Felony charges against Jussie Smollett have been dropped, but the city of Chicago still has business with him. The actor is reportedly on the hook for $130,000 to repay the cost of his investigation, a figure that, by law, could be raised to more than $390,000. Smollett was accused of staging a hate crime after it was alleged that he coordinated his own assault the night two men jumped him in the street. If true, that would have also meant he filed a false police report about it. Smollett was cleared by the Cook County State Attorney last week, but Chicago mayor Rahm Emmanuel still wants the actor to cover the price of the investigation.

“Mr. Smollett has refused to reimburse the City of Chicago for the cost of police overtime spent investigating his false police report on January 29, 2019,” said a spokesperson for the city, according to Deadline. “The Law Department is now drafting a civil complaint that will be filed in the Circuit Court of Cook County. Once it is filed, the Law Department will send a courtesy copy of the complaint to Mr. Smollett’s L.A. based legal team.” At the time, Emmanuel called the decision not to prosecute Smollett “a whitewash of justice.”

The actor, who plays Jamal Lyon on Empire, was cut from the last two episodes of the most recent season. It’s unknown whether or not he will return, though co-star Taraji P. Henson, who plays his mother on the show, said today on The View that he will be back. Fox has not given an official comment.

You know some folks ain't trying to talk about that gun violence in Chicago because whites always bring it up. I remember after one of those bloody weekends a few years back someone posted about it and was accused of having an agenda.

Jussie Smollett is being sued for more than $130,000 by the City of Chicago. This comes after Smollett refused to reimburse the city for the investigation of the hate crime Chicago police say he staged. In a statement, the city said it is seeking “ the full measure of damages allowed under the false statements ordinance.” The city is asking for $130,000 in police overtime pay and $1000 in civil penalty fines for lying and legal costs.

“On January 29, 2019, Defendant submitted a false police report claiming that he was the victim of a racist and homophobic beating by unknown attackers,” the lawsuit reads. “In reality, [Smollett] knew his attackers and orchestrated the purported attack himself. Later, when police confronted him with evidence about his attackers, he still refused to disclose his involvement in planning the attack.” Charges against the Empire actor were dropped March 26 by the Cook County State’s Attorney’s Office. Smollett forfeited his $10,000 bond just before the charges were dropped.

Jussie Smollett purposely tried to mislead authorities by falsely describing the men he claimed attacked him as white, according to a civil lawsuit filed by the city of Chicago.

The city filed the suit against the “Empire” actor over his refusal to reimburse it for overtime payments to police officers who investigated his alleged hate crime hoax.

The complaint, filed in Cook County Circuit Court on Thursday, comes after the city gave Smollett a week earlier this month to pay $130,000 for the police overtime.

Smollett, 36, who is black and gay, allegedly hired brothers Abel and Ola Osundairo, who also are black, to stage an assault on him and make it look like a hate crime, according to authorities.

The actor told cops that the primary attacker “was wearing a ski mask that covered his entire face, with the exception of the area around his eyes, by which (Smollett) could tell the attacker was white-skinned,” according to the lawsuit.

“(Smollett) made this statement despite knowing that the Osundairo Brothers are not white-skinned,” the suit says. “By providing this false description, (Smollett) purposely misled the CPD officers to believe that his attackers were white, when, in fact, (Smollett) knew that his attackers were the Osundairo brothers.”

In adds: “At no point did Defendant inform police that he knew his attackers or recognized their appearances or voices.”

In January, Smollett claimed he was jumped by two men who yelled racist and homophobic slurs, as well as “This is MAGA country!,” at him during the attack.

He claimed his assailants doused him with bleach, threw a noose around his neck and beat him.

During their probe, Chicago police determined Smollett set up the attack and paid the brothers — who both acted in small roles on “Empire” — $3,500 to carry out the supposed beating.

Chicago police calculated that the department used 1,836 hours of overtime in the search for Smollett’s attackers, costing taxpayers $130,106.15.

Under a city ordinance, Chicago is entitled to recoup three times its total damages — or about $390,000. The city also will seek unspecified attorneys’ fees and costs, as well as a $1,000 fine for each false statement to police.

