Filing for Bankruptcy Chapter 7

All of the free legal aid orgs that handle bankruptcy in my city have turned me down. There is this persistent myth that you can't discharge student loans to the point that a lot of lawyers believe it. There have been hella Brunner cases that won over the past few years. The worst part is that some of these orgs exist to give law students and early career lawyers experience. Class after class is missing out on these teaching opportunities and I'm missing out on legal help. I think many of them just want a slam dunk case that can be done quickly and almost guarantee a win. One place asked about my credit card debt which is ~6k and not maxed out. She said I'd have to stop using the card for 6 months before they'll help me file. 6 months?

Let's just say I have highly sought technological skills that are of great interest to two industries that are highly automated. One is public sector, the other is private. I can't work for either right now.

Wait, so your an engineer ain’t can’t get work in Houston?

Go for it! If you can prove undue hardship it’s a chance. You will have to fork up some bucks though

Wait so you are saying you can get out of paying for student loans if you consolidate them with a private funder?
If this is true, it is incredibly interesting.

But they do have statutes of limitations that vary by state. In mine it's 3 years and I'm almost two years into defaulting one of the loans.

I owe Ferrari numbers and as I said earlier it has cost me my job. Outside of a couple industries I can't earn enough to pay back the loans. I can't even make interest only payments right now. I had a hard time finding jobs after I graduated. I couldn't find anything that was stable and paid enough for me to pay my loans back every month. That compound interest built up during that period and I've been fighting it ever since and I owe more money than I did 5 yrs ago despite paying several hundred dollars a month. Now I have no income. It's best to file soon so that I can get ahead of people who went broke during the quarantine.
My ninja .. What's the hold up. Go file that shit now!!!!!!
It freezes everything and stops all debt collection efforts. It will give you time to catch your breath if nothing else.

I'm not an engineer.

Oh okay, My bad. I have technical degree, and had the worst credit early on in my job search as well as other shit and was able to get a job. Have you tried temp agency’s? If your degree is technical you can at least get a temp gig for maybe 6-12 months and get a good paying one maybe 30hr. Temp back group checks aren’t as in depth.

If you want to wait out the SOL, yes, but discharging is much better in my experience. If you have a cosigner the lender can go after them before the time is up. Mine is about to retire and shouldn't have to deal with all of that.

The temp agencies are giving me leads for jobs in the middle of nowhere that pay $30-$40k a year. I'd have to spend $2.5k just to move there, then make deposits on unitilies as well. $2.5k of a post tax $30k income is a lot of money. I'm sure that housing will be cheaper but not so sure about other things being cheaper. From my experience other things go up in price because they don't have economies of scale in these small town either. All of these places were super white as well.

@regulus What was your major and how much student loans do you owe? Be specific.
What is your total debt? How much were you making when you were making money.
The answers to these questions will help give you better advice.

In other words, do you just need to man up and find a good job or is your situation truly unbearable.

Do you have ANY money saved? IRAs, CDs, 401k?

I really hope you do. If you are like 22. I would say man up and pay down those bills.

If you 55 with mad kids and still can't make it happen then cash out the 401k and pay for a good lawyer.

Rethink it.Got a buddy that did it and actually shit was worse. If you have 30-50k in debt I wouldn’t do it.
We have to learn the game fam, it's nothing wrong with bankruptcy when (they) do it multiple times in their lifetime. It was one guy at my hearing about 60 or so and the judge remembered him. He was like you were just here a few years ago and he replied yes the time has passed allowed by law for me to file again, they wiped his debt... Again
We have to be strict afterwards and our credit score will be fine. People have to do the research, I had a 700 plus after about 8mos with chap 7. It wasnt a bad process

He majored in Economics and Finance, but he has a “Ferrari” in student loan debt, so that’s at least $200k. A lot of financial institutions won’t hire people who are deep in debt and/or have credit issues.

But I figure that having a bankruptcy on your record could potentially make that perception from employers worse.

