I do address it. I said you can tell by his body language. What they were doing. I even gave a breakdown for it. You can't ALLOW me to not do anything. The mom of the burger flipper caught on video beating two unruly McDonald's customers insists her ex-con son was just trying to get his life together when things went wrong on the late shift.
Rayon McIntosh appeared in Manhattan Criminal Court yesterday to face assault and weapons charges in the Greenwich Village beatdown seen round the Net.
"My son is a loving individual - not a criminal," said the 52-year-old mom, who did not give her name. "He wasn't walking the streets and looking for a fight or trying to rob somebody. He was working."
McIntosh, 31, spent more than a decade behind bars in the 2000 slaying of a classmate.
In the incident last Thursday at the Mickey D's on W. Third St., he apparently snapped when Denise Darbeau and Rachel Edwards, both 24, allegedly lobbed a barrage of insults at him and co-workers.
Michael Joseph, who was also working that night, testified that one of the women yelled at a third employee: "F--k you! I hope you get deported."
When the two women jumped over the counter, he said, McIntosh grabbed a metal rod and started hitting the two. Darbeau suffered a fractured skull.
McIntosh was held in lieu of $40,000 bail and is due in court Dec. 2.

I just love the way some of the media are omitting important factors like the fact that one of the "victims" slapped the dude which in itself is actually assault.
Even the prosecution are presenting video evidence that actually has the bits showing the victims clambering over the counter in pursuit of the cashier claiming that that portion of the tape is absent due to a technical glitch.

If you are referring me being bias to individuals who are victims, then you are correct. The man was doing his job and was attacked by two thugs. I am sick of hearing and reading about thugs on the attack.
And to the video, he stopped AFTER they stopped trying to get up. Not excessive at all. Turn on prison documentaries and see how guards handle attackers just like these two thugs. The attackers are hit until they comply.

I had it explained to me that just slap itself isn't grounds for assault. It's menacing. In Florida it's assault. I was wondering why she didn't get charged either. But that's how it was explained to me. If she had left a mark on him or cut him or something it's assault.

If a cut/gash or something along those lines can be shown thats caused from the slap they would have been charged accordingly even if its from a ring/bracelet etc..

If he is truly going to be judged by a jury of his peers (his age) then I think they would easily say not guilty or possibly convict him on maybe one charge. Maybe violation of probation or someshit.
