No. He won't. Fired "maybe", and with the way some corporations are starting to take up for their employees being bullied, he might not even get fired. The "spit" is what did it. The employee avoided the altercation, but once he was spit on (especially still during a pandemic), the employee was entitled to react. Spitting is an assault charge with a potential 6 month prison bid.
