Naw, you can defend yourself however you see fit. Most times punching someone for doesn’t equate in a death. Still, there are those moments when it does.

Words never justify an assault, unless they are what the court defines as "fighting words"....you better check your state laws about what fighting words are before you go knocking folk out in response to verbal provocation alone.

The prosecution knows they have that video.
Which is probably why they're not interested in a deal.


Pujols told police that the man was a regular customer, was “extremely rude” that day and called Pujols a racial slur, according to the arrest report. Pujols, who is Black, said he asked the man to repeat what he said, and he uttered the same slur. Pujols said he punched the man once in the face, causing him to fall, the report said.

The store’s surveillance system captured video of the punch.

The video shows the customer didn’t touch Pujols,
and that the man appeared to hit the back of his head on the concrete floor after Pujols punched him,

according to the report.

Cook, 62, has been on house arrest for several weeks. When the alarm on his monitoring bracelet went off early Thursday, investigators wondered if something was up. When Cook didn't answer his phone or show for an 8:30 a.m. hearing, their fears were confirmed.

A Dunkin’ employee in Tampa, Florida, accused of fatally punching a customer who used a racial slur against him last year, was sentenced to two years of house arrest after pleading guilty to felony battery.
Corey Pujols, 27, was ordered by a Tampa judge on Monday to complete 200 hours of community service and attend an anger management course.
Tampa police said the incident occurred around 1:30 p.m. May 4 at the Dunkin’ location at 410 S. 50th Street.
According to court records, the customer, Vonelle Cook, 77, who was white, had gone through the drive-thru to order coffee and was angry over the lack of service. While in the drive-thru, Dunkin’ employees had trouble hearing him, and he started to yell at them about poor service.
Employees told Cook, a regular at the establishment, to leave, but he parked his car, walked inside, and was aggressive and verbally abusive toward employees, prosecutors said.
Pujols asked a co-worker to call the police, leading to an argument between him and Cook, FOX 13 Tampa Bay reported.
When Pujols, who is black, asked Cook to leave, police said Cook called him a racial slur.

Cook fell and hit his head on the floor. He was taken to the hospital, where he died three days later.
An autopsy showed that he suffered a skull fracture and brain contusions.
Pujols had initially been charged with aggravated manslaughter following the incident. Prosecutors accepted a plea deal from Pujols, who agreed to plead guilty to the lesser charge of felony battery, according to FOX 13.

Grayson Kamm, a spokesman for Hillsborough State Attorney Andrew Warren, said prosecutors, in their decision, considered the “totality of the circumstances,” which included Pujols’ lack of criminal history, his youth, and the fact that he did not intend to cause Cook’s death, the Tampa Bay Times reported.
“Two of the primary factors were the aggressive approach the victim took toward the defendant and everyone working with the defendant, and that the victim repeatedly used possibly the most aggressive and offensive term in the English language,” Kamm said.





Cook was a registered sex offender, court records show.

That is a good point, he could make some helluva lemonade out of this situation if he wants too, get his skillset up and come out better in the end.

Damn, 2 years of house arrest is a long fucking time though. I did a few months of the shit and gave up. The shit is aggravating, if you have a decent sized house, the monitor may think you left the home when you are really in your living room or upstairs. Then they call you, ask you where you've been and hang up in your face. Then you gotta explain every time you got out of range. If you have a job, you can go to it, but you literally can't get near your house until the set time you are supposed to be home, or they are calling. Not to mention, you have to pay like $100/mo for the equipment. Can't take your trash out, can't get your mail, can't walk your dog, can't cut your grass, can barely go get food. If you have no family/friends to help (for 2 years!) and you are trying to manage it solo, its a bitch. After 2-3 months of that shit I cut the bracelet off, packed up all that shit and gave it back to them and told them lock me up. My jail time was a fraction of the time/cost/aggravation of house arrest.

Of course I wasn't facing dead cac time either though..... :dunno:
