Manny Pacquiao, the eight-division world champion and congressman from the Philippines, has filed a motion through his attorneys in U.S. District Court in Nevada to issue a default against fellow boxer Floyd Mayweather in the defamation lawsuit against Mayweather.

Manny Pacquiao is asking for a default ruling in his defamation suit against Floyd Mayweather Jr., seeking up to $10 million in damages.

The default, according to one of Pacquiao's attorneys, Daniel Petrocelli, is in response to what he says is Mayweather's refusal to appear in court for a deposition. Court documents, which were obtained by USA TODAY Thursday, show that Pacquiao's representatives offered no fewer than 24 dates, all of which Mayweather allegedly declined, citing training as a reason for not showing up.
Mayweather is scheduled to fight Victor Ortiz at the MGM Grand in Las Vegas on Sept. 17. The documents contain photos of Mayweather taken in various parts of the country during the time he said he was in training.
Pacquiao's representatives are asking the court to issue a default, which means judgment would be rendered against Mayweather in Pacquiao's favor on the issue of defamation; there would then be a separate hearing on damages. Petrocelli said they would seek more than $10 million in damages, plus attorney fees.
"(Mayweather's) lawyer has to respond to the motion, and the judge will need to decide," Petrocelli said Thursday. "Judges can and do issue defaults against parties who do not obey their orders and won't participate in the discovery process according the rules. And you forfeit your opportunity to be a litigant when you defy the rules."
The defamation suit was originally filed by Pacquiao in response to allegations made by Mayweather and his trainer and uncle, Roger Mayweather, that Pacquiao was taking performance-enhancing drugs.
Pacquiao settled a defamation suit against Golden Boy Promotions in May.
In other news involving a possible Pacquiao-Mayweather mega-fight, Top Rank chairman Bob Arum, whose company represents Pacquiao, told Boxingscene.com this week that there are no issues remaining to stop a Pacquiao-Mayweather fight from happening in 2012. Arum reiterated that Pacquiao is willing to comply with Mayweather's blood-testing demands (Olympic style), which was the biggest stumbling block in getting the fighters in the ring.
Of course, the defamation suit could be a problem if it drags on. Also, both fighters would have to get past their upcoming opponents — Mayweather vs. Ortiz, and Pacquiao vs. Juan Manuel Marquez on Nov. 12, also at the MGM Grand.
 
To me PBF doesn't care. Otherwise he would have appeared in court. I got to give it to him. I hinted that the fight with Ortiz was just a way to pay Manny when he lost. If he judgement is around what he makes in the fight against Ortiz. Then PBF is a genius. In my opinion he never came back to fight Manny. I hope I am wrong. But I think he came back to pay Manny for his loss in court without really having to pay with his own money. Perfect plan as long as the verdict isnt on some 50 million shit.

True. But I think the fact gbp settled and made a public apology strengthens Manny's arguement. Not to mention PBF's refusal to defend himself. But for PBF it is no big deal. He will probably fork over the ortiz money and keep talking. He way to really get to manny is to do that and never fight him. PBF has already won the war. He has convincedlots of fans Manny is juicing. Nothing is going to change that.

Well it will be a disastrous perfect plan if Ortiz manages to beat the shit out of him AND he has to pay Pac the money. Upsets do happen.

On the reason for filing the motion:

"What it means in a word is that we have been attempting to take his deposition for a number of months. We notified him of his deposition a couple of months ago, but he refused to show up.

He was claiming that he was in training or about to start training and could not be disturbed and that he needed to spend 100 percent of his time and effort and attention on training.

He filed a brief with the court to excuse himself from the deposition, and the court said, "No," and it ordered him to appear. We then offered no fewer than 24 dates to get his deposition.

But on each occasion, his attorney told us that he could not and would not appear because he was now in training and could not be disturbed. But he has no right to refuse to appear for a duly noticed deposition.

In addition, this particular deposition was ordered by the court, and he has no right to defy a court order."

On where Pacquiao's lawyers say Mayweather was when he should have been in court:

"Furthermore, we've produced evidence in our motion that we have just filed showing that on the occasions when he claimed that he was unavailable because he was training, that he was, in fact, night clubbing.

This included being in places such as Atlanta and, on one occasion, we have a photo of him burning a one hundred dollar bill in a night club at a time when he said that he was not available for deposition.

So we have presented all of that evidence to the court, and we have asked the court to find that he is in willful defiance of his obligation of a litigant, and to enter a default judgment against him."

I know other people don't care. But I find this amazing. How this impacts them ever fighting. I don't know.
