go down to the unemployment office and ask for the documentation listing what factors affect your eligibility for unemployment.

there is a difference between getting laid off and getting fired. if u get fired, u dont get shit. also the firm has to pay into an unemployment insurance fund or some sort, not exactly sure. there is also a vesting period, maybe 3 months, that u have to be employed with the firm. again, u gotta find the right info because i dont know the exact guidelines for sure

i took a leave of absence and didn't come back after it was expired when i got my cdl and i still got unemployment.

there is a difference but u can still get unemployment if your fired u just have to prove that you were fired for something that wasnt your fault

put it like this

if you fucked up and they fire you, well then nope

but if they fire you, and you didn't fuck up, well then yea

but there are hurdles to jump if u truly want to get your way

If your in Texas like you screename suggest you can forget about getting fired and drawing unemployment. The only way you would get it would be to appeal the denial your gonna get. Even then you may or may not get it. In these hard times I would not do it. They would simply tell the employment people that you abandoned your job.

I think you can get fired(might vary by state), the company just has to approve it. So it depends on what it's for really. Like coming in late to work, you can probably get it. Some shit like looking at porn at work, I doubt it.

I think sometimes they just give it to you, because it's easier to just grant unemployment rather than worrying about a former worker contesting a firing.

Depends on how your emmployer responds and standards used in your state. You will need to tick off your employer so they will issue you jacked up performance reviews, PIP, and fired.

The unemployment we get in this country is a joke, people are gettings years of unemployment in other countries if they get laid off, plus they don't have employment at will. The same people promoting employment at will were hyping deregulation and you see where that has led us.

:dance::dance:

they make you jump through hurdles but you can still get it

i know thats right, depending on where you live you get penalized for getting fired, and you basically have to wait at least 6 weeks for a check or a appeal regarding why you got fired. The appeal can go on for weeks.

In Maryland, it doesn't matter how you lose/quit your job, you can still get it.

If you quit or were fired for just cause, you will get penalized...basically, for a month or so you won't get any unemployment, but after that, they have to give it to you. Now, they make you jump through hoops to get it...basically, they confirm why you no longer work at your previous job with your employer, and if you were laid off due to no fault of your own (or they can't contact your employer), they will immediately start it. If you were fired for cause or quit, they will deny you and then on the bottom of the rejection letter in small print, they tell you that you can appeal in writing. Appeal it and you will have to go to court against your employer where depending on the facts, the judge will figure out how much you will be penalized and when your unemployment will start.

Unemployment laws differ from state to state. If you live in a "work at will" state, companies can fire you just because you blink to fast. You can get unemployment, but you have to know your way through the system, and know what to request.

Firing:
If you are fired, you can "only" get unemployment if the company cannot prove gross neglect on your part. If someone is hurt, you come to work drunk, or high, you interfere with the nature of the business with tangible action, you are done. If you have received written warnings (that you signed), you are done. All companies will contest a firing. If you do not know the lingo, it's best to have a someone else represent you when they call you for the phone interview.

Layoff:
Layoffs are different than firings. A layoff means the company is basically "putting you on the bench" until more work is available. Layoff = instant unemployment benefits.

Quitting:
You can get unemployment if you quit (but it's tricky). You have to build a case of request against the employer such as....

Safe work environment (physical, mental, emotional)
Deserved wage increase
etc etc

These have to be documented cases where you put your request in writing, and it has to be over a period of time (up to 6 months in most states).

There is "always" a way to get unemployment. It's just about knowing what to say.

Depends on the state...Most states you have to get fired to even qualify for unemployment. And even then it doesnt mean you will get it. The case has to be reviewed.

being that u r in texas u they can fire u at will for any reason and dont have to tell u....

i had a homegirl of mine in houston quit her miserable job...she just stopped going in....they fired her for abandonment...but didnt contact her properly...so she filed unemployment and won

u could go on FMLA leave (or paid if your company has it) and stay on that bitch till it runs out...by law they have to hold your position for the duration of the FMLA leave...but after that they can deploy another employee in your position and when u get back your job is eliminated

in texas unemployment runs for a year (fyi)

there's tons of cats out there trying to get jobs and people wanna just give up thier's for unemployment. :smh:
