Determined to put his legal transgressions behind him before the start of the football season, 49ers linebacker Aldon Smith plead no-contest to three felony counts of possessing illegal assault rifles and misdemeanor DUI on Wednesday.

Smith will be sentenced July 25, two days after the 49ers report for training camp in Santa Clara. Smith faces anywhere from probation to four years and four months in Santa Clara County Jail.

The deal should clear the way for the NFL or 49ers to impose a suspension for the upcoming season. Such a suspension might range from one to four games if past cases are an indication, though the league has also imposed eight-game, full-season and indefinite suspensions of players for off-field conduct since 2007.

The Los Angeles City Attorney's Office is still weighing whether to charge Smith with a misdemeanor charge for allegedly making a false bomb threat at the Los Angeles airport in April. Smith has denied using the word "bomb'' during a random second screening by a TSA agent.

The gun charges carry a range of possible punishments, from probation to a maximum of four years and four months in prison. The three illegal assault rifles were discovered in 2012 after gang members crashed a party at Smith's house, stabbing him and shooting other guests.

The typical sentence for a first-time DUI conviction is six days on a weekend work crew. But in Smith's case, prosecutors have said there are three aggravating factors that could put him in jail for up to six months: He was involved in a collision (with a tree); his blood-alcohol level was nearly twice the legal limit; and he has a previous arrest in Florida for drunken driving. However, he also spent about six weeks in a substance abuse treatment program last year, missing five games.

Smith may be able to avoid being labeled a felon for the rest of his life by applying to the judge to have the three felony counts reduced to misdemeanors. Regardless of the judge's decision, the felonies do not count as serious or violent "strike'' crimes under the state's Three Strikes Law.

Despite Smith's run-ins with the law, 49ers general manager Trent Baalke gave the thumbs up earlier this month for the team to pick up the embattled linebacker's 2015 option, citing his commitment to a "humanistic'' approach.

The team has had nine arrests since 2012, the most in the NFL during that span, according to a review conducted by this newspaper. Four of those arrests came courtesy of Smith. In 2012, Smith was arrested in Miami Beach on suspicion of driving under the influence. He qualified for a diversion program for first-time offenders and charges were reduced to reckless driving.
 
Nope, plea deal that he worked out with the prosecutor. In just a short while, all of the legal troubles will be over and that includes the civil suits that he's already been settling.

The case itself was bullshit with the weapons because they were in his house, purchased legally and they wouldn't have found them if OTHER people hadn't been shooting up the party. Which also goes into the civil suits he's settling paying for people who got hurt by someone else at his house.

oh and unlike a lot of teams we actually have depth, so aldon smith not playing isn't going to make the defense trash. him playing makes it unreal.

No GOOD defense lawyer in his right mind would allow his client to plead no contest unless they have something worked out. It's basically placing his client's future in the palm of the prosecution and judge.

Just based off of the fact that Aldon pleaded no contest, I'm pretty sure they've got something in place in terms of a plea deal and as long as Aldon doesn't do anything stupid, we'll find out what the sentence is on the 25th of July.

The no contest plea will also prevent the plea from being used against Aldon in any subsequent civil lawsuit filed by anyone who was injured or suffered damages as a result of the firearm incident at his home.

He'll miss 4 games, 8 games max. No jail time...at least not during the season. They'll be fine.

he didn't know they were illegal to have in cali and they can't prove that he intentionally went to arizona to buy the guns and bring them back to california.
 
I'm not going to sugarcoat or downplay anything. In the REAL world, driving drunk is serious. Luckily Aldon did not seriously injure someone. With that being said...

Any 49ers fan should have already seen this coming & expected this already, so no reason to cry in the car. As for the NFL, Aldon will probably be suspended for half the season (6-8 games). We already have good solid backups in LB Cory Lemonier & Dan Skuta. Last year we were 5-0, when Aldon was out doing the rehab thing. We should get BOTH Aldon Smith & Navarrow Bowman back just before the playoffs! It will be a drop off but not a HUGE loss. We have a talented enough roster to compensate for the loss.

And LOL @ Seahawks fans popping shit. Especially after Marshawn Lynch got busted last year for a DUI too!

Yea, but you know Goodell loves to make examples of cats. Ignorance of the law is no excuse and that shit ain't gonna play well. My gut tells me 2-4 games but Goodell could get froggish. He'll play next season though.

Well it is kind of in this case imo. He didn't buy them illegally and wasn't doing anything illegal with them and they were in his home. that should be considered.

The dui there's no excuse for it at all in any way.

There's no excuse for the drunk driving. None.

The weapons and civil suits is bullshit imo. He got them legally and they were in his house and not being used.

The civil suits is because people got injured at his house.

He missed 5 games last season to go get treatment that should count for something.

8 games would basically send the message to not be proactive just play until they punish you.

That's not how it works though. If the charge is something that describes his "intent" to distribute, etc., that's one thing. My understanding (haven't followed this that closely) is that it's illegal to have them IN Cali? Fucked up as it sounds the way the law works in that case is if a law is on the books it's on every citizen to know what the law says. A judge might go light on him for a number of reasons but you can't really claim "I bought them in AZ, I didn't realize it would get me jammed up in Cali."

Then he's got to deal with the airport thing right?
