The same rule applies to any property. Fence or not there are properly lines. Yes it has public access but what he was doing is suspicious activity. Notice he claimed to be a journalist. That gave him some leeway. If he didn't have his white skin they would've pressed him to prove it.

There is no fed and local property. It's OUR property.
Unless posted as a restricted area (like signs, walls/fences) they can't legally tell you not to film.
That's the whole point of doing audits. To see who will violate your rights.
