For everyone wondering it has to be assumed that the person was of reasonable age. So if you meet a girl at the club and it was a 21 year or older club and you sleep with an underage woman then you would not be charged. Also a woman can't use a fake ID to lie about her age

She couldn't have lied about it because there was nothing to lie about. From day one the charge has been 3rd degree rape, which is simply sex with a person unable to give consent (either underage or otherwise mentally incapable), that should not be confused with 1st degree rape, which is violent sex forced upon an unwilling victim and which causes serious injury.

I think any person in their right mind would not mistake a 13 year old for someone 18. I find that hard to believe. Even though most states have rigid rape laws the jury is informed that they don't have to convict if they feel that the person acted within reason.

Naw bru it don't work like that. If you were in a club that was for 21 years or older and you met a woman and slept with her you would not be charged. If the DA feels that you just did not know and it was reasonable for you not to know then you would never see a trial. If a female gave you a fake ID then once again charges would not be brought against you. It would all be handle in house and never taken to trial. No DA will prosecute that case cause the jury would not convict anyway.

A conviction does not always mean a jury trial. A plea agreement is also counts as a conviction and convictions = more fed money.

Now it will help your cause if the club thoroughly checks ID and she was able to fool that person but it is still highly likely that the DA will prosecute and place the burden of proof on you.
Remember, the DA doesn't really have to factor in "reasonable expectation" because ignorance is not a sufficient defense. The burden of proof then falls to the defense counsel to prove their client was intentionally misled.
