You’re reading it wrong. The age of consent is just what it says it is. The close in age exception is an exception to having sex with someone who is UNDER the age of consent if both are close in age. Therefore in a state where the age of consent is 16, it is not illegal for a 40 year old man to have sex with a 16 year old.

I hear what you're saying as far as her being "16", but that don't fly in the state of Tennessee where this occurred anyways. Age of consent is 18. And anyone trying to justify fucking a 16 y/o child is just sick. Don't care what state it is.

The close in age exemption only comes into account when at least one of the actors is BELOW the age of consent. That is the law as stated by my quote and your quote.
The only point I was making was to contrast all the OPINIONS suggesting he was a depraved pediophile for having sex with a 16 year old when in fact the law in 31 states makes having sex with a 16 year old perfectly legal, even if the man was 40.