On March 26, the office of Cook County State’s Attorney Kim Foxx made the surprise announcement that it was dropping charges against Smollett, who had been indicted on 16 counts of disorderly conduct.

He agreed to forfeit $10,000 that he put up in bond money to secure his release after his arrest.

Kim Foxx, Chicago's top prosecutor, has asked the Cook County inspector general to investigate her office's handling of Jussie Smollett's criminal case, a spokesperson from Foxx's office confirmed Friday.

The Cook County State's Attorney's office dropped 16 felony charges against the "Empire" actor, who was accused of staging a hate crime against himself in Chicago. Smollett agreed to forfeit $10,000 in bail and do community service. Inspector General Patrick Blanchard will be conducting the investigation.

Blanchard told CNN Friday that Foxx requested his office review their handling of the Smollett case this week and he has no idea how long that investigation will take.
"We are proceeding immediately with this matter, but it is difficult to forecast the length at this juncture," Blanchard said, adding he's never been asked by Foxx to review the findings of a state's attorney's case. He said the report will either be made public directly after the review or addressed in a quarterly report that will be made public.
Calls for Foxx's resignation are personal, she says
The Chicago Fraternal Order of Police (FOP) and a suburban police chiefs association called for Foxx's resignation after holding votes of no confidence April 4. The vote took place more than a week after Foxx's office dropped all charges against Smollett. FOP President Kevin Graham said dropping the charges undermined the public's faith in the criminal justice system.

Days later at an event with Rev. Jesse Jackson, Foxx said calls for her resignation run deeper than the Jussie Smollett case.
"I think we have to ask ourselves what is this really about? I've been asking myself for the last two weeks, 'What is this really about?'" Foxx said. "I will tell you this is personal, it's personal."
Foxx has previously said she welcomes an "outside, nonpolitical review" into how her office handled the Smollett case. She had separated herself from decision-making in the case in mid-February out of "an abundance of caution."

State’s Attorney Kim Foxx has asked Cook County’s inspector general to investigate her office’s handling of “Empire” actor Jussie Smollett’s criminal case, she confirmed Friday.

Inspector General Patrick Blanchard revealed the request in a letter Thursday to Cook County Board President Toni Preckwinkle, county commissioners, Preckwinkle’s top staff and Foxx.


“This letter is written to inform you that this office has received a request by State’s Attorney Kim Foxx to conduct an Office of the Independent Inspector General review of the circumstances surrounding the resolution of criminal charges formerly pending against Jussie Smollett,” Blanchard wrote in the letter, obtained by the Tribune. “As you may recall, the office of the Cook County State’s Attorney has previously objected to the exercise of jurisdiction by this office over the SAO in relation to other unrelated issues. State’s Attorney Foxx has stated that her office will cooperate during the course of this review notwithstanding prior objections to OIIG jurisdiction.

“Accordingly,” Blanchard added, “this office will proceed with this review” under the county’s inspector general law.

Preckwinkle’s office declined to comment.

In a statement, Foxx lauded Blanchard.

“A former prosecutor, Inspector General Blanchard has been conducting independent inquiries for Cook County for over a decade,” Foxx said. “Ensuring that I and my office have the community’s trust and confidence is paramount to me, which is why I invited an independent review of this matter. I welcome this investigation and pledge my full cooperation and the cooperation of my office as IG Blanchard conducts his review.”


In a statement, Blanchard said his office “is pursuing an inquiry into the circumstances surrounding the resolution of criminal charges in the Smollet case. This will be accomplished in accordance with the protocols established by this office.”

Blanchard is no stranger to high-profile investigations. Last October he concluded that billionaire gubernatorial candidate J.B. Pritzker improperly received $330,000 in property tax breaks on one of his Gold Coast mansions as part of a “scheme to defraud” taxpayers. Pritzker repaid the money, won the governor’s race and denied wrongdoing.

Blanchard also concluded that an SUV driven “nearly exclusively” by Preckwinkle’s security chief was illegally used to transport political materials, including campaign literature for Foxx, and successfully battled former Cook County Assessor Joseph Berriosover whether Blanchard had authority to investigate his office.

