So I got followed by a cop tonight ....

i'm a bit of a night owl and i like to get things done while everyone else is sleep ... because i enjoy the peace and quiet ...

so it's 3am ...and i decide to go for a walk .. and mail a letter ... the closest mailbox is about 4 blocks away ...

i get about a block into my stroll..when i feel a bright light behind me ... and a car comin' towards ...pullin' up alongside me ... now i'm walkin' against traffic ..in order for this car to pull up alongside me ... it has to cut across 3 lanes of traffic ... and drive in the wrong direction ...

now i keep walkin' ... and the cruiser is drivin' alongside me at 2 mph ... the cop says "how ya doin'?" ...i reply "fine" (my natural response when someone asks me that question) ...

he then asks "what ya doin'?" ... i reply "mindin' my business"... and continue walkin' ....

he then asks "where ya headed?" ... i respond with something to the effect of, "i don't have to tell you that under my right against self-incrimination" ...
he responds "oh, so you're one of those guys?"... i do not respond ...

he then asks "where ya comin' from?" ... i then ask "am i bein' detained or am i free to go?" ...to which he retorts "how are ya bein' detained when you're still walkin'?"

so i keep on walkin' .... he's still followin' me ...goin' the wrong way down the street ... and he still has his bright ass light shinin' in my face ... i look over occasionally as i spoke to him ... but i can't see his face ..much less a badge number ... i can't even see the number of his police cruiser ..

he then adds "don't you think it's weird someone bein' out at 3 in the morning?"...i reiterate "i do not want to answer your questions and i do not want to talk to you"..

i continue walkin'.....he continues followin' me ... it's now been about a block and a half ....

he asks "don't ya think it's strange takin' the 5th" .. he says "i mean usually only someone who has something to hide takes the 5th"..."do you have anything to hide" ..."are you out here plannin' to rob somebody?"

i keep quiet ...and keep walkin' .... he keeps followin' me ...

he keeps on "i mean usually when you ask an innocent person where they're goin', they say 'oh, i couldn't sleep' or 'i'm jus goin' for a walk' or 'i'm headed to work'"..."i mean, that's all you have to say"...

i keep quiet ... and keep walkin' ... he keeps creepin' alongside me ..

he continues "don't ya think it's rude not to speak to someone when they are askin' you a question?" ..."is that how you were raised?"

he continues askin' me questions of this nature.... i continue walkin ...i'm about a half a block from the mailbox ...

FINALLY ...he realizes ...that i'm not gonna tell him where i'm goin' ...and i'm not gonna stop walkin' to talk to him ...

so he peels out ...and as he's takin' off.. he says "i'll be seein' you around i'm sure"... and he makes a left at the corner ...and i try to get a plate number or car number ... but my eyes are all fucked up from have that fuckin' light in my face for the past 5-6 minutes ...

anyways ... i get to the mailbox ...drop my letter off and head home ... and wouldn't you know this cop doubles back and drives by me as i'm walkin' home!!

next time this happens i will be gettin' a badge number and filin' a complaint ....

shoulda stopped and talked to him long enough to get a name and badge number .

then again, who knows what coulda happened at that point. you were being harassed by a cop at 3am. mighta been better to do what you did and keep it pushin...

gotta pick your battles wisely.

how do you turn it on and off and where does the video record to?

I will have to assume that he is up to no good if he looks suspect and does not give straight answers when asked. if that was me i was simply gonna say what i was doing walking down the streets at 3am. The policeman was doing his job, which is of protecting people.

because i'm tryna give you a detailed account of the story ...

i don't feel i was bein' a smart ass to a cop .... i stated my position and kept it movin' ...he kept followin' me ...as if he was waitin' for me to commit a crime right in front of him...

several smart-ass comments went through my head ... but i didn't say any of them ...

and why would a police officer feel the need to follow someone ...who jus walkin' down the street ...

i'm tired of cops violatin' my rights ..actin' like they did me a favor by lettin' me off with a warnin'... and actin' like i should be grateful ....

if he drives by and want to say good evenin' ... jus to make his presence known ...and drive off... cool... because i have no intentions of breakin' any laws ...

at what point...should i invoke my right to remain silent ...after they've slapped the handcuffs on me... after i've tried to explain my position ... or after i've confessed and given the DA a slam dunk case against me ....

there's like a hundreds of thousands of laws on the books nowadays... (technically they're not laws, they're statutes) ... and by talkin' to a cop you might confess to some shit you didn't even know was illegal ...

so i'll continue to keep my mouth shut...

that depends on where he is walking and if that is the cops normal patrol.

I live in the burbs and there is nothing within walking distance on the street I live on.There is nothing to complain about if they see something out of the normal and investigate.

Hopefully they don't drive by when they see a pickup outside your house in the middle of the night and somebody moving your shit out.

Recently there have been one burglary and one attempted so they patrol more than they used to. The reason being the block association complained that the taxes are high and they never see patrols.

On another occasion it had been pretty windy and the screen on my daughters window had come off. The screen was on the porch roof visible and her curtain was hanging out the window.

They rang the bell and the dog went off.When I came to the door they told me about the screen and said they were just checking.As they saw the dog trying to get at them they said you have nothing to worry about and have a nice day.

I agree it would be one thing if it was 3pm and then you could make the case that it was harassment but 3 am and not in an area that pedestrian traffic would be common at that time.

I live in a white neighborhood. White chicks are always jogging/running when I come home at 4 and 5 in the morning. The first it happened it scared the shit out of me when I heard the feet on the street. The OP was right in his actions.

Being a nite owl myself, this happened quite often also over the years.

But then again I do know how to talk to the police.

the envelope was in my jacket pocket along with both my hands ... and i wasn't about to take my hands out my pockets unless instructed to ... but first i would have stated that i don't consent to any searches if he had decided to get out of the car and pat me down ....

had he detained me ... i would have stopped ... had he decided to arrest me ..i would have offered no resistance ... i was not goin' to get into any kind of verbal or physical confrontation with him...

he jus didn't have the right to ask me where i was goin'...and i wasn't gonna tell him ...

Because it is 3am in a residential area that foot traffic at that time is unusual

If after you showed him your envelope or said mailing a letter and he persisted.You can invoke your right at anytime and cut off a conversation.

Granted you are totally w/ in right not respond to dude if you didn't want to but the time you took to say that you coulda said "the mailbox" and the situation woulda probably be done then and there and if not then I could understand ignoring him if he kept pressing...unless you meet a super asshole cop they usually respond to you the way you respond to them jmho

I'm a night owl too and thank God for Walmart cuz I can't get shit done during the day even during my time off
 
Now to the OP, while I do not discount your right to be walking about your biz at 3am, the police has to be checking up on you otherwise they would not be doing that part of their job called protection.
To me it all depends on how the approach is made. I have no problems answering a polite question, it's when they forget themselves and act crazy arrogant that I give them a hard time.
 
my smartass answer to "where are you going?" would have been "why, are you gonna give me a ride? presidential police escort???"

Most property theft happens at night.

btw Texas adds an enhancement to sentencing for residential burglaries for that very reason. They say that you would expect someone to be home and that you would do bodily harm so you get more time for nighttime burglaries.
