I have my own personal experience of surveillance abuse, IP stolen costing millions of dollars utilizing backdoors in IT products that the NSA installed. You want to talk about the Chinese installing backdoors, how about the U.S. and the NSA.
Even if the government detained the hijackers that were prepared to die in a suicide mission, it would have been difficult to determine their plan from any interrogation. Remember the Boston Marathon bombers? They had bulk collection of metadata, they were warned by Russian officials and yet were unable to foil this plot on that day.
The September 11th attacks could have been thwarted by strengthening the cockpit doors and running background checks on people training to fly. There was a weak assassination plot attempted that failed against Bin Laden using Cruise Missiles which probably led to 9/11. Clearly, security measures were sufficient to deter the hijackers to only use box cutters instead of attempting to smuggle bombs on the planes
The probability that a plane will be taken over and flown into a building is next to zero.
What about Pearl Harbor?, should we use that event as justification to spy on Japanese Americans? This judges ruling seems to rely heavily on a 12 year old event to justify thwarting our Constitutional rights.

After discussions of the hostages and release of an Al Qaida propaganda tape, we are supposed to cower in fear and give all your freedom to the government? Clearly the government has blackmail information on this judge such as his porn viewing habits and infidelities. This judge does not want that brown envelope at his house addressed to his wife from the NSA.
He is also a political hack appointed by President Bill Clinton, that is trying to help out the Democratic Party. Having a ruling like this helps the image of President Obama.