I have been thinking about doing this for awhile has anyone done this and was it with or without an attorney
I did it a few years ago. I used an attorney and it was way easier than I thought it would be. I had to take some credit courses as part of the deal, but they were all online. You will take a hit on your credit report, but it shouldn't be anything to keep you down for long and you can start freash and bounce back pretty quickly.

WHy should he cash out the 401k?

Chapter 7 stays on your credit for ten years not 7. Chapter 11 stays on for 7 but your still pay off your debts, but they are reorganized into payments you can better handle. Here's the part they don't tell you. Once you declare bankruptcy your auto and homeowners insurance go through the roof! There are companies who will never deal with you. I'm told that American Express will never issue you a card if there is a bankruptcy in your history regardless how old. My question is how do they know, since after 7 to 10 years it is supposed to be wiped. I don't know. You also will no longer qualify for some of the better career type jobs. Many will pull your FICO and history as part of the hiring process. The is an underlying sentiment in the US that people who don't pay their bills lack character and morals when the issue is far more reaching and complex than that. If at all possible, try hard to stay afloat and deal with your bills, but if you can't probably Chapter 7 beats 11 since you wash the debts away at the price of 3 extra years of credit issues.

I don't know about that.. My uncle filed for bankruptcy...

And he filed all the paper work himself for under a g... But this was back in late nineties..

After seven years they sent him offers for credit cards ..

Now he chling....debt free decent credit score. ..

That is very true.
Seems like he gonna have to hustle hard and find the right network and connections.
Right now it one of the worst times to be going through something like this.

I will say this "DO NOT GIVE UP".

There is definitely a way out.

Money really aint shit. You can get it.

Health, love and happiness are the major things in life that if you dont have, you are truly fucked.

As an individual? Ok.
yes, its not only for businesses

You can get credit cards right after your bankruptcy.... They'll start you out with a secured or low limit Mastercard or Visa, true. But American Express will not touch you! American Express is a valued card because it offers so many perks built in. It really doesn't even work like other cards, as you can't carry a balance from month to month. You instead pay your entire balance every month to keep the card in good standing.

My mother filed in the early 2000s

Best move she ever made

After 5 yrs they start sending u applications for credit cards again and after 7 yrs all that shit comes off your credit

My mother has a 800 score now and relaxing

I just talked to a lawyer who said that you can't discharge federal loans which is false. She also said my private loan is not dischargable because I graduated and the loans were used for school. Imagine that, a college loan! She said a coworker just told her that. That coworker doesn't know what the fuck she's talking about.

It's difficult to have student loans discharged.

Does anyone know what software is needed to write legal documents? I don't know how to type all of those symbols on Google docs. It looks like I might have to file pro se. No lawyer with take my case except for one that looks hella shady. Filling out the basic bankruptcy forms is no problem. It's the adversary complaint that I need help with. I think I can write it up, but I need help if the debtors respond to it.

Why not use Word?

most bankruptcy lawyers u pay per month
avg 300 up front to file
total cost 1,000 - 2,000 in total
people do it all the time have 700/800 score in 6 months, as they show you how to play credit game
Got a few friends that did it. This is pretty much what they told me.

Get a lawyer, dont do it on your own. Make more money and stop complaining. Bankruptcy is not a bad thing in general. It can really help if you use it right. Chapter 11 is for corporations. Chapter 7 and 13 are for individuals. I charge $2500 for chapter 7s and $4000 for chapter 13s so if you have someone that will do it for $1200 then you should move forward with them (granted, I don't know what state you are in)

Let them eat cake, huh?

You're joking, right? Your problem isnt money, its mindset. You're on the internet living in the United States. There are so many ways to make money its dizzying. Blindfold yourself, spin around, throw a dart against the wall and pick one! You want to see real poverty and lack of opportunity, I can take you to a favela in Brazil or a township in South Africa. Please miss me bro. Someone could give you $1,000,000 and years you'd still end up on the internet asking about bankruptcy.

I did it many years ago. My lawyer was great and made it relatively painless. It stayed on my credit for ten years.

LOL, I tell people that living in the US is the easiest thing to do but dudes make it seem like it's rocket science. There is no reason to be broke if you're healthy and have no records.
