DAYTON, Ohio (Jan. 28) - Investigators believe China Arnold killed her infant daughter by putting her in a microwave oven. Arnold's attorneys argue she had nothing to do with the baby's death in 2005.

Jury selection for Arnold was scheduled to begin Monday in Montgomery County Common Pleas Court. Arnold, 27, has pleaded not guilty to aggravated murder. If convicted, she could face the death penalty.

China Arnold has been charged with killing her month-old daughter by burning her in a microwave. Her defense team said she had nothing to do with the child's death.
Police investigators believe Arnold killed 1-month-old Paris Talley by putting her in a microwave at her home. Coroner's officials have said the baby suffered high-heat internal injuries and had no external burns. They have ruled out scalding water, open flame or other possible causes of death that could have damaged the skin.

Defense attorney Jon Paul Rion has said Arnold had nothing to do with her daughter's death and was stunned when investigators told her that a microwave might have been involved. Arnold took the baby to the hospital after finding her unconscious and does not know how she died, Rion said.

During a pretrial hearing in July, police Detective Michael Galbraith said Arnold told him she arrived home in the early morning hours after drinking, fell asleep and was awakened at 2:30 a.m. by the baby's crying.

She said she warmed a bottle in the microwave oven, tried to give it to the baby, changed the child's diaper and then fell asleep on the couch with the baby on her chest.

Arnold said she and her children were the only ones in the apartment until her boyfriend arrived several hours later and noticed something was wrong with the baby.

Galbraith said Arnold told him: "If I hadn't gotten so drunk, I guess my baby wouldn't have died."

When cross-examined by Rion, Galbraith acknowledged that Arnold told him she did not know how the baby suffered the burns and that she had nothing to do with it that she could recall.

Earlier this month, defense witness Robert Belloto, a staff pharmacist at Good Samaritan Hospital, testified he does not believe it would have been possible for Arnold to place the baby in the microwave because the woman was so intoxicated.

Belloto said Arnold told him she had consumed about 40 percent of a pint of high-proof rum in 90 minutes. But he acknowledged that he had no other corroboration for her claim.

Life sentence given US woman found guilty of killing baby daughter in microwave oven

DAYTON, Ohio (AP) — A woman convicted of killing her month-old baby daughter in a microwave oven was spared the death penalty and sentenced Friday to life in prison without parole.

Montgomery County Common Pleas Judge Mary Wiseman sentenced China Arnold, 31, of Dayton, Ohio, who psychologists testified showed no signs of serious mental illness. Arnold declined to make a statement during her sentencing.

Arnold was convicted last week of aggravated murder by the same jury that recommended her punishment. Jurors deliberated about six hours Thursday and Friday.

Prosecutors say Arnold intentionally put 28-day-old Paris Talley in a microwave and turned it on after a fight with her boyfriend. The couple had argued over whether the boyfriend was the infant's biological father.

Defense attorney Jon Paul Rion argued that the evidence pointed as much to the boyfriend :smh: as it did to the child's mother, who Rion said was drunk at the time.

After Friday's hearing, Rion told the Dayton Daily News he would appeal. He did not immediately return a message left at his office by The Associated Press.

It was Arnold's third trial in her daughter's 2005 death. Her first trial ended in a mistrial when new witnesses surfaced just before closing arguments. Her second trial ended in a guilty verdict and a life sentence. But an appeals court overturned the conviction when it found prosecutorial misconduct and said the trial judge erred in not allowing a relevant witness to testify.

The sentencing phase was delayed earlier this week to allow time for a mental exam of Arnold. Two psychologists testified Thursday that Arnold was of average intelligence and showed no signs of serious mental illness.

Dr. Jeffrey Smalldon said Arnold suffered from a "low-grade chronic depressive condition" as well as alcohol and drug abuse. He said he found nothing "that would have justified the death of this child."

In arguing for the death sentence, Assistant Montgomery County Prosecutor Dan Brandt told the jury there were no factors that mitigate the "purposeful murder of baby Paris in that microwave."

Defense attorney Kevin Lennen said that death or life in prison would be a tough penalty, but death should go only to the worst offenders. He pointed to evidence that Arnold was drunk at the time of the baby's death.

yea im from dayton as well an when i heard this shit i knew she was black lol she lived in parkside an almost all that lives there is ghetto an black..i its sad plain an simple.i think they tore those building down or bout to .oh well she wont know it........rip little girl..:smh:
