Multiple eyewitnesses and surveillance videotape and these cops are STILL on the job with no repercussions. On duty policemen arrive and let the fight starters leave and THEY ARRESTED THE UNARMED VICTIM as well as TWO UNINVOLVED EYEWITNESSES! I've been Googling unsuccessfully for 30 minutes to find any pictures of Murphy or Orsa or McNamara - plenty of pics of the innocent guy they gang attacked, though :angry:

Two off-duty Chicago cops who beat up a man and pulled a gun on him inside a taco joint will finally be fired — a decade after the caught-on-camera attack.

Officers Brian Murphy and Jason Orsa will again be fired for the 2006 beat down inside a Taco Burrito King, the Chicago Tribune reported. The pair was ousted five years after the attack on Obed "OJ" DeLeon, but a judge overturned their discharges in 2012 and put them back on duty.

Last month, an appeals court reversed their reinstatements — which means they’ll be fired again, unless they appeal to the state’s Supreme Court.

"My (then-unborn) son is 10 years old now!" DeLeon told the newspaper, commenting on the lengthy court process.

DeLeon’s fiancée was pregnant and craving tacos in 2006 when he made a pre-dawn run to the Taco Burrito King to pick her up some snacks.

When he got to the fast-food joint, he found a car blocking the parking lot. Frustrated, he entered the taco shop complaining about the poor parking job as he walked inside, asking the late-night crowd inside which “a--hole” had parked so carelessly.

"What if I'm the a--hole?" Orsa replied, according to testimony from a police board hearing. The plainclothes cop was there with three buddies — Murphy, a third off-duty officer named Daniel McNamara, and a Marine who had just returned from Iraq — dining after a night of drinking at a nearby bar.

"Then stop being an a--hole, and move your car," DeLeon said, according to witnesses.

Surveillance video from inside the restaurant showed the table of four diners gesturing and talking to the standing DeLeon. Murphy abruptly got up and pulled out his gun to confront DeLeon. The three others followed Murphy’s lead.


The four surrounded DeLeon and knocked him to the ground, the video showed. When he got back up, the group beat him down again and ripped open his shirt.


"It happened so fast," DeLeon testified years after the 2006 beating. "People were just jumping on my back, kicking me."


Other diners called 911 to report “a white man with a gun,” apparently unaware that Murphy was a cop.

When officers showed up, at least two witnesses told them the four diners has started the fight with DeLeon.


"Is that the story you're sticking with?" one of the responding officers asked before arresting the two witnesses for “being in the wrong place at the wrong time.”


DeLeon was arrested, too, despite multiple accounts that claimed the three off-duty cops and their Marine friend launched the assault. The foursome was allowed to leave the taco joint through a back door.

Neither Murphy, Orsa nor McNamara filed use-of-force reports, required for both on- and off-duty cops involved in altercations. DeLeon, however, did file a complaint against the officers — which wasn’t investigated until a year later.

Formal charges were brought against the cops in 2010. The police board fired Murphy and Orsa — but their punishment didn’t last for long.

In 2012, Judge Kathleen M. Pantle overturned the dismissals, granted the cops their jobs back and awarded them back pay. She said she believed the cops, who claimed they were scared for their lives during the brawl, and blasted DeLeon as a criminal.


"All you have to do is look at him and know he's a gang member," she said according to court transcripts.
"Anybody looking at the videotape knows that as soon as he walks in the door."

DeLeon — who has several gang-related tattoos — admitted that he was once involved in criminal activity, but gave up the life when he met his would-be fiancée.

The case made its way to an appeals court last month, which sided with DeLeon. The fact that Murphy pulled out his gun unprovoked was reason enough to fire him, the court said.

The two cops will be fired, pending a possible appeal to the Supreme Court. It’s not clear if the officers plan to do so.

Nothing has really changed in 10yrs..just more cams...DeLeon couldv'e easily been killed with the same end results and no charges filed against any of the 4 main perpetrators, other officers who just stood by or unidentified individuals that threw in punches and kicks..

10 years.... even though they're getting fired again now, they got 10 years pay that I'm sure they're not gonna have to give back.

but yeah, i see some other loophole opening for them.

and what about the judge??? dudes a gang member...so what? gang members dont deserve justice?

yeah that judge should be brought up for review if they are still on the bench. total bullshit.
