Three plead not guilty to charges of lying to police in probe of Fort Lee man's murder

Two women and a man pleaded not guilty Wednesday to charges that they lied to police during questioning in the kidnapping and murder of a Fort Lee car-service operator whose body was found in the trunk of his BMW in the Bronx.

Courtney Evelyn, 30, her brother, Dyrol Evelyn, 25, and Diana Escotto, 24, all of the Bronx, were arrested two weeks ago and charged with hindering apprehension in the murder of 24-year-old Jordan Johnson.

The three provided false information when they were being questioned by police about the killing, Danielle Grootenboer, a Bergen County assistant prosecutor, said at a hearing Wednesday in Superior Court in Hackensack.

Two others – Robert Martinez, 26, and Andre Jamal Thompson, 25, both of Massachusetts – have been arrested and charged with murder. They are awaiting extradition to Bergen County.

Grootenboer asked Judge Edward Jerejian to set $100,000 bail each for Courtney and Dyrol Evelyn and for Escotto, saying that anyone charged with lying to police is an increased flight risk.

Christopher Renfroe, an attorney for Courtney Evelyn, argued that a $100,000 bail is too high for a third-degree charge of hindering apprehension. He said Courtney Evelyn was employed until her arrest and has no criminal record, and that police first came to her house, took her to the 52nd Precinct in the Bronx for questioning, and later arrested her at her home. She made no attempt to flee throughout, he said.

The attorney also said that it is not clear in the criminal complaint which statement made by his client constitutes a lie.

Jerejian set Courtney Evelyn's bail at $100,000 and ordered her not to make any contact with the victim's relatives. If she does make bail, she is required to surrender her passport and remain in the New York City metro area.

Escotto and Dyrol Evelyn, who did not have attorneys at their hearing on Wednesday, were also held on $100,000 bail with similar conditions. Jerejian entered not-guilty pleas on their behalves.

The cases of all three will now be referred to a Bergen County grand jury for indictment.

Authorities said Johnson, who had been friends with Thompson and Martinez, disappeared from his apartment in the luxury Carriage House building in Fort Lee on the night of Jan. 13. They said Thompson and Martinez lured Johnson to an apartment in Fort Lee that Thompson used sometimes, where they assaulted him and took his cellphone, keys and his 2013 BMW 550i Gran Turismo before killing him.

The two men then used Johnson's phone to send text messages to his girlfriend, Megan Faulkner, luring her from the Carriage House apartment she shared with Johnson to an address in Harlem, prosecutors said. Faulkner returned to the apartment around 2 a.m. on Jan. 14, only to find it burglarized, with jewelry, cash and other items missing, prosecutors said.

Faulkner and Johnson's relatives called police to report the burglary and to report Johnson missing. Detectives found Johnson's car in the Bronx the next day, with his body in the trunk, authorities said.

Thompson and Martinez fled the state within hours of the killing, prosecutors said. Thompson was arrested in a hotel in Maryland on Feb. 4 and was being held there on $2 million bail. Martinez was located in Massachusetts and was being held at the Worcester County House of Corrections on $2 million bail.

Both are charged with felony murder, robbery, burglary and hindering apprehension. The murder charge carries a maximum penalty of life in prison.