Smollett, who is African-American and openly gay, found himself at the center of an international media firestorm after he reported being the victim of a Jan. 29 attack by two people who shouted the slurs, hit him and wrapped a noose around his neck. Police initially treated the incident as a hate crime, but their focus turned to Smollett after two brothers who were alleged to have been his attackers told detectives that Smollett had paid them $3,500 to stage the attack, with a promise of an additional $500 later.

In a stunning about-face, however, Foxx’s office dropped the 16-count indictment it had secured against Smollett at an unannounced court hearing March 26.

The move to drop charges has provoked fierce criticism.

Outgoing Mayor Rahm Emanuel’s administration has sued to try to force Smollett to reimburse Chicago for its expenses investigating the alleged hoax even though all charges against the “Empire” actor were dropped.

They came up with unions and cornered the market saying you had to be in a union to get this job. Guess who was excluded from joining the union? Us yet we were all skilled laborers. I think unions have their place but I’m well aware about their roots.

The Empire lost an heir — but maybe not the one we expected.

In the season 5 premiere, Empire unveiled a flash-forward structure that featured Lucious standing over a mysterious coffin. When EW interviewed showrunner Brett Mahoney, he called the future death “impactful.” Well, after a season of teases, the season 5 finale just revealed that the newest Lyon, Kingsley (A.Z. Kelsey), was the unlucky victim. Just introduced this season, Lucious’ illegitimate son tried to find his way into the family, but his mother and abandonment issues pushed him too far, eventually killing himself and leaving his heart to go to an ailing Andre (Trai Byers).

The reveal that Kingsley was in the coffin comes as the futures of the other Lyon sons looked more dire, considering Andre was previously seen flatlining in a flash-forward and Jamal actor Jussie Smollett has been embroiled in controversy, and upon renewing the series, Fox said there are “no plans” for him to return.

To discuss the season finale, EW chatted with Mahoney about Kingsley’s death, splitting up Lucious (Terrence Howard) and Cookie (Taraji P. Henson), and Jussie Smollett’s future on the show.

ENTERTAINMENT WEEKLY: In the end, why Kingsley?
BRETT MAHONEY: This season, with the whole idea of the coffin, we wanted some aspect of mortality to touch the Lyons. They live such a high stakes life that it just seemed like life and death should touch upon them. So we knew that we wanted it to be a Lyon, but then as we proceeded, so many of the Lyon characters had such rich stories that we had to look at who would we could lose that would affect our storytelling going forward the least, and it seemed like that would be Kingsley. It was still sad to lose Kingsley, but that was the decision that was made in the end and he was put in the coffin.

Talking to you earlier in the season, you said that you hadn’t yet determined who would die, so how deep in the process was it when you settled on him?
As we moved forward, we narrowed it down, but I think we made the final decision that it was Kingsley before we started into the back nine episodes.

We didn’t really get to sit with Kingsley’s death as the episode jumped right to dealing with Andre, so what impact will Kingsley’s memory and actions have moving forward? Andre will surely be thankful, but Cookie and Hakeem should probably feel some guilt for how they treated him.
I hope that it will resonate. It’s not just his death but what he offered in his death. He actually offered Andre life in the end, so I think he will always live on with the Lyons. And the loss of him will impact Lucious and the family moving forward.

Do you think the hype of who died got bigger than you expected? People see a coffin and immediately jump to the biggest conclusions, such as losing an original character.
We definitely hoped that it would be something people would talk about and speculate about who was in the coffin. In that way, it was successful. I don’t know if we could have predicted that people would have cared as much as they did. I guess that was a little bit of a surprise. There were episodes where I felt like big things were happening and people were like, “But who’s in the coffin?” So it did take on a life of its own, but I’m not mad at that.

In the season 4 finale, you married Lucious and Cookie. Now, in the season 5 finale, you split up Lucious and Cookie. After bringing them together, why did this feel like the appropriate move?
This season was a test of their relationship, a test of ride-or-die. People tend to look at relationships through rose-tinted glasses, and this season was just a matter of, “Yes, they love each other, but what happens when they’re together, and these people who have gone through so much, could their relationship actually be problematic and something you have to fight for?” So we were just trying to show how difficult it is. Yes, they love each other, but is that enough? And that’s an ongoing question; that question isn’t answered in our finale. Even though they separate there, even Cookie says it, it’s not that they don’t love each other, it’s can they be together?

