[FLASH]http://www.liveleak.com/player.swf?token=a53_1193655118[/FLASH]I first heard of this trial on NPR two days ago. This investigation encircles the charitable organization that goes by the name "Holy Land Foundation" which sends money for humanitarian aid purposes to Palestine. It has been linked to Hamas in it's efforts to help the Palestinian people which is labeled and for good reasons, as a terrorist organization. Hamas is also the current government though in political power of those lands in which the United States government sends limited aid to as well. The reason I say it will go down in the history books is because of it's applications such as; is offering aid for humanitarian purposes considered supporting terrorism because the money can be funneled to other causes or free up resources through the extra help for such a thing as terrorism? I have mixed feelings about the case personally where on one hand they could be supporting terrorism and terrorist actions and on the other hand they are helping people in need of basic necessities such as food. Anyway, celebrations in the muslim community are ongoing and as this video shows they are considering it as a victory.

Victory they say? No, not by a long shot. It was simply a mistrial. There is going to be a retrial and the United States government has already made this clear. In this case, neither the defense nor the prosecutors are going to have it easy. The jury is going to have a even tougher time deciding this time around. There is a current vitory that should be discussed in this case though and it's for the United States government which as of right now has completely shut down the organization and its cash flow indefinitely.

U.S. District Judge Jorge Solis has denied a request by defense attorneys in the Holy Land Foundation terrorism financing case to throw out the indictment over allegations of prosecutorial misconduct.

The judge rejected defense arguments that prosecutors purposely allowed 19 exhibits, including charts, documents, photographs and videos not admitted into evidence, into the jury room during last year's trial. The defense argued in court papers that these materials unfairly swayed jurors, causing an Oct. 22 mistrial after 19 days of deliberations.

Prosecutors said the materials, most of which were shown to jurors during the two-month trial as learning aids to navigate the hundreds of pieces of admitted evidence, were placed in the jury room by mistake.

Attorneys for both sides have declined to comment on the judge's ruling, citing a long-standing gag order.

The defense had hoped to have the case thrown out before a Sept. 8 retrial date, scheduled after jurors in last year's trial failed to agree on verdicts for the five former Holy Land charity organizers.

The men are accused of using the former Richardson-based charity to raise millions of dollars in the U.S. for the Palestinian resistance group Hamas. American authorities banned all support of Hamas in 1995 when it declared it a terrorist organization because of its use of suicide bombers to target Israeli civilians.
