Because that dude was very much alive and cognizant of his surroundings, so if he did indeed have a gun there's no way the officer should have proceeded down those stairs and gotten that close to him without first securing the gun...
If there was a gun involved he could have easily turned around and cut that officer down the way he followed him after the shooting
