shooting at HT’s Lounge on FM 1765, in Texas City.
Today Galveston County Sheriff’s Office Detectives and a Crime Scene Investigator were present at today’s Autopsy performed by the Medical Examiner’s office. The autopsy took several hours to complete.

The Decedant is positvely identified as being Carlton Wayne Smith Jr., 20 years of age of Texas City, Texas. The prelimanary results from todays autopsy shows that Mr. Smith received 5 gunshot wounds. It was not determined which shot was first, but Smith received one shot to the upper left shoulder which travelled in a downward direction, one shot to the left side, one shot to the upper left chest, two to the face, one striking the left cheek, and the other striking the chin.

The District Attorney’s office and Chief Burby have been briefed with these preliminary findings. Additionally, Detectives have also briefed the family of these findings.

The Sheriff’s Office and the District Attorney’s office are continuing their investigations.

Anyone that was present that night at HT’s when the fight and shooting occurred are encourage to contact the Sheriff’s office so we will have all the possible information available to perform a complete and thorough investigation into the facts of this case.