So then you don’t think the damage is irreparable? Cookie seems to want to permanently set ablaze to the relationship when she says that she slept with Damon.
That’s exactly why she does it. I think what’s interesting is if they do come back together, they will be coming back together with their eyes wide open and knowing how difficult it will be. So I don’t think the door is closed, it’s just a matter if they can come back to it — and if they do come back to it, they’ll come back to it in a more mature way.

What can you say about where Lucious is going and what he plans on doing?
What he tells us is that he’s going to disappear for awhile so he can find out what exactly Damon and the federal prosecutor have against him. But, I think that he may leave and discover some new things about himself before he comes back.


Andre has been through more than anyone on this show, and now, he’s lost a brother, but gained a heart, wife, and, soon, a child. So what should we expect for him moving forward?
He was on a journey with where he was with his faith and his belief in God and what he thought he could have in his life, and what I think he learned through this season was that beyond Rhonda, beyond losing his kid, there may be hope for him in the future. He was at a place where he didn’t think that he could have good things in his life, and now he realizes that it is a possibility.

When your season 6 renewal was announced, Fox said there were “no plans” for Jussie to come back, but are you leaving door the open for him to eventually return?
I think we are still in the same place where we don’t have plans specifically at this moment. I mean, I haven’t gotten all of the writers together so we don’t really have our plans for next season.

Obviously there are so many other factors, but, in your ideal world, would your hope be that Jussie reappears at some point before the show ends?
It’s hard to imagine. I’m not sure yet; we will see as we start things next season how things play out.

For these last two episodes, you had the convenient option to say that Jamal was on his honeymoon, but have you figured out how you will handle his absence come next season?
It’s still in the process of being figured out.

What else can you tease about season 6?
It’s season 6, so I just think it needs to be bombastic and fun and crazy and very Empire. We’re open to turning it upside-down and seeing what falls out in terms of what new stuff, what new twists and turns we can come up with to make it exciting.

Now moving into season 6, you’re closer to the end than the beginning, so have you started planning an endgame for the series?
It’s unrealistic to not think about how it should end and how do you draw the empire to an epic conclusion. So I think that is definitely something in the back of my mind and the other executive producers’ minds.

Fox confirmed this morning that Empire’supcoming sixth season will be its last, with the musical drama concluding after more than 100 episodes on the network. It was previously confirmed that the show had “no plans” to include Smollett in its sixth season, although the future of his character, the newly married Jamal, would still be “open” as the season progressed. (Series finale, anybody?) Let’s see how it strikes back.

Also, since we’re on the topic of Fox, two other tidbits to pass along: That delightfully bizarre Masked Singer is coming back for two more seasons (set to debut in the fall and spring), and that dad you love to hate and hate to love, Tim Allen’s Last Man Standing,will also be returning in 2020.

A month after all criminal charges against actor Jussie Smollett were unexpectedly dropped, the show he’s most famous for, Empire, has been officially renewed for a sixth season — however, he’s not going to be back anytime soon. In a statement released by Fox Entertainment and 20th Century Fox TV, the studios confirmed Smollett’s key supporting character, Jamal, will not be appearing on the Fox drama in the immediate future, although that could change. “By mutual agreement, the studio has negotiated an extension to Jussie Smollett’s option for season six, but at this time there are no plans for the character of Jamal to return to Empire,” the statement reads.

Smollett was written out of Empire’s final two episodes this season, due to the ongoing criminal investigation that alleged he staged his own hate-crime attack in Chicago with the help of two accomplices. He pleaded not guilty to a 16-count indictment before the case’s ultimate dismissal, a reversal that has royally pissed off Chicago, so much so that the city is suing Smollett.

Update: On behalf of the actor, Smollett’s representative issued a statement. “We’ve been told that Jussie will not be on Empire in the beginning of the season but he appreciates they have extended his contract to keep Jamal’s future open,” his rep said. “Most importantly he is grateful to Fox and Empire leadership, cast, crew and fans for their unwavering support.”

5 to 6 seasons is the best time to end a TV show any way....

After 5 seasons the actors get tired or demand more money, the showrunners usually leave and the writing get lazy....

Disney buying Fox gives them the perfect out...
