I don't think yall understand the rule. He doesn't need to be "set". He has to be in the legal guardian position outside of the box before the player gets into a shooting motion. Lebron was in legal position. His movement wasn't sliding under Durant to cause contact. That's why the ref who was reviewing it live on set said he thought Lebron was in legal position and it was indeed a charge. The fact the ref originally called it a charge and the ref reviewing it on live tv also said he thought it was a charge is enough proof was questionable enough to not be overturned.

and there is a question on whether that should have even been reviewed because the trigger is in the restricted area. Lebron was outside of it.

They review to see if he was or wasn't
