Legally Speaking; What Did Eddie Long Do Wrong?

Heist

I'm not defending him or the allegations, I'm just trying to understand the Civil suit and potential FBI probe of his actions.
Maybe Jagu or Papi68 can chime in.

My question is why was it no problem when these consent and "of age" young men are getting gifts, taking trips, riding in limos, etc. they're happy to take the dick in the booty.

Then when the gifts stop, years later they starting crying about being sexually swindled and coerced into having having gay sex? :hmm:

They need to look deeper within themselves. Takes two to tango. I can understand a little 10-13 year old like the Catholic Priest were doing.

But when you're 17-20, you've pretty much developed a strong sense of your sexual identity and general values.

You can't tell me in anyway possible that ANOTHER MAN can convince you to let him pound you in the ass if you are 100% heterosexual. If you did, you did it because you were being tricked on and enjoyed the gifts and fringe benefits of being around him.
Or you got slicked talked into fucking. That's been happening for millenia - not illegal, you're just weak minded.

But my general point is, legally:

- It wasn't prostitution, because there was no exchange of gifts and money for sex.

- It wasn't sexual harassment, the window to file those charges long since expired.

- It wasn't coercion, because these guys were not on his payroll or his employees, so there was no threat of losing income or their jobs.

- It wasn't an inappropriate relationship (legally), because he's not governed under the same laws a school teacher would if say they screwed one of their students.

... So what is it exactly that they think they're going to get out of him or the suit? Civilly or Criminally, I don't see where this is a win for these guys outside of ruining his reputation even if the allegations are proven to be true.

i been to his church, and i can tell you dude is a crook.

but the fact that no criminal charges were made, and sexual coercian is some civil shit, im sure this is some revenge shit.

couldnt happen to a nicer guy, though. :hmm:

They're looking to do two things to this man
1 they are looking to ruin his reputation as a bishop and put him out of business for good for being hypocritical

as far as what was illegal, nothing was illegal on the relationship front as far as age of consent and everything

where the bishop fucked up was buying them gifts and things BECAUSE now that this suit is coming into play it gives the IRS a chance to probe him nh and take a closer look at how he has been using the "church" funds. the misuse of funds that are supposed to be used for church is what's going to be the end of him. All of that stuff being given to the boys as gifts...if they came out of the "building fund" or the "new pew fund" then he's fucked. if that house or those cars or plane rides etc came out of the "help out the community" or "build a youth center" funds that people gave willingly to support those projects but instead went to support his lifestyle and those projects and things took a loss because of his personal gain.. this is where he's going to end up in the slammer.

not for fucking but because of these dudes civil case and claiming of getting gifts they're gonna probe into where that money came from and how he was able to get those gifts...and eddie's house is just a deck of cards...the irs is about to come and pluck it and end his run .

did you read the complaint? it has some of the legal justifications - not that they will be accepted but they are there.

also, im sure more evidence is going to eventually surface - so the issue of whether there was an explicit exchange of sex for money happened is not clear. there's probably going to be all types of emails/texts etc etc.

either way, whether or not he committed a crime against the law - he did commit one against his God and congregation. this is all so funny though..

It's a civil suit. They are trying to get some of the "Holy loaf"......

Seriously, what did he pay with those "business" trips with? Church funds? If so, there's your answer. Some of you need to adjust to the fact that this shit could be true. Those of us that thinks he did it also realizes that it could be a lie.

No, you think long and hard on it. You're kidding right? That long ass jibber jabber response, and you failed to read the first sentence in my post?

"I'm not defending him or the allegations, I'm just trying to understand the Civil suit and potential FBI probe of his actions."

I want to understand the LEGAL aspects of the suit. I already understand that moral and social norms have been violated, but legally - according to law on the books - what has he done wrong?

you put alot of thought into this like you cant come to grips with the allegations
I dont mean that to flame you just sayin thats what it reads like

See my first sentence.

Well the funny thing about using Church funds for personal vacations is that so long as he can prove he did ONE THING or ONE DAY of mission or ministry related work, he can legally and justifiably claim it was Church business.

That's the hustle. That's why these ministers will take a week long "mission" down to Bermunda. Do one day of sermon at a local church bringing the word, or visit a kids hospital - and now they can claim the visit was for ministry business and the rest of the time they're partying and taking a personal holiday.

He was railing on gays, bashing them like Ted Haggard; that is what's wrong.

Well, if it turns out to be true and the defendants can prove they had sex with him, the state of GA may charge him with sex with a minor depending on the age. If he is not guilty, those boys will be charged with a number of charges one being slandering.

Legally, not morally.

L-E-G-A-L-L-Y guys. We all have a moral code that says it's wrong. Social norms raise an eyebrow to it as well, but legally, where are these guys coming from?

"He told me to let him fuck me in the ass, so I let him because he said God said it was ok?"

That's grounds for a suit? No, that just makes you stupid.

If Eddie Long said they could all fly because God told him they could and that they should go jump off the highest building they could find - and they did and they died - what then?

They were all of the age of consent (i.e. >17)

They can't sue him for that, he was just playing on their emotions. But damn, Eddie a funny dude though. :roflmao::roflmao::roflmao::roflmao:

Not sure of all the details of this fuckery, but the causes of action the plaintiffs are alleging are breach of fiduciary duty, negligence, fraud, and intentional and negligent infliction of emotional distress.

