BGOL Lawyers: Should I take the first settlement the insurance co. offered?

Last year while riding in a tour van I fractured a bone in my back. The driver rushing didnt slow down on a speed bump and sent us flying in the air. I was in the back and got the worst of it. Been going to therapy and the MRI shows the injury

I hear back from the lawyer saying this is their top offer (not final) I look at the total and it was only 50k. After the lawyer fees I'll see 33k. I really was expecting more. What are my options? I dont want to go to trial and honestly if they offered 80k after the lawyer's cut I'd sign off.

What should I do? Do I risk losing it all if I go to court?

hold out for more....it aint going to trial, these thing hardly ever go to trial.

Is your injury temporary or permanent?

Do you expect a loss of income from this injury, do you sit in an office chair or do manual labor?

If it is something that is permanent than you need to go to jury trial and get a bigger settlement.

The insurance coverages should also be factored in, since they will only cover up to a certain point, than the driver has to pay.

Where did you get your attorney from? He should have contacted the Van's insurance provider and asked what the insurance policy and determined what the policy limits were. That should have been the start of Settlement. What were your damages? What type of injuries did you sustain? What were the hospital bills? Did you lose past, present and future earnings? What makes you think you are entitled to more than what was offered?

No loss of income or anything permanent. Still having pain. I'm not sure how much their insurance covers. Part of the settlement included a free pass for the driver. The driver was an older black man who stayed at the hospital with me. I dont want to sue him. And part of me doesnt want more than whats fair. I've been blessed financially so just seeking whats fair at this point. 33k dont seem like it.
 
I work for an Insurance company... Do not accept the first offer. They do not want a case like this to go to trial. Hold out for more and the offer will go up. They have already accepted liability for it, so the only argument is damages. It may not go up to the full value you are asking, but the offer will definitely go up. Even if they think they have a strong case, because of the cost of a trial it will make sense for them to settle. Your atty should know this. If he isnt telling you this... maybe you need new counsel.

During settlement talks, your injuries are permanent, and you expect substantial loss of income tied to that injury that the defendant caused. If their client was drunk or texting, than you need to bring that up.

Went local. There is an attorney office in the community I live in. They handled my divorce which went smooth. They do personal injury too. Even though my back was fractured it healed and I can do what I've been doing but the pain is there if sit I too long. The insurance company paid every single medical bill. No loss of income for me. So as far as that goes they did the right thing. I just thought my injury and the initial pain to my back and bowels was worth more. Couldnt pass anything for a week after the accident due to the trauma. I want them to be fair. Maybe a total payout of 50k is fair. But after the lawyer cut i dont look so sweet

Yeah exactly! My case they told me they had 300K to go after so for me to sit back, do my PT and stuff and they on it.

But I really don't care cause it's free tax free money.

In the legal community... you go after the deepest pockets not the obvious tortfeasor. How much money do you think you can get from the average individual? You can get a $500,000 verdict, but what if the the defendant is worth only $5,000? What do you do then?

So if dude had a cheap 20k liability coverage is the insurance company gonna pay more than that?
 
If you want top dollar be prepared to settle sometime just before opening arguments. I do this for a living. 6 new cases last week. Another 6 new cases this week. Shit is expensive but I can't fathom the alternative. (no cases)
