A man accused of molesting his New York roommate's model girlfriend while she slept claims he did not know he was doing it because he was sleepwalking.

Nick Liu, 27, is charged with one count of forcible touching and third-degree sexual abuse over an incident that took place in the Manhattan apartment he shared with Shane Payne on September 11, 2015.

Payne had flown his girlfriend, who has not been named, from Florida to New York for a romantic weekend. When she arrived, they went out for drinks at a bar on the Lower East Side, according to the New York Post, before they went home to have sex.

Payne told the Manhattan Criminal Court Wednesday his girlfriend fell asleep in bed after they had sex, at which point he left the bedroom and went to read a book on his couch in the living room.

Payne's girlfriend then testified she woke up to find Liu kissing her neck and molesting her, according to the Post.

She told the court she shouted, 'Stop, Stop!' as she pushed the 27-year-old away.

Payne's testified picked up on what happened immediately after the alleged incident.

'The next thing I remember is being violently shaken by [my girlfriend], and she’s screaming, "Nick fingered me!"' he told the court.

'She's in hysterics. I wake up and storm into Nick's room.'

Payne then said his roommate said to him: 'I'm so sorry, I can’t believe I did this.'

Traumatized by the alleged incident, Payne's girlfriend then flew home to Florida.

Lisa Philips, Liu's mother, then told the court her son had a sleep disorder since he was a boy and was asked by the prosecution to describe any incidents she could remember.

Philips, who is a kindergarten teacher in New Jersey, said: 'His dad and I would wake up and he'd be in our room lost, staring off into space'.

However, the upset mother then broke down during an intense cross-examination from Assistant District Attorney Mimi Mairs.

'Was there ever a time when your son was sleepwalking that he put his fingers in your vagina or your daughter's?' Mairs asked.

Philips broke down in tears, saying: 'That’s awful... What's wrong with you?'

Liu's girlfriend, Alexandra Berg, then spoke to the jury about experiences she had with his sleep issues over their five-year relationship.

Berg explained twice every month or so Liu would grab her breasts and vagina while he was asleep.

'The first few times it happened, I didn’t know he was asleep,' she told the court, according to the Post.

'He woke up during it, and you could see his eyes going from unconscious to confused.'

She then said her boyfriend called her immediately after the incident in September 2015.

'He felt horrible about what happened,' she said, before going on to say he moved out of the apartment the next week.

'(He) wanted to live alone to ensure nothing like this would happen again.'

Or you could look at it as sleepwalking is a great excuse when your not black, but when a black man, especially a big bad looking one uses that very same excuse, especially when the page is flipped and he becomes the weaker helpless victim, all of a sudden its no longer a viable excuse..
All I did was flip the situation in a way that the perpetrator could see things the way the original victim did, in order to bring out the hypocrisy of his defense..
Sure I used a black man, mainly because the white criminals I looked up, looked weak as fuck, while this guy looks as big, strong and mean as the rapist must have appeared to the woman he raped..
But I guess that doesn't fit the narrative you was pushing for so it flew over your head...

Basically I am saying would that sleepwalking defense work for a big strong mean looking black guy the way it works for a whimpy looking white looking guy...
Using a big mean looking white guy someone could easily say, sure it will work just as long as he is white...

An unemployed Manhattan man claimed that he was just sleepwalking when he molested his roommate’s bikini-model girlfriend — and Friday, a jury bought his bizarre story.

Alleged sex pervert Nick Liu, 27, was acquitted of all charges by the panel of two men and four women after three hours of deliberations — much to the shock of those watching in the courtroom.

“I’m very happy to have my life back,’’ a smiling Liu said after the verdict.

He had faced one count each of misdemeanor forcible touching and third-degree sex abuse.

While his accuser wept on the stand recounting her trauma during the incident, Liu’s lawyer successfully argued that his client shouldn’t be held responsible for his actions — because he hadn’t truly been awake at the time.

Liu, a Georgetown University graduate, got into hot water after a night of heavy drinking Sept. 11, 2015. Early the next morning, he wandered into roommate Shane Payne’s bedroom in the StuyTown pad they once shared.

Payne’s horrified girlfriend awoke to find Liu kissing her neck and putting his fingers inside her, she told jurors.

The brunette, who has posed for Hooter’s bikini calendar, yelled, “Stop! Stop!” as she shoved him off her.

During her tearful testimony, she insisted that Liu was fully conscious when he attacked her and even blurted to her, “Wait, we’re not going to do this?”

But the mild-mannered defendant told jurors he has suffered from sleepwalking since he was a young child.

He said he fell asleep that morning and that his next memory was of “someone jostling me quite aggressively.” He said he was distraught when he realized it was his pal’s girlfriend.

The out-of-work investment analyst said he ran back into his bedroom and started hyperventilating.

“I was breathing quite fast, I just felt horrible,” he testified.

His loyal girlfriend of five years, Alexandra Berg, talked on the stand about his history of sleep disturbances.

She said that he grabs her breasts and vagina about twice a month in his sleep.

“The first few times it happened, I didn’t know he was asleep,” she told the jury. “He woke up during it, and you could see his eyes going from unconscious to confused.”

Liu’s mom, Lisa Phillips, a kindergarten teacher, broke down in tears when Assistant District Attorney Mimi Mairs indelicately grilled her on the stand about her son sleepwalking as a child.

As the mom tried to explain her son’s behavior that night in 2015, Mairs asked, “Was there ever a time when your son was sleepwalking that he put his fingers in your vagina or your daughter’s?”

“That’s awful!” Phillips replied. “What is wrong with you?”

The jurors looked disgusted at the prosecutor’s line of questioning.

Liu’s lawyer, Dan Ollen, argued in summations that the law requires intent.

“You cannot intend to do something if you are not conscious,” Ollen said. The defense of sleepwalking wasn’t made up out of thin air.”

But the prosecutor countered that there is no science or medical diagnosis to back up the claim. She insisted that Liu knew what he was doing and the crime was about sexual gratification.

Liu left the courtroom accompanied by his girlfriend, parents and sister