The general premise of their arguments is that as an influential and powerful Pastor and spiritual advisor, Mr. Long had a controlling influence over the plaintiffs' conduct. He had a fiduciary responsibility to act in the best interests of those he had an immediate and direct influence over. By engaging in sexual acts with the plaintiffs, Mr. Long breached that duty and as a direct and immediate consequence of that breach, plaintiffs suffered severe emotional distress.

With regards to 'duty of care', a fiduciary duty is the highest level of trust and responsibility. One who owes a principal a fiduciary duty has to ensure that the principal's interests are best served.

This situation can also be described as "Pastor Malpractice" since legal malpractice cases are probably what lay people can analogize with what Eddie Long did wrong legally.

This is more about showing his hypocrisy then anything else. People don't care if it was legal or not, they just want to know IF HE DID IT.

Did anyone see that Ted Faggard Doc on HBO? That CAC went from being a big time preacher to selling shit Door to Door. It was sad and funny at the same time.

if any of the acts happened in GA they could get his ass SODOMY is still illegal there that means getting you dick sucked /sucking dick or fucking ass

Georgia's Sodomy Law
Georgia code section 16-6-2 provides a 1 to 20 year mandatory sentence for any adults consenting to "any sexual act involving the sex organs of one person and the mouth or anus of another". Married couples are not excluded from this law. The Supreme Court upheld a constitutional challenge to the sodomy law Bowers v. Hardwich (1986), saying that the Constitution did not grant the right to engage in sodomy. Presumably few consensual behaviors by or between adults are specifically enumerated by the constitution and therefore could be subject to laws prohibiting them and imposing penalties for them at any time.

For the purposes of comparing the severity of Georgia's opposition to these sorts of consensual acts between adults, Georgia provides less extreme penalties for sexual acts such as bestiality (16-6-6) and necrophilia (16-6-7) which provide one to five year and one to ten year sentences respectively.

Georgia law section 16-6-15 prohibits the solicitation of sodomy and imposes up to a 12 month sentence and $1,000.00 fine if someone is determined to be guilty of soliciting an adult. For the purposes of obtaining a conviction, the Georgia court has determined that the term "blow job" is not too vague a term to support the conviction of soliciting for sodomy. [Anderson v. State, 142 Ga. App. 282, 235 S.E.2d 675 (1977)]

Masturbation for hire is also made illegal and is subject to a sentence of up to 12 months and up to a $1,000 fine.

Georgia also outlaws consensual sexual intercourse between unmarried persons with section 16-6-18, Fornication. The penalty provided under this section is a sentence of up to 12 months and up to a $1,000 fine.

Heist you say they are old enought not to be tricked into gay sex, but he tricks his whole church into giving him 10% of their wages. So if he can do that he can manipulate some teen boys to do gay shit.

:hmm:

It's actually a good question.

A 17 yr old is still a boy, not a man. Depending on the state, that may be the age of consent but he's still legally not an adult.

 If he was writing these trips and hotels and limos off as "church expenditures", he's in it deep.

I did and it was. The church he founded kicked him out of the church and his own house (which was in the church's name).

It's illegal for unmarried people to have sex in Georgia?!
I'm somewhere between :smh: and .

Now I'm wondering what's on the books here in NC.

Bentley, Private Jets, I need to get into preaching. No wonder I seen some rappers become preachers...

I worked at some non-profit - feed the hungry in Africa, preacher was driving an expensive porsche, six figures at least.

I can give some of the women, one on one spiritual guidance after the sermon.

Good analysis. Before filing the case, the lawyers must have
gotten with experts and examined medical reports to
be convinced the two suffered major "damages" or "injuries"
to make it a potential big $$$ case. They could care less about criminal prosecution, except that it would help strengthen the validity of their civil case.

I don't know much about ol boy but when I hear shit like he is riding around in a $300,000 Bentley and is accused of having relations with young men and black people still defending the nigga, I just....:smh::smh::smh::smh::smh::smh::smh:

Unless they have text messages or some type of pictures or emails of the Bishop then they will catch major heat from the Bishop legal team,

I'm not defending him or the allegations, I'm just trying to understand the Civil suit and potential FBI probe of his actions.

This is a link to Anthony Flagg's complaint: http://www.examiner.com/us-headline...int-filed-by-anthony-flagg-video-player-video

There are 11 counts in total.

These are against Long (mostly for damages resulting from his failure to satisfy his duty to the young men in his care to not coerce them into fucking him):

  • *Breach of Fiduciary Duty
    *Negligence Per Se
    *Negligence
    *Fraud
    *Intentional Infliction of Emotional Distress

These are against New Birth and Longfellow Academy (by and through the employees for allowing Eddie Long to continue along coercing the boys in their care into fucking him).

  • *Negligent Failure to Warn
    *Negligent Failure to Protect
    *Negligent Retention
    *Negligent Failure to Supervise
    *Negligent Infliction of Emotional Distress

- It wasn't coercion, because these guys were not on his payroll or his employees, so there was no threat of losing income or their jobs.

The complaint alleges that they were put on the payroll.

It wasn't an inappropriate relationship (legally), because he's not governed under the same laws a school teacher would if say they screwed one of their students.

Its much closer to a psychologist who fucks his patients (teenage or otherwise). Its a gross dereliction of his duty as a pastor. It may not be criminal, but this is what civil suits are for.

The only thing that I can think of is by the church being set up as a non-profit, spending the money in the manner that was spent is illegal for tax purposes. The Feds are probably looking into tax fraud, mail fraud, etc.
