I only practice in rural counties with historically black populations. This is an A+++.This situation, although sad, isn't a law created to target black people. This happens to white and Hispanics as well. Are black families disproportionately affected by it? About 40% of all black property in the south is heir property. So Yes. But, we have to be honest about what is happening and why it is happening. Our lack of knowledge and opportunist who take advantage of our ignorance.
For those who didn't see the video, and you should because it is a cautionary tale, it details a little known law regarding heirs property. Basically, your great grand parents buy land. They die without a will. The land passes to the living heirs. This happens for a few generations until there are "owners" you do not know. This creates a "cloudy title." This is the first issue.
Some family members, because they have no personal tie to the land sell their interest to a developer. That developer seeks out more family members and continues to buy them out until he has a significant percentage. Keep in mind those family members willingly sold to this person which is the 2nd issue. Smh.
The developer then files a petition with the court to order the sell of the heir property on the grounds that a mutual concensus can not be found regarding what to do with the land. Most of the family are not knowledgeable about how to fight the petiton nor do they have the capital to outbid the developer. This is the 3rd issue. The developer buys the property, the heirs get paid their fraction from the sale, which could be very small if it's a lot of people. The people who were living on the land are most affected and usually have to vacate due to the new ownership.
This goes back to something I've repeatedly said on this forum about black folk, we have to increase our financial literacy. Being unaware can't always be the excuse.
The situations in the video were mostly avoidable. Now, is it cold blooded? Yes. But, this maneuver can never be initiated without the compliance of those family members who willing divested their interest in the land.
For those of you who have land like this in your families. And most of you do. Don't be afraid to ask about it and ensure that legally you are protected. With heir property, the original owners name is still on the deed. Why?? No will no legally enforceable property management strategy. In our family we transfer the land to the patriarch each generation. They can not sell without a 75% vote. However, any family member can request to develop a portion of the land to build homes.

The first remedy is make sure you have a will.
People should have a will and give any large asset that you want to stay in the family (like a house) to one person, not “split” between the whole family. When you split it, of course the family will sell it and split the money.Thanks for posting this OP.
This is one of the saddest videos I've ever seen. My family is facing this very same thing currently. The problem is you'll get half of the family wanting to keep the property, and the other half wanting to sell. You can't get them to agree on shit.
Then when the property is gone, they look back and reminisce and say, "We should have kept Big Momma's property." Fuck you asshole!
My Grandmother wasn't even the grave and we had relatives talking about, "We should sell it and get the money." I was like, "What fucking money? Do you understand that she had 13 children, at least 50 grandchildren, and no telling how many great-grandchildren. By the time that shit is split up, you're walking away with maybe hundreds of dollars, not thousands or millions."
That's what happen with Bruce's Beach here in Los Angeles. I bet that family had some crazy internal battles. At least they decided to let the city lease it until they can really get a grasp as to whats really going on.
