In a decision that stunned legal experts, the Supreme Court ruled Wednesday that state governments have the authority to prosecute certain cases on tribal lands, effectively undermining centuries of legal precedent by expanding the power of states.

The court’s ruling in Oklahoma v. Castro-Huerta is a heavy blow to the sovereignty of tribes over their land and governance, federal Indian law experts and tribal leaders said. They raised concerns that states would usurp the hard-won autonomy of tribes to prosecute crimes on their own lands in a community-based way that meets the needs of their own citizens, which they said could complicate prosecutions in domestic violence and sexual assault cases.


The experts and leaders also worry the decision is a sign the high court could further erode other areas in which federal and tribal governments have authority, such as environmental regulation and child welfare on reservations, and give more power to states.

My older brother and older sister both think we are headed for a Civil War. My sister is 61 and usually level headed and she recently told me we just need to stop pussy footing around and get on with it because Black people are not going to continue to be treated like shit. My older brother who owns many guns wants to buy an AR15 primarily because he thinks war with white folks is on the horizon. I'm usually the loose cannon and I've told both of them in sadness that if it comes down to that we don't win. My brother basically said well when the time comes I plan on taking as many with me before I go. In any event if it comes down to that a lot of us won't be here for the aftermath.

Balkanization is preferable to civil war if it comes to that. It's also easy to do because the country is already divided into states that have a similar culture to the ones surrounding.

The Civil War was fought to oreserve the Union. This time we can just let these areas go and become a self-governing nations.
