He completely stopped at 44 seconds in. He took both hands off the rod. and stood over them. At 39 secs they were both down. And he was advancing. His body didn't jar. So they weren't hitting him back. His body showed no movement other than advancing. The short 1 had been on the ground from 39 and received 2 hits while on the ground.

Where was the knife? Where was the gun? If the short 1 had a weapon, he went to the other 1 in black. He hit her again at 45. He hit her twice. Where was her knife and gun? The short 1 still hadn't gotten up. That wasn't plenty of time to pull your knife gun? Trying to get up? She was probably laying on the ground bleeding. Where was the knife gun?

At 48 the other employee tried to stop him. He was standing over the short 1. At 50. He completely stops. Stands up straight. And looks out into the main room of the restaurant. Still no knife gun. 4 seconds pass and he's back to hitting the other 1. So that's 2 times he could've stopped doing it.

Where were the vicious bulldaggers knives and guns? He didn't get hit but 1 time the initial slap. His body didn't move when it was visible from any other force. Meaning nobody was hitting him. kicking him, biting him.

If they had knives and guns drawn out to be getting beaten like that why didn't the other employees who were looking down at the women move? Nobody said gun. Nobody said knife. They moved out of the way of him swinging his mighty rod. Not from the women on the floor.

At 44 seconds in. He could've stopped. He could've backed up. Still held his mighty rod. It was a corner. He could've gone out the back door. They were on the floor. They were not advancing on him. His reactions, and the reactions of his coworkers? Tell me they didn't have weapons. As a matter of fact the reaction of 2 of the coworkers 1 in the blue and 1 in the red. Show me because they checked on the short 1 multiple times. You don't do that if someone is pulling a knife. The chick isn't a ninja. She just got whacked on the head but good. She didn't have hidden shuriken and kunai daggers.

The guy could've left at 44. It will be interesting to see what happens next. I notice he didn't back up once. He advanced the entire time. He didn't even attempt too. He didn't back up and then proceed. Hmph.

when a fight/incident like this is going on,you're not there being over analytical like you/we are doing here,you subdue the person,atleast to your judgement.

Now you can speculate with 30secs,40s etc..fact remain until the participants speak on the issue in court etc..i give the defendant the benefit of the doubt in making sure he FEEL safe and the aggressors are subdued,since he is the one who were attacked,not you or me.

Your sarcasm ignores the obvious double standard which exists when men of color are involved. Do you remember the old white dude in Texas who shot and killed two burglars fleeing from his neighbors house. That old guy killed these mexican burglars and got off... he was even held up as a hero for defending his neighbors property. In the Md's incident the employee was defending himself.

Points to consider; the video shows two women pacing back on forth between customers and cussing out employees, obviously looking for trouble. Nobody says shit to them... everyone keeps there distance. One woman smacks the guy at the register and everybody runs away... quite possibly thinking these crazy ass woman might start shooting. Point is if someone is coming for you and you really don't have anywhere to run all you can do is fight back. Where is this guy going... the back office? if this woman has a gun how far can he get before a bullet catches him. He did what most people in that situation would've done.

As a footnote, the white chick screaming actually heightens the situation. If your on the ground and you hear a shrill voice yelling like that you're gonna try to get up.

you would be correct it this was an ordinary situation. If it was shown that he "spazzed out" during the initial verbal confrontation, or after the initial slap, I would agree with you. However what is shown on the video leads me sir to conclude that your assessment is full of shit. That he is black is irrelevant. That they were females is also irrelevant. That "black people defend the dumbest things" is a deflection.

A young woman bludgeoned by an ex-con McDonald's cashier during an argument could have permanent brain damage, her angry mother said Monday.

Denise Darbeau, 24, has been hospitalized since Thursday's violent clash in Greenwich Village, and her prognosis is unclear.

"She has memory loss. She's been heavily sedated. The doctors say it's too early to tell," said Darbeau's mother, who declined to give her name.

Mickey D's employee Rayon McIntosh, 31, used a metal bat to beat Darbeau and pal Rachel Edwards after they jumped behind the counter during a dispute over a $50 bill.

McIntosh is on parole after serving 10 years for manslaughter for shooting and killing a 17-year-old classmate in 2000.

Darbeau's mother said her daughter was unarmed and didn't deserve the beating, some of which occurred while she was helpless on the floor.

"Our concern is the background checks they do at McDonald's," the mother said of McIntosh's employment.

"I believe in second chances. But maybe they should not put people with violent backgrounds dealing with customers."

McDonald's could not be reached for immediate comment on its policies.

McIntosh is being held on an assault charge. Darbeau and Edwards were charged with menacing, criminal trespass and disorderly conduct.

"My daughter is just your average 24-year-old," her mother said. "She's fun-loving and full of life. We just want our daughter back the way she was.

So by your logic an ex felon- a non ordinary citizen- shouldn't be expected to protect themselves?

This incident is unfortunate and perhaps he should have let another employee handle the order. If another employee had handled the order- say a white one, or a black one without a criminal record- would you feel the same way?
